I think that is a scam, A search warrant has to be addressed to an individual and the police have to attend. Only inland revenue, customs and excise and the police have the power to search a house. Debt collectors have no power.

I do not see how not being given entry to a property is grounds for " obtaining a search warrant ". While a Militia Officer - Police in Lithuania in the 90's I carried out many searches. But simply turning up at a property and wanting to nose around then being refused entry, NEVER constituted a valid reason for the Prosecutors Office to issue search permits. These people are not even police.

Here in NZ we no longer have TV Licensing. Hope the UK follows soon.. theres plenty of ways for the BBC to get Funds.. For there Programs etc. (they sell overseas etc)

J Brady will be getting another invoice for processing his bullshit letters and its off to court we go when they fail to pay (which I'm sure they will). TV licencing is a SCAM. over here in Liverpool UK all it took to stop them was a removal of implied rights of access and it wasn't even in writing it was face to face when they turned up at the house unannounced, then we got a letter a week later from them acknowledging the removal of implied rights of access and confirmed they will never come back to the property but did say they may send a letter In a years time to see if the situation has changed but so far they haven't and it's been about 4 years now

Along with the monthly letters addressed to " the legal occupier" I've had the goons show up at my door many times (no TV licence here) asking who the legal occupier is. They have different tactics but it is always going to end the same with me refusing to answer any questions and them leaving without knowing any more than when they arrived. My latest bit of enjoyment (sad I know) with them is writing various comments on their unopened junk mail along with "RETURN TO SENDER, LEGAL OCCUPIER NOT INTERESTED" and posting it back. On one visit the guy refused to identify himself but I know it was TV licencing by the electronic gadget hanging from his belt. The next time they come in person and if they again do not identify themselves I am planning to say "just a moment" and go get dressed for outdoors, then together with my video camera rolling and my mobile in the other hand go back to the door and explain to the person that they have two choices, tell me who they are or I will follow them down the road while phoning the police to report a possible burglar testing peoples homes for vulnerability. I hope they turn and walk away, it will make a great video of what follows. Lastly, "the legal occupier" is not a legal entity and that is how they get away with such threatening letters. One goon even told me they can get my name from the council to which I simply replied "you better do that then", however I still get the same bullshit addressed to the legal occupier. If TV licencing ever sends me a generalized threatening letter with my name on it I will serve them notice of harassment, alarm and distress. If I receive two more after that they will be reported to the police as such. This will never happen though as they know they can't do such things. In any case they can not (at least where I live in the UK) apply for a warrant based on the refusal to answer questions, in other words they can not legally suspect me of needing a licence only on the basis of one's refusal to answer any question they may ask. To me it's a fun game I wish happened more often.

There is something called 'The Presumption of Innocence' which applies to every person, however, these shyster companies completely ignore this and operate under a presumption of guilt, which goes against every aspect of natural justice! I neither correspond with, nor otherwise communicate with shysters that wilfully misrepresent themselves and presume, without an iota of actual evidence, that there is a tv on the premises. I had a guy come here once who grabbed my hand while sat next to me, seeing me cry and placed it on his private area....I pulled away and he grabbed me again and said if I do this I want have too pay...that he would sort it and that I wouldn't here of them again for at least three years... I was so distraught, scared and went crazy....he ran out the house, begging for me not to report him, that he had a wife and children to feed.... I will never again let anyone in my house, it broke me and made me very nervous. So to all out their be careful please.

So what even if there is a tv on the premises? It's not illegal to own a television without having a licence. It is completely wrong and illegal to issue a search warrant to search somebody's house to see if they own a television set. There are various reasons they might do this including using it as a computer monitor and using it to view DVDs,blue ray, video etc. In their own letters they say the law states that you need a licence for watching TV, not for owning a TV set, so the only possible legal justification that could be given for applying for a warrant would be an attempt to catch the householder red-handed in the act of watching TV without a licence. Citing ownership of a television as a pretext for obtaining a warrant is a misrepresent.ation of the law. I'm not a lawyer, but isn't it obvious that a warrant issued under these circumstances is legally invalid and that this could be successfully argued in court? Saying that ownership of a TV proves you watch TV is a little bit like saying possession of a box of matches makes you an arsonist or possession of a coat with pockets makes you a shoplifter. Where's a competent lawyer when you need one. He/she would be a national hero if they organised a class action pro bono.

For years we were without a TV here in England. To begin with I wasn’t impressed by the threatening language and sheer lack of professionalism shown by the agency and their sub-contractors. Then there was a change and they became reasonable, not just with me but with everybody in my situation. They just reserved the power to arrive unannounced and look for apparatus. Never happened to us. Now we have a tv and the license requirements have been extended to on line devices capable of showing live streams from the BBC. I’m only unhappy with that because of the poor quality and bias of news and current affairs from the BBC. So I ignore that but delight in the natural history and better sport.

I have been without a Box Programming Unit ( some prefer to call them TV's) for over 7 years now. I just do not have the time sit and watch utter celebrity shite, Fear News or David Attenborough fannying around with some sort of animal or even worse listen to Weather people talking about dribs and drabs of rain with a chilly wind or talking about the coldest night since the previous week ! Don't be afraid of a warrant if they turn up with one ask to see it and if it has no address, date or judges signature tell them to feck off, it might not have your name because you have refused to give them it and the police have difficulty accessing your name. Complain about the police if they help them in executing the warrant they are only there to keep the peace, nothing more, if you have a smart TV you can have an aerial connected to listen to radio as no licence is required for radio so just put your set to any radio station and turn it off.

Enquired if I had a telly and acquiring the answers preceded to tell me they'd been sending me letters for a TV licence and I told him that they'd made good fire lighters for my solid fuel stove. He soon tooteled off saying he'd be sending me a fine. Brilliant I said, hope it's as good a fire lighter as the others he'd sent and shut the door. Went back to watching Sifi.

I ditched my TV two years ago. Since then, I've had roughly eight letters, plus two visits (by the SAME enforcement officer !). At both visits - I told him the only way he's getting into my home - is (a) with a search warrant, and (b) in the company of a police officer - which is my legal right. Until recently, they've left me alone. Now - I've started getting the same 'reminders' - but addressed to 'the occupier'. Just waiting on my next visit...!

I had a similar argument with TV licencing UK. When a red final demand arrived I phoned the TV licencing people and put the following points to them: "Please give me your full name". If they refuse, tell them they are scammers and the police will be informed. "I have told you I have no TV equipment. If you wish to call me a liar, do so with a full-page ad in the national press", now the TV licencing is privatised you cannot hide in the shadow of a government department. "You have told me that my goods will be seized if I do not pay forthwith". This is demanding money with menaces, a criminal offence in law. I got angry but remained polite. The manager who had been called was told that I demand compensation for the distress caused by their action. Failure to comply would mean a call to the police, with all persons named being complicit with bullying and intimidation to obtain money. 1 week later, I received a cheque for £50. They now send a reminder every two years; I do not open it, I write "no change" on the envelope, with "return to sender". I will not be bullied by anyone, any more. Stay polite all of the time, never swear or use colloquialisms that may be considered offensive.

I have not watched TV in any shape or formin over 5 years. I do everything online. The state should have no right to impose a tariff on us for the purpose of supporting a commercial enterprise. If it were not for the fact that politicians rely on their ego's being massaged by being "ON TV" this would not even be a discussion. If the beneficiaries of the TV licence produced quality programming then I am sure that people would willingly pay for it through subscription. This new proposal to introduce a tax on devices to replace the TV licence is disgusting & should be treated with the same contempt & intensity that water charges were. From the purchase of the devices, the electricity to power them to the broadband & telephone services used to run them. I have no interest or get no benefit in funding the RTE organisation.

I asked for legal advice for this very thing and attached is what they told me. Its an interesting read. TVL accompanied by a Police Officer. Can they enter you house with a warrant. No. Only the police officer has the right of entry *with a warrant* to search for items specified on the warrant (i.e. television equipment that is in use (i.e. switched on and tuned). Since non-payment of TV licence fees is a civil matter, not a criminal matter, then the police has no authority or reason to become involved unless there is a proven risk of harm to any party or damage to any property. TVLA has no authority to issue a summons. Only a justice of the peace or a magistrate can issue a summons, upon the laying of evidence from a material witness to the complaint. Any summons which does not come from a court, bearing a court seal and the name of the magistrate or his clerk and/or their signature, is fraudulent. Any summons bearing the name of anybody who claims to be the reporting person who was not actually a witness to the offence being reported is also fraudulent.

Technical point, Amazon firestick is a hard drive connected to a computer monitor. Just uninstall and delete all data, cache software and apps for live streams and all news. 😄👍also sky, and get rid of recording devices & aerials of any description connecting to your computer monitor or to recording device, then apply to cancel your licence confirming the above. They will remind you of the criteria anyway. Get their approval confirmation and a cancellation number from them.

I have just bought my house have been here a month and have already had a tv goon come to my. House. We were not in at the time but they left a letter which was addressed to this house with no name stating it was illegal to not own a tv lisence all in red capitals, it also said that we are under investigation, so apparently my house is under investigation though they can't even name the people who are occupying it. I want them to f off but i also dont want any face to face communication, i will never reveal any information and have told my wife to do the same. I worry if shes alone and slips up. We don't even have a tv but it rattles my cage so much. These letters and empty threats really piss me off. Some of my family members just say things like, oh its cheap you may aswell get one, or seem horrified about the whole situation. People are just sheep and dont seem to see the bigger picture.

I notice the way the letter is worded seems to imply that you need a licence to own a television. This is not the case where I live, as you only need a licence to view live TV or any BBC catch-up service. So Netflix for example is allowed without a licence being needed. I'm in the UK and stopped watching TV in December 1999. I have a TV now but only for watching my bought videos and DVDs. I checked before I bought it and was told that if it's not tuned into any channels I don't need a license. But every two years I get a letter requiring me to assure them that I don't watch TV and therefore don't need a licence, upon receipt of which they graciously leave me alone for two whole years before starting the process all over again. I've told them: "You'll know if/when I start watching TV because I'll get a licence" but they apparently don't believe me. There seems to be some law in the UK where, if you buy a TV, video player or DVD player, the shop has to send your details to the TV Licencing Office, and then they come at you for a licence for the device that they were "informed" you recently bought. Years ago I bought a video player for my mum. I tried a pre-emptive measure and wrote to TV Licencing, telling them that they'd soon be "informed" that I'd bought a video player , but that I'd bought it for my mother so I still didn't need a licence, so don't send me any "we've been informed" letters. never tell them you look forward to them getting a warrent , just say will that be a criminal warrent if entry ? let them answer on paper , then you have more proof of them lieing and acting like a member of the law Society or better still ask which member of their legal team advise them to go for it a criminal search warrant of entry after their name details etc

To think that you need a licence to watch TV, I find is completely insane. Do you also need a licence to listen to the radio? Do you need a licence to watch a video or a DVD through your TV set? The people, who through your,laws and Government insist on this being acceptable to the normal bloke on the street need to be taken to the Tower and dealt with.

When you buy a tv in uk or ireland in a shop the first question at the till is address for your warranty please. They then send your details to the fake license inspector. Never give your address. Tell them you live in your van. I had the inspector at my house 5 days ago. I told him to off and he said ok but he told me i have ten days to buy a licence. I told him to get a real job. So next step i guess will be a court summons. No worries. I will go. In ireland those who dont pay the court fines get jailed. The jail usually lets you out in max 1 day.

How very strange, that letter is not signed, there is no reverse liability. It means nothing and they know it!

Just supposing that they were able to get a search warrant. They are looking for a TV that is tuned to watch live TV. This they can only do by testing your TV with your own electricity. My advice is that you should charge them £159, paid in cash in advance, to use your electricity in performing the said test. Otherwise, turn off the electricity and jeer at them.

I've recently contacted them over the phone, saying that I do not wish any further visits at my home, if so, I will be calling the police for disturbance and causing stress to me and my family, I've also said clearly that I will not be providing any info regarding me or my property or if I have any satellite as it is non of their business in 5 days I received a letter that I do not need to purchase license anymore and they wished me a nice day Guys this whole license is a scam, but people are dumb to pay that.. You rock, bill them for contact. I do that to scammers on the phone. No proper caller ID means you must have an authorization number. No number, $25 notification and processing fee, $100 monthly late fee, your consent is automatic. They hang up real fast.

Strange how it's the TV equipment that they say requires the license yet it is actually the viewing of live broadcasts from the BBC that requires the license. Owning a TV is not against the law, only receiving the BBC signal.
