PACT Act: www.va.gov/resources/the-pact...
In this video, we delve into how you can achieve a VA rating even if you didn't have any doctor visits during your military service. Discover how veterans can still secure their benefits with minimal evidence by understanding the power of presumptive and semi-presumptive conditions.
Auto-Approved VA Claims: No Evidence Needed
Learn about the latest updates from the PACT Act, including how exposure to burn pits and other toxins can lead to presumptive conditions that are automatically approved by the VA. This means you can receive your benefits without the usual extensive medical evidence.
Introducing Semi-Presumptive Conditions
I've coined a new term, "semi-presumptive conditions," which applies to specific military roles and activities. If you were airborne and jumped out of airplanes, or if you served as a munitions specialist or mortar gunner, and now suffer from knee problems, back issues, or hearing loss, these conditions may also be considered semi-presumptive. This concept bridges the gap, making it easier for veterans to connect their service to their current health problems.
What You’ll Learn in This Video:
How presumptive conditions work and why they are automatically approved.
The concept of semi-presumptive conditions and examples of roles that fit this category.
Tips and strategies for winning your VA claim without extensive medical documentation.
Real-life examples of how veterans have successfully secured their benefits.
Don't let the lack of in-service medical records hold you back from getting the VA benefits you deserve. Watch now to empower yourself with the knowledge and tools to navigate the VA claims process effectively!

Same, starting to have hip issues. Went to the doctor to have it checked out and they did X-rays. Showing signs of degenerative hip conditions. Wondering if it’s from all the hip throws and leg sweeps from the MCMAP and shifting body weight from fireman’s carry training for the combat readiness tests. Never went to sick call from the pain and self medicated with Motrin and icyhot

I filed for my right shoulder which was documented during service and also pointed out in my exit exam, my claim was denied with the VA basically stating too much time had passed. I am at 60%. 10% tinnitus + 50% for insomnia and anxiety. I started having migraines a few years ago. Filed a claim 4 months ago connecting it to the tinnitus. I hurt my back at Ft. Banning in 1984. Fortunately the Company Commander was standing right by me when it happened. I attached his letter to my claim as I did not go to the infirmy. We shall see how these two claims play out.

Your videos are a god send. All of my service records were confiscated by a 3 letter 3rd party in 1990 while I was in desert shield. After 3 decades Biden got me into the VA system. I am lucky enough as a Marine I have good relationships with several of my brothers in green to write buddy letters. As an aside, I asked the VA how I could file the PACT since my PC doc wouldn't send me to the clinics I need and she told me if I have the symptoms to just file and the C&P would do the rest. And that is exactly how it's going. I went from nothing to 90% and working on the last 10 but it's a struggle with zero records to use. Waiting on a buddy letter now to show location.

I went in Navy at 17 and went thru depression at 18 and 1/2. I got hassled for minor infractions and Captains Mast. I got kicked out at 19 years old. I asked if there was any program I could go thru so I could complete my enlistment. At 53 years I ordered my service record and someone wrote they thought I was going thru depression. So I applied for disability and was approved at 70% for anxiety and depression. I am now 61 but I wish I would have gotten help 41 years ago.

Love the videos wanted to ask I started getting mental health help two months from discharge of the Army. A piece of an antenna element broke and impaled my right hand. Va rated me 10% but I kept going for mental health help since 1999 and still go to this day. I never new of all these service connections recently got a 70 percent mental health rating but it only went back for the standard day of filing which is two years back. Is there anyway to claim it back further? I wish I knew about these service connections sooner. I only found out because my father passed away 3 years ago and a buddy of mine told me about va claims at his funeral.

Is there a condition for just low back pain? I had an organization help me file my claim and the put down disc degenerative disease for one of my claims. I didn’t give it much thought until I got denied a third time. Then I wondered why did they identify me with this condition. I have 2 incidents on active duty hurting my back and for the life of me I can’t get service connected. I’ve also been seeing doctors and chiropractors since I left service.

Heck i found a medical document pertaining to my left eye..sharp pain.. I've been wearing a baseball cap for decades because of sensitivity to sunlight..i didn't have this before the Army...also my MOS was Petroleum Supply..even tho i never went to war, i was in the field learning how to handle those large pipes to ship fuel...so i was near chemicals at Ft Lee Va...not sure what they changed to name of Ft Lee these days...oh also i have had autoimmune issues along with migraines off and on for decades! ... Heck I've proven my right hand was injured (sprained 9 times in 2 weeks) because i was forced to mop floors while on crutches (fractured ischium)..but the VA has my rt hand at 0%...

The comments shown were exactly those just turned down by a PA that evaluated my claims. Knees replaced after years on knees under aircraft and jumping down off wings. Burn pits in Vietnam, all lower grade GI's had to burn toilets matter with "Diesel fuel. Working with PD-680 for several years in a wheel and tire shop and rubber gloves failed and we still had to put out aircraft wheels with bearings. Just a few examples that was turned down by the PA evaluator during June 2024.

That’s tough, the good thing is that with a supplemental claim, you will likely get a whole new examiner and likely a better one from the sound of it

I was a cook. Regularly exposed to fumes from the burners and the loud noises in the field kitchens and standing for 15+ hours a day regularly in those black "safty boots" all took a toll on me. Ive been dreading dealing with the VA as i only have about 6 months left.

Just got denied for back, knees, feet and ankles but yet was diagnosed for all during c&p exam…hundreds of jumps while on active duty…so I’d have to say your information is incorrect
@mrm1521

The information is accurate. Either your connection to your military service was weak, the examiner may have been given an inaccurate medical opinion request from the rater, or the rater misinterpreted the rules. Consider adding medical studies that link your specific injuries to your military service and taking another look at your personal statement. Keep winning!!!

Brother, Thank You for putting this “Vital” information out to our Veterans and still Active Duty Battle Buddies. It’s a long hard process, but getting the Benefits that are promised to you deserves to be fought for. I’m Finally 100% at Age 39, but if I knew about the VA process earlier, I would’ve been 100% about 10-15 years ago. Keep up the Great work and Vets, DON’T STOP FIGHTING!!! 💪🏾😎🙏🏾🫡

Because of your videos I went from 60% to 90. Thank you so much for helping out the Veteran community! I am forever grateful! I do feel I got low balled on my lower back rating and I wasn’t rated for my numbness and tingling in my legs even tho I made sure to disclose it during my C&P exam. What would be your advice moving forward?
@vaclaimsacademy
@vaclaimsacademy 3 күн бұрын
Great work Eddie I’m so glad to hear the videos made a real difference in your life, that’s what it’s all about. I would submit a FOIA request to pull your C&P exam DBQ to see if the examiner did not indicate the proper numbness/tingling. If the examiner made the mistake, do a supplemental claim. If the examiner was correct, that means the rater made the mistake, do an HLR.

Can bruxism be a secondary to tinnitus?
@vaclaimsacademy
@vaclaimsacademy 3 күн бұрын
Yes, if your medical specialist opines that your tinnitus has at least a 50% chance of causing your bruxism. I’d label it as a “Hail Mary” play though personally but it’s certainly winnable

It is the culture of the service, it is not only discouraged, it was detrimental to assignments, schools, details, promotions even reenlistment. People are trying to suck it up to make a career. They are YOUNG MEN and you just assume these pains will heal or not bother you down the road. Call congress ,your senators, and the White House Hotline to demand that this FACT of service is assumed to apply. Stop farting around.

One thing you have to realize is the percentage isnt adding like you would think. A 70 starting point plus a 20 plus a 10 doesnt add to 100. There is the dumbest chart they use. Get your employer or former employer to sign a document for you then fill out another form like a resume and if approved you get 100 percent pay (not rating). You can be 50 rating but be paid 100. Im waiting for the initial rating to find out where i stand.
