In today's video Immigration Lawyer Kaushik Ranchod from the Ranchod Law Group will touch base on an important immigration topic, the J1 Exceptional Hardship Waiver.
We'll be talking once again of one of the main mistakes I see applicants make which is confusing the no objection waiver and the exceptional hardship waiver.
These two are different from one and other and need to be used correctly so that you can increase the possibilities of having a successful outcome in your immigration visa application.
Also we talked about one of our latest success stories. This success story is in fact about a J1 Exceptional Hardship Waiver for an applicant from Jordan. However this can apply to applicants from any country across the globe.

Hello, I am a subject to the home residency rule and I am an F-1 student married to a US citizen and currently studying a bachelors degree. I am planning to pursue an OPT and after that a MS degree in a STEMM field. My question is can I apply for a waiver and be enrolled as a student and stay here in the USA while my paperwork is being processed by USCIS or do I have to leave the country and wait for the approval from my home country?

If an applicant is unable to serve in the military this could be a helpful factor for exceptional hardship.

Applied for Hardship waiver in March 2021 and it’s still in process, I am just wondering how long it will take to hear from USCIS.

Hi Jagdesh. I would allow for 16.5 months or longer for processing of your application if it is a j1 waiver if it is a I601a allow for 2 years or longer depending upon service center.

I have a A10 card based a asylum, I took a J1 visa to enter USA. My spouse is a us citizen and have severe depression issue, we will have our child in November 2023. Is it possible that I can apply for j1 waiver through hardship ? My home country doesn’t accept my no obligation waiver because of my current A10. Thanks

An applicant may be able to file a J1 hardship waiver based on mental health hardship and other factors should be evaluated as well. Having more than one US citizen qualifying relative is helpful to the case. You can contact our office at 916-613-3553 to go over the details of your case.
