I’ve been watching several different channels on VA disability. The one thing I want to stress to veterans is if you are denied please read the reason why you were denied and look up the CFR’s listed the denial letter. It’s not a “secret formula” on how to get 100% VA disability. “Education on the VA process is key!” I’m 100% P&T and my journey to getting there was getting Nexus Statements and DBQ’s for my service connected disabilities. I was able to get them for free from my treating physicians. Please do not pay anyone to assist with your VA claim unless it’s absolutely the last resort! VSO’s are free but it’s up to the Veteran to put in the work to assist the VSO with submitting a successful claim.

The VSO did all the work for me. I just told them what I was claiming and they took it from there. This isn't rocket science.

@catrinaxoxo9153 I didn’t have a really good VSO. I just used them to file my paperwork electronically. I did 90% of the work myself.

Great video... FDC if not in-service is: 1) DD-214 2)Diagnosis, 3) medical records/treatment records 4)Great Nexus linking to the established service connected disability, 5) DBQ, 6) Personal statement 7) 1 or more Lay Statements supporting your claim, 8) 1 or more VA higher case decisions supporting your claim as well, if you can find. VA Rater can not overlook their own case laws.. all this most of the time =💰

Definitely go through your records yourself, even with a VSO. You make their lives easier too by already knowing and telling them what diagnosis you already have and what paperwork is attached to each claim

@stanatkins You're right. In an ideal world, you shouldn't have to, but like everything else, you have to be the best advocate for yourself. There are many things you shouldn't have to do, but you still do it cause it helps. I "shouldn't have to" tell S1 to do their fucking job an put my weapons card on system for the 80th time. I "shouldn't have to" buy a dash cam for my car, to have extra proof for insurance purposes. I "shouldn't have to" lock my house or my doors in any neighborhood.

@stanatkins also, I don't tell them what to do, I simply help them by giving them relevant information about what I want to claim, what I have evidence for, and simply making them not waste time going aimlessly through thousands of pages of medical records.

I filed a claim for headaches in 2017. I was treated for headaches ( migraine,severe,frequent, light and sound sensitivity) while on active duty in 1991 and my service treatment record shows this to be true. I have been denied over and over. The process brought me to a federal judge via video. The judge requested a nexus letter and gave me 3 months to submit it. I had never heard of a nexus letter until that day. The 3 months has long passed and I wasn’t able to obtain a nexus. The claim is currently pending awaiting a judge. The video I just watched , you mentioned “implicit “ because of the active duty diagnosis of headaches?? Yet here I am still trying to prove myself. One problem with my case is that I was discharged in 1992 but did not know that I was eligible for healthcare and benefits through the VA until 2011. The VA says since I didn’t seek treatment for headaches after discharge then my headaches must have gone away. Headaches caused my decision to exit the Marine Corps, headaches contributed to my several divorces, to my not being able to complete college, to my having substance abuse problems, to my repeated failures at life. Help.

Back in the 60s and 70s, at your last physical, the person doing took 5 minutes, not once did he communicated with us about anything. The only thing I remember him saying was you.lost lots of hearing on your left ear. But yet it took the vA 7 yrs to finally award me 40 pct

Great tips. My biggest problem is gaps in documented treatment because I followed Dr's orders for OTC meds, ice, etc. I spent 3x as long in Reserve vs Active Duty. Very frustrating.

Write lay statements and get a buddy to sign it in INK that agrees with you cuz he/she was there. That was big for me. I have basically NOTHING in my service record, because they don't exist! I was in the reserves and got a new medical record each deployment, each school, etc. Idk where they are at now. Get those buddy statements, write your personal statements, if you can get nexus letters and do you C&P exams after studying the cfr and know exactly what they are looking for you to say. I explained plenty of things wrong and down played them not knowing I was screwing myself. I'm going to explained how I downplayed my symptoms because I was scared, taught to do it in the military, have memory issues, etc. Keep up the good fight!

Lay (buddy) statements don't count. You might as well forge your own letters. Were you really in the military? The same medical and school records follow you throughout your time in the service. You have no idea what you're talking about. You were "scared". We must have been in different military's.

I had 4 ear infections while in service. I get pulsatile tinnitus. (Hearing a heartbeat sound) is an actual type of tenitius. Most people,, including myself until i researched it think only rining in the ears . If you have a pulsatile tinnitus or a "wooshing" sound its tinnitus too. This type is caused mostly from ear or sinus infections. People generally think about loud noise. You may have good hearing, but havs a history of ENT infections. I havent filed for it yet but my research tells me to do it.

Also I injured my back inservice but was denied for low back pain 30 yrs later even though I have back pain now because they said it wasn't a severe enough injury. Such a crock.

I spoke with you last week and you told me about this video prior to you putting it out about looking through my med records and finding the gold in them. Well you was right I found things that I counted on va rep to find because I was to lazy to look. Well you was right…..I am in the process of joining your course. Thank You for being awesome!

I filed for chronic headaches 25 years ago and was denied. I went to sick call for it only twice. The reason I was denied was because I never got a profile or had time off work. Looks like the only route I have is a supplemental claim secondary to anxiety and depression unless there's a better route.

Hi i just got my Tinnitus approved secondary to my tension headaches the first time around by listening to you thanks - This will blow you away man i did my str will no help from anyone back in 2011-2012 my evidence was solid headaches was diagnosed low back also plus i had surgery to stop my headaches they returned st.pete office still denied those claims for 10 years finally got the lowback headaches left shoulder right and left upper approved with VES and QTC examiners then they low-ball my ratings and of course the wrong effective dates i appealed short to the judge because i already knew st.pete office isn't approving any claims for me no matter what the evidence say all st.pete examiners IMO stated least likely in service my in-service str lists at least 10 claims that i had a continuous of symptoms from 1984- 2023 the good i got 17 claims at the bva waiting for a judge to review them all have a diagnosis and a IMO so no remand based on the big D plus IMO - all my claims will get approved outside of my regional office except for Tinnitus i got a PTSD will all the evidence in my doctor did the DBQ they stalling as usual DBQ rating is a 70 percent rating they won't grant i already know this i know what the rater is going to say before i get the denial i been right 100 percent of the time bro i tell my family and friends they like wild You know them - only good that DAV do for me is write a good to great post brief to the bva on why the claims should have been granted by case laws i do my own claims - DAV do state this in there briefs to the bva veteran articulate his claims very well and his evidence is supported by case law -

I’m 74yr old Vietnam Vet w/stage 4 prostate cancer. Im rated 100% for cancer&100% for metasis of lymphoma. 50% major depressive order&ptsd. I have two smc k, 1 for housebound criteria &1 for loss of external organ. I’m considering filing for smc s. I’m told if i have one rate at 100%&another at 60% I would qualify. Is rating amount added to my present monthly compensation? Thank you for any info you can supply.

This video hit me hard because I absolutely missed out on potentially being rated 50% out of the gate. I didn't have the ability to put time into filing claims when I got out so I just got 10% for knee pain and didn't file anything else. Honestly, I didn't even know I could. But since the PACT act I've filed additional claims, and after I filed to have a few new claims added I decided to review my STR . I realized I had "Bilateral Pes Planus" listed plain and simple while on active duty. The even documented the orthopedic inserts. I basically had this claim all along. I reviewed my records and determined I have all the major claims I'm filing and the work is all done. I don't need to work for a Dx, I don't need to have a nexus letter, I don't need to file secondaries. It's all there.

Are you saying that if i have a full copy of my service treatment records i may have good chance at a V. A. claim for issues ?I know that while in military on Antarctica i went to doctor for isseus with problems with sense of smell issues as a generator watch. In a generator watch in power plant .

I have been asking for my records since the 80's and have never seen them. Except for the first time the VA denied my spine injury connection. They had all of my original records but would not let me even see them. .In the 80's they told me they were lost in a fire. In the 90's the VA doctor had them in his possession to deny my claim. Still wouldn't give me a copy.

Thank Jordan! Question: I claimed migraine sec tinnitus with dbq/imo. Now I have a TERA c&p exam. STR list migraine caused by solvent bottle explosion. Will this cause problems claiming secondary. My doctor did not mention it. How should I handle this?

Keyton if I’m understanding you correctly, you were diagnosed with migraines in active service since you said migraines were on your STR? If that’s the case, there’s nothing you need to do to service connect the disability if the event happened during active service

How do i get my medical records from when i was stationed at 32nd Street San Diego? Ive requested twice and just got a letter that bc only a dr can interpret the notes that are in service records so they will only release to a Dr!!! IS THIS LEGAL OR RIGHT?

I appreciate that feedback, I worked hard on refining & taking things OUT of the course that are not absolutely 100% essential to the end mission of maximizing the rating as quickly as possible. I have been working on my fathers info and have not been able to get a copy of any of his medical records. The national archive sent me a letter saying they don’t have anything and to contact the VA. The VA originally told me to get them from the national archives. How can I get his info?

Tricare online doesn’t work for older veterans. You have to do an FOIA request for service medical records. Oh yeah… and prepare to wait several MONTHS to get it. I’m going into month 5 and still waiting!

I served from 67 to 1971 all they (VA) could find of my medical records was from 1969 through 1971 in other words no records for the first two years. How is one to file an appeal without evidence.

There is a national archive center in St. Louis,MO. Go online and go to their website and you can receive your service records within 7 to 10 business days.

Are you talking service records or medical records? Service - do you have any paperwork? Orders, LES, pictures, commendations, etc? Medical - you will need to rebuild. Contact every military and civilian medical center you have ever been to. Many will still have them. Request copies. Get statements of folks who served with you documenting what happened. Personal statement with places, dates and proof you were there.

What VA are you talking about, I've filed on several different diagnosis claims and I get the same thing... get a nexus, none of the DRs I've been to will write one even when I've given them sample letters that have been VA approved

I half way agree and half disagree George. Even though it’s not our fault we weren’t prepared by the military, it’s certainly our responsibility to take ownership of the process. We’re grown adults; as soon as a tax-free passive pension is even mentioned in passing, the ears should perk up right away and think “okay, this is clearly life changing and important. I should do some research into this”. Agree with this 100% even was able to show my family member vet he/she had hypertension that wasnt even considered in the claim. However, STR records are good unless you were on official leave becase that DA 31 implies directly that if something happens to your during that time you are not im active duty and it will not apply. But the lazy raters unaware of even vurrent guidelines will not notice that ao no worriws. Cheer$!
