In observation of Hill & Ponton, they responded quickly to my inquiry and once you conduct an initial intake, you get an attorney and team members who consult with and primarily they can truly and successfully represent you for any Appeals whether it's VA (Veterans Affairs) or SSA (Social Security Administration) for your disability(ies). Check 'em out, consult with them, I have to say never a question with education swept under the rug with, so try it!

I absolutely love this video… you’ve answered a lot of questions that I’ve had. If you get granted 100% for TDIU, do you know if you get the same benefits as the other 100% rating? In California, a Veteran rated at 100% doesn’t have to pay fees for vehicle registration or freeway tolls… is it the same or no?

I have 50 percent for Sleep Apnea, 10 percent for both left and right foot for degenerative arthritis, 10 percent for both right and left knee for degenerative arthritis, and 10 percent right elbow with degenerative arthritis. I have a left toe that was 10 percent but reduced to 0 that is under appeal for increase. Also applied for left ankle tendon issues and hip issues. I expect overall 80 percent rating when all the dust settles on this round. I also have TMJ but probably will only get connected at 0 percent. I will retire in 2023 and may apply for TDIU then. I will have annuities from the FED and MIL side and TSP from both so money is not an issue. I have served for 35 years as of next week. Also 24 years FED service in June.

Im at 50% disabilty from service related lower back injury (damage to lumbar spine with arthritis.) I tried for more compensation in 2016 but was refused. I have in my medical records that my hearing was affected by my service also but that was refused also. I have not worked since 2009. I applied for ssd and was rejected in 2011. I am now not eligible for SS.

I have a 70% with PTSD for 7 years now....( Nov. 2015). I'm 73 years old. If i put in for TDIU, could they reduce my compensation....since they are opening up my files again? I don't want to risk them reducing my compensation to 50% or 30%. Would it be helpful to get an occupational expert before attempting a TDIU ?

I have an 80% disability. (The provider who helped me file didn’t put everything i had) I haven’t worked in over a year because of my disabilities they just keep getting worse and worse. I’m single and no kids. I started going to school so I don’t waste my GI Bill benefits and make a little bit extra money to pay my bills. Will going to school effect in any way TDIU? Also, I know you get the pension as a 100% disability but what about the benefits like free dental?

I am a homeless 70% Unemployable (TDIU) veteran who couldn't find a place to buy or rent in the insane housing market. I found an apartment/office for rent. To rent and keep the space I must form an LLC, acquire a FEIN number, department of revenue Tax ID, permit, etc. Won't make a dime, pretend like I am doing business. Some say if I acquire a FEIN number I will automatically lose my TDIU because the VA will deem me gainfully employed. Some say I can acquire my FEIN I will not lose my TDIU if I make less than the poverty threshold. I am confused.....

I’m 80% totally and permanently disabled I believe tdiu I’m unemployable so I’m being paid at the 100% rate I didn’t have to put in for unemployability they automatically gave it to me. My question is I don’t have to go back and get reevaluated unless I open up a new claim right I’m just trying to make sure thanks

What if you are in process to medically retire and just waiting it to be finalized. Can you still file. Especially if it is that disability is the reason you are having to medically retire. Just throwing that out there.

You may be able to get those additional benefits. You'll want to talk to someone at the VA regional office and inquire further.

What’s the difference between TDIU and P&T? Can you work with P&T?

TDIU is paid at the 100 % rate but you can’t work. P&T means total and permanent. If you get the designation of P&T then that means that the VA will not reduce your rating and you won’t be scheduled for any future C&P exams.

Sir I was totalling 70% combined rating with 30% flat feet, 30% depression, 10% lumbar spine, 10% left knee and 10% right knee when I filed for tdiu in January..today I checked my ebenefits online and saw that my combined rating is increased to 80%...70% for depression, 10% flat feet, 10% left knee, 10% right knee, 20% lumber spine, the decision letter is in the mail tho..so my question is do you think my tdiu is granted and is it possible to verify that without getting the decision letter in the mail.

@@cayondaspires2593 you are entitled for TDIU without a dought..I finally got tdiu few months ago .. you get 3000 and it goes up based on how many dependent you have..you cannot work if you getting tdiu tho.

I am a 30yr retired Air Force (10 active, 20yr reserves) vet. What if I made a decision to do an early (62) S.S. retirement (civilian), because of me not able to do the work (Information Technology) anymore, due to lack of concentration, lower back pain, etc. I have a 40% rating at the moment. 30% is a combined of PTSD, Sleep Apnea, & others, 10% for Tinnitus, & 10% right angle. Am I possibly, maybe, eligible for TDIU?

I believe the minimum combined VA rating must be 70% to qualify for TDIU.

All of the videos are quite informative and I have been trying to implement as much as I can. For some reason I have not been able to get any attorney to take my case. I have bilateral knee conditions that I have been denied service connection for that I am with the help of a VSO filing for a Higher Level Review and awaiting their decision. We summitted Buddy Letters along with a NEXUS and medical record to show my injury while in service so I was anticipating that everything was in order. Hill & Ponton referred me to another attorney and they couldn't help me either. I suffer from anxiety and depression, mood swings and irritability. I have severe lower back and hip pain from this sciatic nerve traveling down my leg through my ankle to my foot. My lower legs numbness from the radiculopathy in both of them. I only rated 10% disability for Tinnitus at this present moment. These multiple symptoms makes my life miserable and not being able to get professional legal representation is so frustrating. I will not stop until I get my 100% P&T that I deserve.

Hello I was at 30% service connected and went to see my DAV officer. While there he ask me why I haven't applied for major depression disorder and a couple other things I was taking medication for. I said I was unaware that I could file for those things. Long story short he says I'm going to submit your claim just get me your medical info. Well, in 2 month I got a rating decision for TDIU with no more exams and SMC- K for being housebound. My question is I had a TBI while on ship and was sent to the main VA hospital in Durham NC for a 3 day TBI workup well afterwards the doctor called and said It was positive and i immediately needed to be put on Social Security. Since then I've been diagnosed with PTSD SLEEP APNEA and TBI my question is I'm drawing max so should i open up a claim for these problems or just leave it alone?????

You may qualify for the other SMC because of the TBI, such as aid and attendance. Look into that. Also ask the VA Regional Office to make your condition Permanent and Total since you suffer from major service connection issues. Once P&T you can’t have your rating reduced.

I am permanent and total they paid for my children's college and it says P and T on my disability papers and also says no more exams in the future. 3 and a half more years and I will be on the 20 year mark as far as drawing 100%

Will it say TDIU on your benefits page? I applied for TDIU but I ended up getting 100% for TBI and it says (You are considered to be totally and permanently disabled due solely to your service-connected disabilities). I'm not sure if they gave me just the straight up 100 without the TDIU or not, any information would be greatly appreciated!!

It looks like you just got the straight 100%. TDIU pays the same. You can get one or the other but not both. With the straight 100% there are no work restrictions. With TDIU you can’t work. Since you got TBI you should look into SMC, Special Monthly Compensation. You can get extra money.

​@@juan3-3 Understandable. A lot of the veterans we speak to are in very similar situations. One thing many veterans with service-connected back problems don't realize is being affected, and that the VA should be more diligent on, is a veteran's mental health. Most of the veterans we speak to who have a back condition also have Major Depression and/or Anxiety because they can no longer do the things they used to and now experience chronic pain due to service. Mental health conditions that stem from service can be awarded service connection with their own ratings. Also, when your back is compromised, the rest of your body has to overcompensate which can typically lead to even more pain and potential issues with knees, shoulders, hips, etc. If present and with proper evidence, many conditions can be awarded Secondary Service Connection. If you need help getting started, you may want to consider speaking to a VSO or local advocacy group near you.

They both pay the same. It wouldn’t make any sense to try to get the TDIU if you are already receiving the same amount. You can only get one, not both.

If you're not at 100% then yes, we think you should be appealing and making sure you are given a fair rating. If you cannot work due to your PTSD, then the answer should be clear.

Great video/topic. I would like to ask a question and I hope you can answer it for me. I would like to start a website where people get together once a month and join their lottery tickets together. If we win we divide the prize equally. If we don't we don't care. Currently, I'm rated at 70% P&D but with IU = 100%, would I lose my IU then?

I have a question. I was just awarded 70% PTSD and I DID NOT apply for TDIU, however in my decision letter it states "The issue of whether or not you are entitled to Individual Unemployment is deferred for the following: development".. Again I personally did NOT apply for TDIU, what does this mean??

Hi there, so the short answer is no. TDIU, also known as Individual Unemployability, when awarded to a veteran means they get disability compensation at the same level as a veteran who has a 100% disability rating. The difference being that is that your conditions aren't quite rated at 100% but are severe enough to keep you from working and impact your income. no you wont be approved for voc rehab because like third or forth question on form asks have you applied for or are receiving tdiu

I’m TDIU since 2015. VA said TDIU is not a qualifier in the Philippines.for dental care. Unless you have dental disability, you’re not eligible for dental care. Extra schedular disability have no bearing on when it comes to dental care. They don’t tell veterans until you file for reimbursement to the cost you initially paid . Where is the duty to assist veterans ?.

I no you get the same paid as A 100% rating but do you get the same benefits Like health Care, Base Assess to the commissary, ect,ect

@Jim Burnett but there is a significant distinction between 100% rating and all lower ratings as a relates to the perks, ID card, etc.. that he’s referring to.. and if I’m not mistaken, TDIU Encompasses all of the same “perks” as 100% scheduler rating..

Can someone help me with these two statements I received. - I receive Total and Permanent Disability due to service connected disabilities. - you are being paid 100% bc you are unemployable due to service connected disability’s.

Hill & Ponton sorry, am I TDIU or Total & Permanent? I am asking bc I was awarded this in 2011 w/ ChampVA and was told I couldn’t draw SSD. I hadn’t planned on keeping it anyway after surgery so never attempted but surgeries haven’t stopped. I have 6 spinal fusions and beings the time expired to draw my SSD I cant draw bc none has been paid in lately. I would like to open a Contracting Company to subcontract work to pay some SSD in for a couple years so I can draw. My body is too broke to do anything otherwise and family is in this line of work and its all setup. Don’t want to get in trouble but being led down the wrong path in beginning cause me to miss out on SSD I paid in. Thanks

@@ddtrahan I’m sure by now you’ve already had your question answered but if not I wanted to let you know you’re probably (like me) both, meaning you’re being paid at the 100% level even though you’re actual VA ratings don’t equal 100%, but because you’re unable to maintain “gainful employment” you’re receiving the same pay as a 100% ratings veteran somewhere around $3,146.....you’re also considered “permanent and total” which is basically the VA‘s way of saying you’re not at risk for a ratings reduction unless they discover some fraud and you will not be required to attend any further C&P exams unless you decided to file another claim. In terms of doing anything with regards to working I would not recommend it as you run the risk of no longer being given 100% TDIU because the whole point of getting it is that you’re supposed to be UNABLE to work, it is supposed to be filed for you automatically by your VSO but many of them don’t do it. I filed for an increase in my 70% rating that I’ve had to years now and they filed for it because I had been unemployed for over year. Thankfully I got it and I was deemed permanent and total even at 35 years old.

@@ProudBostonian most say I shouldn’t file for an increase but I fall in a unusual situation. I was told by VA I couldn’t draw SSI and I truly unlike some, had plans on working. As a matter of fact I just recently told my wife to fill out the ChampVA stuff after 8.5 years. I paid for private insurance for me and kids. I still pay for my private insurance bc I refuse to let VA cut on my spine. After 8 years and four surgeries from disc after disc going out due to adjacent levels being fused I decided I am fcked bc I hurt so much. I have C3-C4-C5-C6-C7 fused along w/ L4-L5-S1 fused also and knee repaired again w/ private insurance & left shoulder rebuilt. I hear you can draw SSD 2-3 years ago. I go to SSD office in 2020 and they tell me your date expired 2012. I asked to explain and she said you paid in this amount and none since 2010 so your ineligible. She said I need to pay some in a few years. I get letter in mail last year saying if my taxes ever show earned income I am done. Hmm unsure who to call to ask if I can just pay a little SSD in and not work. Meanwhile I had the DBQ’s filled out almost a decade ago and never submitted bc of the TDIU. What I have filled out most likely gets me to 90 or the 100. I have never filled out any secondary things. After reviewing the rules and calling my surgeons, getting to 100% shouldn’t be a problem. People tell me not to submit but I need to pay some SSD to be able to draw in future. What’s your thoughts? Thanks for comment!

@@ddtrahan here’s the issue you’re going to run into, At least based on my understanding of how SSD works. In order for you collect an SSD amount that would help you, you’d have to pay in an ASTRONOMICAL and you’d have to do it for SEVERAL YEARS, the reason being all of social security is based on what you’ve paid in to it, which is part of why I cannot collect it, because I do not posses enough “work credits” or whatever they call it because I never made a lot of money. Unless you’re going to be making a few hundred thousand dollars a year it would NOT make sense for you do that. The fact you have 8 kids I’m sure makes it impossible to survive on just your disability which is around $5,400 if I am getting all your information correctly. I am considered a “single” veteran even though my fiancé and me have been together for almost a decade, and we have no kids (I don’t want any) and we have 2 dogs (those are our kids) and even with her working full time for the county and bringing home $2,000 a month and me getting 100% disability from the VA at $3,146/month we still just get by....I would call your local Social Security office and see what they tell you is your best option, are you eligible for any kind of housing grant? How old is your oldest kid? Do they all live at home? I moved out as soon as I graduated from high school, left for the service and never moved back to Boston again! Now I’m here in NC and I can’t wait to move somewhere else....preferably somewhere with FAR LESS PEOPLE! Just me, my fiancé and our dogs near a mountain in a log cabin (with internet hahaha)

I want to ask about increasing your base disability rating. I'm on TDIU and my rating is 90% I want to increase because you know the moment I get a job, they'll cut TDIU. I know it's not immediate but it's scary for a veteran who's used to a certain income like TDIU. It would be peace of mind to have 100% and still be able to work outside TDIU. Filing to increase to a 100% is something a lot of Veterans do continue to do after receiving TDIU to prepare for a day where it might be taken away. If you do file a claim for service connection or an increase, and get denied, please feel free to reach out to us at 386-257-2100.

You have IU but now want to work. You are rated that because you told the VA you CAN'T work. WTH...We have all the veterans that try this to sign saying they know they can be reduced and, by the way, this happens all the time.
