There are two main requirements that must be met in order to qualify for VA unemployability benefits. First, you must be unable to maintain substantially gainful employment due to your service-connected disabilities. Second, your disabilities must be rated at least 50% by the VA.
If you believe that you meet these qualifications, you will need to submit extensive documentation to the VA in order to have your claim approved. This documentation should include medical records, employment records, and any other documentation that can support your case.
The VA will also consider your age, education, and work experience when determining if you are eligible for VA unemployability benefits. If you are unable to meet the qualifications above, you may still be able to receive partial disability benefits from the VA.
If you are a veteran who is struggling to find work due to your service-connected disabilities, you may want to contact a qualified Veterans Benefits lawyer to help you with your claim. An experienced attorney can help you gather the necessary documentation and evidence to support your claim and give you the best chance of obtaining the benefits you deserve.

For almost ten years I lived on less then 10k a year because the VA wouldn’t do an MRI on my back. I’m great full for Combat Craig videos. With out his videos an help I’d still be struggling with a sever back injury an wrist injury an a TBI Keep up the great work Combat Craig

15+ years for me...even with 4 MRI until I got a new Dr and all of a sudden I needed emergency spinal fusion surgery...when the c&p "Dr" asked me how do I know it was service connected...I said..."besides the fact that I was there when it happened?"

Great talk guys, I have Hypertension that I just claimed from Matt Hill’s staff and I’m going for TDIU with Hill & Ponton, but It takes so long, I still in line about 45,000 in line, I think they jipted in line. I’m at 70% and it takes years to do this; the VA should move on Vets that are 75 yrs old. Carl Timmins

Such a great video. It’s so hard to find this detailed information elsewhere. I just got off the phone with the regional office in Salt Lake City and I am about as clear as mud as it relates to earnings while on TDIU.. Staying below the poverty threshold is pretty straightforward. My employer is well aware of my service-connected disabilities and is more than accommodating when I need to go home when I have bad migraines for example among many other things that would normally not be available to other employees. That said, theoretically I should be able to earn more than the property threshold because I am technically in a sheltered work environment. But it seems like a long drawn out legal battle with the VA is inevitable if I make more than the poverty threshold despite a sheltered work environment.

The term sheltered workshop refers to an organization or environment that employs people with disabilities separately from others, usually with exemptions from labor standards, including but not limited to the absence of minimum wage requirements.

Thank you for this. I'm in that 70% category and I'm not working because of my mental health conditions. I'm in Chicago, I watched Jay Cutler (Bears) throw interceptions in the red zone, only to be ran back for touchdowns by the opposing teams. 😐 If you are 100% service connected, you can get your student loans wiped out.

Yes anytime you file a claim you can end up with a decrease just as easily as you can with an increase☝️

Oh my hope you aren't reduced. I filed two claims for increases in July and last week received my decision letter. Thankful to God for the increases as I prayed I wasn't going to be decreased. I am being hesitant if I should file for tdiu as I am now 90%.

“Hedge” all your your service connected disabilities with a good private dr who can help you. Have the medical reports that support your disability are getting worse from that dr. So when you file a new claim.. and the VA try’s to reduce you for what ever reason they pull out of thin air. You’re private doctors evidence should cancel out the VAs evidence to reduce you. Therefore keeping your disability exactly where it stands. (From what i understand on CCs video about hedging)

I filed for TDIU and then started working as a CWT at the hospital so I withdrew my claim for IU. I also would not file for it if you have had your ratings for less than 5 years because they can bust you back down % wise.

I just sent in a claim for TDIU. I used to work at a VA hospital was let go because of my condition and thet could not accomodate me, OPM gave me a retirement due to disability for the condition that had brought me to a VA 60%. In the process I applied to SSA for disability and was approved by them because of the same condition because the condition precluded me finding employment. I don't know if the VA will approve it, but they have already ler me know that a C&P is coming soon.

Pray it works out for you , I like H&P I haven't filed for tdiu yet but did reach out to them. They (the disability coordinator) called me on yesterday that Atty Matthew Hill advised they wouldn't be able to take my case but will forward my info to an alternate firm for assistance and to allow 2 weeks for them to reach out. I wasn't disappointed as this is what I expected because its not a appeal claim.

Craig, is it possible for you to cover Restless Leg Syndrome? I got service connected at 0%. At that time, I couldn't take meds because it would've made me drowsy; a no-no in my active duty assignment. Now as a retiree, I'm poppin' meds. Seems the VA isn't clear on the diagnosis and rating. There are blogs from lawyers, but no videos. Thanks, brutha.

I just had this on in the background and when he mentioned that the "VA could be considered protected" I instantly thought of all my appointments ive gone to while employed there. I have never thought of it that way and appreciate the perspective. Where can I find more info on this?

Thank you Combat Craig and Matt. I filed TDIU paperwork Dec 16, 2020 with a "veteran law group" in the Evidence lane at the BVA and still waiting!! I am 70% Anxiety, 20% lumbar spine, with 20% right lower sciatic and 20% left lower sciatic, 10% Morton's neuroma. Getting paid 90% and still nothing! My lawyer says wait but I want to call the VA and find out more. Who do I call?

The sheltered workshop here is a shop similar to a goodwill and they hire mentally handicapped people to work in the shop, and i think they even had a yardwork crew

There are ~ 20 million veterans, of which 6.9 million are collecting VA compensation. My question is how many out of the 6.9 million are rated at 100% P&T and how many are rated at 100% TDIU? I think that once this is answered, we can get a better understanding on how rare and how difficult it is to achieve the goal of getting a 100% rating. I received a 100% P&T rating a few years ago and at the time my VSO said it is very difficult to get this rating and very few receive either 100% P&T or TDIU. He said that he believed that the low ratings contribute to the high rate of veterans committing suicide During their service they did not go on sick call when injured, because it was frowned upon. So when they filed claims after service, they had no Nexus; thus having to fight an up hill battle. As you have said in your videos, without the Nexus (proof of in service injury), there is little chance of success in the VA granting the veteran’s desired ratings goal. Once the Nexus is established, only then can secondary claims be filed and rated. I live in NYC and go to the three VA hospitals for treatment of my injuries and speak to many fellow veterans and they regret that they didn’t report their injuries while in service and they are paying the “price” now.

100% correct!!! Everyone who was in the military knows going on sick call /reporting injuries was frowned upon and even threatened not to to!!! I hope anyone currently in the service will report everything/get it in your med. records because if you don't, you will be denied any help in the future.

Im currently at 80% with 70% for ptsd. I filed my TDIU claim last month with a Vocational Expert letter. Did my c & p exam 2 weeks later and now I'm just waiting. My claim status was updated yesterday.

I have a question. Does anyone know whether or not my spouse’s income counts towards the income limit? I don’t know the current income limit for 2023. I understand we can’t make substantially gainful employment but we can still work as long as it’s not above the 2023 poverty level.

If I understand correctly, a veteran on TDIU can attempt to go back to work full-time and still receive TDIU for one year. So it’s kind of like a trial period to see if the veteran can gainfully work? But if say eight months into the job the service connected disability‘s disallowed the veterans to work, they will remain on TDIU? Just want to make sure I’m understanding correctly. I've Got 90% but they gave me P&T TDIU. SSD Says that i'm too young to be on it so i can't go that route. But every day i wake up and i fear that the VA will just rip the benefits away from me. Am i fearing over nothing? (November 2019 is when they have established this rating). How could i go about getting SSD? Love your videos, glad someone out there is helping the veterans.

Take each payment as a gift m8. If it ends the gifts stop you should have prepared when you had the income. I try and put away half mine each month so just incase they pull it I can have half stashed away for the 2 -4 year battle. I also try and get jobs , make some money and I always get fired for some reason, I add every firing and denial for a job to my case. Good luck tho, your at 90 already so I think your doing better than me.

I like how they give out money to "oppressed" people like its candy. I know 20 year olds rolling around in brand new Cadillacs on welfare, yet disabled combat veterans have to jump through hoops just to get a living wage.

Combat Craig: Would doing a outside job like a security guard or something like this type of employment to supplement the income needed to take care of expenses qualify as a protected employment status when trying to get 100 percent??

I would say by definition that if you have to go to work carrying a weapon and stopping idiots from doing stupid things by force that would probably not qualify as protected or sheltered but that's a generalized statement. Dig in and see if your particular scenario fits in with TDIU.

Yes, however, you need to call the VA to get the contact number/location they use and set up an appt yourself. From then on, you’re scheduled every 6mons for dental care

You’re gonna have to learn about the combine ratings table man it’s hard to get your head around but you’re gonna be dealing with it for the rest of your life so start googling around and use online VA disability calculators. You can go tried to figure it out the VA website there’s resources out there.

Could someone please explain the VA math to me? I thought I had it figured out. How did he come up with 94%? I understand that 90+40 isn't 130% Thank you in advance

If you are 90 percent every 10 percent equals 1 percent so you would need another 50 percent in ratings to Get you to 95 percent that will round off to 💯

90% means 10% of you is still "healthy". So a 40% additional rating applies to that 10%. 40% of 10% is 4%. 94%

Yes, I don’t know exactly how old, but you can find it somewhere on the page that shows the status of your claim. However, I think it’s over 65+

Yes, A State Retirement is passive income and does not count. As long as you are currently not working and unable to.

And have been total disable since was administration separate with 2 more years on contract , what is protocol of discharge isn't there a medical exam before discharge? Or they just fire me administration separate me ..? ...because I broke my neck and more ...

And if you don't know ow can you direct me to some can help with administrative discharge for some reason I feel there is something wrong ...I need a professional because I served 6 yrs ...reservist and have no discharge papers ...no va , have issues kneess and feet ...I feel Miltary related but I need to get back to be administrative separation for discharge paper work that is real with a number on it

There is no timeframe that I am aware of. I’ve decisions anywhere from 24 hours to 10 years. It’s literally all over the board🤠

If you have a service connected disability/disabilities that prevent you from working and you can prove it then not only will you qualify, you will win! Make sure you get a vocational expert involved.

I would be very careful with that. If your a high earner and you pull down 3 or 4 grand a week for those 20 hours they will yank it from you man🤠
