if they're a subspecies then it's the same species. they're called the "little people" for a reason. silmarillion describes the beginning of every race (elves, dwarves, humans, ents, orcs & trolls), but the hobbits never get a separate story in that book. there would definitely be a mention if they were meant to be a separate race but they're repeatedly described as humans and shouldn't be counted separately.

I did say there was no explicit mention of privacy in the constitution. Freedom of assembly and the 4th do give some right to privacy. How much is up for debate which is where the court would decide. I'll stand by my argument that privacy is implied in the constitution.
