Brazil has a mugshot problem. Innocent people can be charged with crimes when the only evidence is a blurry photo and an unconfident witness. A study shows that 83 percent of suspects who were wrongly arrested based entirely on photo recognition were Black.

@@RolandoGarza so sad 😞 I feel so horrible for this man and his family. The justice system in the US claims to “rehabilitate” but it’s just a revolving door trapping our young black men. Sounds even worse in Brazil. Ironically, both US and Brazil have horrifying past with slavery. Makes you think these systems have racial bias stemming from our past with slavery.

study after study has shown, eye witness accounts are the LEAST reliable form of evidence, but unfortunately, also the most relied upon form in our court system today. People see what they want to see.

Eye witness accounts vary greatly. There's a reason so many major events with many witnesses result in large conspiracies. You're not expecting something crazy to happen, then when it does, thousands of people positioned all around see/hear events unfold in fractioned pieces throughout the ensuing panic. Some of the information gained is valuable, but it's really best when being the supplement to additional evidence.

I remember when I was in Rio in 2019 and had to go to the police station for a police report on a skimmed ATM card. People were flipping through binders of mug shots all over the place to try and identify muggers.

If they skimmed your atm card, chances are it's done remotely, or they remove the skimmer at night making it almost impossible to identify them, sorry for your financial loss

31 months in pre-trial detention isn’t just a police problem, that’s also a Justice system problem. Accused should be released at the nearest convenience of the court unless the prosecution provides a reasonable cause (balanced based on probability)

To be fair he was accused of murder, it' s pretty normal anywhere not to release a suspected murderer awaiting trial. But that should be all the more reason not to half-ass your investigation and make sure you're not putting someone behind bars with super dubious evidence.

Rio's Police need to pay a penalty for their carelessness to know that choosing an innocent person of a crime they didn't commit is wrong. They should be sued.

@@MIAMI113 both countries have a fairly recent past enslaving people from Africa. So yes it can be compared. Racial bias is systemic. You absolutely can compare in terms of the justice system being racially biased. My father works in the justice department for the state of NJ and all employees have to undergo racial bias training frequently because the implicit bias is so bad. White people are known to get lesser sentences than black people for the same exact crime. This is a well documented thing…

I’m Brazilian but everytime I see all these news about corruption and crime it all sounds so distance and extreme to me. I grew up in a rather rural setting. Our close neighbors was a farm house like 20 miles away and I also remember when I left to the US the car ride to the airport took like 14 hours just for the nearest internacional airport.

People are constantly being mis identified through pictures, especially considering during the crime the person may not be looking at certain unique features, like scars, tattoos and whatnot. Not to mention there are people who, like in the 80% said in this instance, think identification is race driven...not saying all of them but it's definitely not so reliable that you should stop all investigation and make an arrest. I really hope this gets fixed or something, that's horrible. I couldn't imagine...

Most definitely. The Innocence Project reports that mistaken eyewitness identifications contributed to 71% of the more than 360 cases overturned by post-conviction DNA evidence.

what happens in these cases is that there's a legal mechanism that allows for people to get arrested before they get tried, which is commonly abused, and the trial might take years to happen

This is why I am so glad in the UK police legally must delete any data be it fingerprints or mug shots if they don't prosecute you. Obviously they never actually do and instead put you on watch lists but legally they are supposed to.

Btw VICE News those aerial footage are not from Rio, but from Nova Iguaçu. Which is a different municipality on the North end of the city. It's in the outskirts of Rio. So be a bit more professional with your information.

The state must be required to compensate these people, but a lawyer is needed, and it is not accessible to the poor . . . coupled with impunity for the corrupt public servant.

@@ergoncardia I'm sure that's how it works somewhere, but not Brazil. The key factor is there's simply so much junk going on that any half decent measure to destroy evidence will likely get the authorities off you. But you still have to worry about the victim taking revenge. Also rich people do go to prison or get revenge murdered, often when their crimes are impossible to hide or when they get in a feud with other oligarchs (a problem you can't bribe your way out of). One key statistic is most known murders involve cops. Not because cops are more violent than anyone else, but because mostly cops are reporting crimes. So it really is no surprise that a combination of cheap equipment, cheap cops, and a cheap judge will do this. Also, the suspect interviewed prolly did steal a car and get away with it. And that public defender isn't any different, as you see she's a young lawyer with a huge caseload and a political agenda. She's as much garbage as the rest of them.
