None of this means she will win when the judge has everything. The lawyers on the defendant side are presenting arguments of law for motions right now. They aren’t presenting evidence yet. But when they get to evidence… Blair is toast. There’s only a million videos by a million creators on this topic. I’ve not seen a single one in defense of her. The judge is only allowed to look at what is actually in front of them. They can’t go look on Twitter or KZfaq and review this stuff. So this stuff will be brought before the judge and the judge will see it for what it is. That’s all. She cannot possibly win this case. That would be ridiculous.

Madcaster points out that the judge seems to have a fundamental misunderstanding of youtube content creation, and says that people in difference niches like Click and Blaire are competitors. I have been worried about the competence of the judge since aroud the third time Blair and co still had not specified what the actual cases of defamation and slander were or cited specifics and they kept allowing the case to continue. They should've have dismissed this debacle about 10 amendments ago.

The way the US legal system works is that if there's even the remote possibility of some of the claims being true then they can't be dismissed. That doesnt mean that she'll win the case though.

Mind bending. Plaintiff is suing for relief from public comments made by defendant. Defendant says these are SLAPP suits, judge disagrees they are SLAPP because the comments defendant is making isn't in the public interest. If they aren't in the public interest, then what harm could they do to the plaintiff? WTF?

That whole paying for digging up dirt on Click thing seems so sus because there is a fine line between gathering evidence and blackmail/intent to harm. I think you really could argue that Blair literally paid a person in financial struggle to gather information on someone so she could publicly harm him and his business ventures. I think it's important to say that the judge is giving her the benefit of the doubt. He isn't saying that her evidence is plausible. He's saying it's plausible that she could possibly have a case if she has the evidence, so it's worth moving onto the stage where they present evidence. He's not checking if she's right at this point. He's just checking if the claim sounds stupid and made up or if it's something that could actually happen. Basically, this is the stage where they ask "if she was 100% telling the truth, would she have a case or not"

I was an avid watcher of Blair until she posted that illuminaughtii Exposed video. There were so many issues with that video. As a therapist I found it alarming that her therapist terminated services but continued services with Wonder. That speaks volumes considering Blair was seeing her for years first. Everything after that was just the cherry on top. I won't watch someone I believe is a hypocrite and manipulative.

The fact that she hasn't had the lawsuit dismissed doesn't mean she has any chance of winning. As madcatster said, this court jurisdiction is pretty well known for favoring plantiffs regarding early dismissal, and on top of all that the standard for allowing a suit to continue does include taking the plaintiff's allegations as true, but as soon as the trial proper starts that presumption goes away entirely.

"viewing the amended complaint in the light most favorable to the plaintiff" The judge is not on Blair's side, he is just doing his job- in my view he is making it very clear in his wording by reiterating *multiple times* that these conclusions are inherently tied to a legal bias towards Blair in this stage of the process.

If she wins, there is no hope for the legal system.

This wasnt the result that Oz or Felix wanted, but it's hardly a win for Blair. It's going to trial, which means Blair will be under oath. She's going to have to prove her lies, and she won't be able to.

The judge and the court can only rule on the evidence that has been presented to it. If Felix hasn’t shown that he was not an employee at the time of that conversation, then the judge has to take Blair at her word that he was bound by her NDA.

The fact that Blair has now actively attacked and stressed out two prego women with complications (Madison who thankfully didn't miscarry, and Oz's partner) tells me Blair must really want to torture people by unaliving their babies. So sick.

A little insight to the local legal system, as with damn near everything in Colorado Springs currently, we simply don’t have enough infrastructure. The towns population has quickly grown beyond the infrastructure we have to support it. That accounts for the CSPD, EMS, the court systems and even healthcare beyond the already sorry state it was in. It’s especially interesting in the context of her supposedly removing the whole swatting protections on Oz’s home, as I’ve actually essentially been swatted by someone claiming my gardener was a large black man with a gun. Which was so racist and fucked on so many levels, but CSPD is so behind, that they came out with the riot gear the next day. Which at that point I don’t know what they thought would happen, but if there actually was a threat, it’s too late. Just the other night someone found a wandering toddler in the road and the police took 18 hours to get involved. So I’m not surprised she’s been so easily able to skirt the court systems, as they’re so overworked and the city so underserved. That until this progresses further it’s likely not getting anywhere near the attention it deserves to realize how clear of a SLAPP suit this is and should have already been seen to be. I can guarantee they have not had the time to view any of these videos in full, if hardly at all. Which is why the judge continues to want cited sources, while her amendments never do so. Which seems pretty amateurish on her attorneys side, but the facts also don’t line up with her legal narrative. Not to mention I’m sure her plan is to gas them all out financially as a war of attrition. Tho her financials are also confusing, she must have a bunch of not properly reported assets or she’d be in a better state, maybe borrowing against her net worth without anything liquid, as it’s doesn’t make sense she would be having all these random debts. Like the not paying her property taxes for years, I had actually hypothesized she was planning on letting it go to auction and have someone else pay the property tax and assume ownership at far less than it’s worth. As property values are insane here currently, I’m getting offers around 360k over what my property is realistically worth. But I know people salivate at snatching up properties with unpaid property taxes. She didn’t even owe much originally, just a couple thousand and that’s not bad over two years for Colorado spring’s, but it’s majorly ballooned as a result of them not being paid. I know mine is $1200 and it’s a far smaller property. Anyways just figured I’d add a couple of details from the local perspective. Which having lived here my whole life and graduating the same year she did from another local school, it’s kind of weird, as she was kind of ghost to everyone she went to school with from what I can tell. People knew who she was, but she seemed to be pretty conniving back then too and people just steered clear. Think I might have seen her at a football game once, when my cousins played against her school team, but that’s about it.

It applies to information obtained before signing as well. What is important is if you are under NDA when you disclose the information to a third party. That said, Blair should just withdraw at this point. It's just painful to see her drag herself through the mud like this. Nobody wins, she is just inflicting suffering on others, while subjecting herself to that same pain.

Blair has narcissistic tendencies -- the win is the only thing she really cares about, at least in the short term. Personally I think she'll either settle or she'll lose. This is just the pre-phase -- the trio have more than enough to bury her in actual court. I would hope her lawyers know this, but from what we've seen... I may be alone in being certain she's going to lose if it actually goes into a courtroom, but I don't see how she wins when actual documents and evidence get put on the table, tbh. I highly doubt she'll settle, though.

18:45 - I am not defending Blair but, the explanation of the ruling is a little funky and I wanted to help clarify. In a motion like this, the judge has to assume that all the facts alleged so far by the plaintiff (Blair) are true because the defense brought the motion to dismiss. If she brought a motion for summary judgement (to win without going to trial), the judge would assume all the defendants facts were true when making the consideration. Part of the judges job is to settle disputes of facts and, without a trial, the dispute can’t happen so, they can’t be thrown out. Next, one of the facts that Blair alleges is an employer/ employee relationship with Felix. Oz’s information about how Felix was paid, and when he signed an NDA are relevant to the trial (because they will help determine the nature of one of the disputed facts) but not to the motion (because we’re not disputing facts right now). Because there is a possibility that a jury could find it more likely than not that Felix and Blair had an employee / employer relationship, the suit must go forward.

I'm really glad they all have documentation and hopefully will be able to call witnesses including the others she stole content from and made other false accusations towards. This whole situation is doing nothing but paying legal fees.

I’m not sure you can say Blair ‘allegedly’ sent those messages to Felix considering that their argument is that he was breaking an NDA to send those to a third party. Her not arguing that the messages were made up means she’s basically admitted that the messages exist and are truthful. She’s gonna sink hard if this goes to trial and hopefully they will either countersue for legal fees or the judge awards them to defendants because her every argument has been misleading at best. Love how she never served Wonder, at this point it hopefully looks like he won’t be sued by her hinky crap.

It sounds like she lied under oath for this case. If she did the video will prove that she lied under oath, which will not only ruin her standing in court, but also would raise issues for breaking the oath. I am not familiar with breaking the oath, but I could have sworn it was a big deal if it is found that you did.

Motions to dismiss almost NEVER succeed. This isn't really an Illuminaughty win. Heck, Oz should consider it a major win that half the claims against him DID get dismissed.

Blair hasn't included the specifics of Oz's claim that she was an embezzler because she can't. Oz never said that. If they hadn't brought it on themselves by accepting a client who wanted to file a frivolous lawsuit I'd feel sorry for her lawyers; it can't be easy to represent a client who has no facts on her side.

the third party would be a mediator, there are lawyers and social service workers who mediate conversations between parties. courts appreciate it too because having court proceedings and trials are lengthy and expensive. mediation is cheaper and quicker (sometimes mediating doesnt work and the parties end up in court afterwards).
