Hi art, I'm from the uk and I've worked all my life from 16 years old, I'm 33 now and ive always thought about wanting to move to the USA on a work visa to start off with but seems so hard to get the chance. I must add that I'm not a skilled worker and that what comes across to me that maybe it would be easy to turn me away, what advice would you give me to start the process ? Thank you

Hi, just watched your video and thank you its very informative, my friend in the philippines is a nurse and she applied for eb3 unskilled program almost 2yrs ago now she got an email from the U S department of labor employment and training administration office of foreign labor certification to be to be a health aid provider in NJ ,PERM, now they are telling them that there is 7 to 10 months waiting for a regular process for the filing of i-140 or pay a $2,500 premium process and get the result for just 15days. Is this legit? Do eb3 program really has premium processing fees option if you want to expedite the papers? Hope you can answer my question, thank you

USCIS says “ Skilled workers” are persons whose jobs require a minimum of 2 years training or experience”. Does it mean that they will only count training or experience, not both?

Hi Arthur, could you make another video that can enlighten us for the recent passed bill HR1044 (though it only passed the house yet). This is causing widely spread panic among the Chinese community. Would like to hear some voice from you!

Well, to be honest, I have been waiting since 2001 for any big or real changes to the immigration law, and Congress has done nothing. Nothing. We don't make videos about "pending bills" that could become law, because in 18 years, NONE of the pending bills became a law. My advice, don't worry. Panic is not productive. It either will or will not become a law, and even if it does becone a law, only GOD KNOWS what the Senate will add to it. So, worry and panic are not productive, and neither is explaining something that probably will not become a final law. Makes sense?

I don't get it, why doesn't skilled and professionals just apply for the EB-2 visas? Is it easier and better chances of getting approved with EB-3 Visa? Isn't it more beneficial for U.S. to bring in more professionals than an unskilled?

You need either an advanced degree or exceptional ability in your discipline to be eligible for EB-2, and even then for many people it's incredibly difficult to find a sponsor.

How this person is working if he does not have a green card? If he have a working permit what is it based in? Did not get your point.

If i understood it right, he's talking about the hypothetical person in this video working with their bachelor's degree in their own country before immigration. Meaning, they've already got a degree, as well as working on their master's degree. This meaning they have no reason to apply for an unskilled visa when they already have a degree. If you have a degree, it would be wrong sending in a visa saying you have no degree, can't work at a job that needs at least two years of trade school or whatever when you clearly can. If you do accidentally do this, your papers will have holes in them (2 different "stories" conflicting) meaning it'll rise the possibility of being denied drastically

Hi art, Thank you for making this video and exposing the truth. Here is my case : My wife and I are international students. My wife applied for EB3 unskilled janitorial position through a company that's willing to sponsor employment based green card. She started the process of filling LC just a month before her graduation. My wife graduated with bachelor's degree and applied for OPT, got approved and started working for a IT company. However, concurrently her EB3 was processing from biometrics to finally getting I-485 adjustment of status interview. This mourning we had an interview and the IO asked her why would she do this job when she has a degree? Well, she answered as advised by the lawyer that she took an opportunity because she needed a job and they accepted her quickly. The IO was a nice person and didn't grill us with difficult questions but did have concerns about my wife being a degree holder and having a second job in the IT company. Long story short, we got a letter at the end of the interview saying that final decision is to be made, we will contact you by mail if we need any further information. The letter also says not to inquire with the USCIS before 120 days. Now, we're very scared about out future. We have gone through an expensive process and we are not sure if the decision will be in our favor. Could you please help us understand what is going to happen next? Please help us! 😔
