In the early hours of Feb. 22, 2023, a Troy, NY police officer responding to an emergency call broadsided a Honda sedan in an intersection, killing its driver. City leaders have declined to answer questions about their police emergency response policies, including whether officers don't use sirens.

I was a police officer for 33 years. Let's call it like it is. Red lights and sirens aren't right of way in a controlled intersection particularly when you consider the side street traffic is obstructed by buildings. The requirement in most states is to stop and proceed when safe to do so. My training officer told me to remember you can't help anyone if you don't get to the call safely. This is an utter disregard for public safety.

Thank you! I remember when they used to slow down at lights and intersections with lights and sirens. Nowadays it seems like " I have on my lights and sirens and coming in hot now get out of my way!" with NO regard to public safety. Maybe you being the officer you are should teach other officers what to do when in a call. I understand there is a FIGHT IN PROGRESS" but that is no reason to put the rest of the public at risk! All emergency vehicles have to follow these rules of the road when under an emergency, yet police officers seem to think they are above that.

I clicked the link and read the article a lot of shady shit man. No body cam footage, no dash cam footage (the dash cam comes on when they turn on the sirens and a lot of cops in that area don’t turn on the sirens because of that), the police took the camera footage from the gas station across from the McDonald’s which would have shown everything clearly. This is just sad my condolences to the family and I hope justice is served.

If you lived in Troy or the Albany area. This would not surprise you. That city and police Department has been the "pits' for about 2 decades. Just write the check to the widow and move on. This will come out far worse as far as the amount goes if they don't settle. All those people and they only interviewed 1 person? What does that tell you?

​@@jasonxii3141 Yes, she did. Her car never fully stopped, it was always rolling at a slow pace. If she kept it rolling at that slow pace, the police car would have hit her car. If she suddenly came to a complete stop, the police car still would have hit her vehicle, because she was slowly rolling into his path. Her only option was to speed up out of the way, if she didnt want her vehicle struck.

80 in a 30 mph zone is unacceptable especially sense two other police cars were already there. The police also need to be held accountable for their actions. This cop really had no need to be going that fast.

I read a report that the deceased had been checked for drugs and alcohol during the autopsy but I wonder if the officer who clearly caused this accident was checked for the same? I doubt it!

Na when you have a badge you're above the law, hence why he was going 78 miles per hour in a 30 zone and ran multiple red lights, even after there was already 2 other officers. All for a "domestic disturbance"

Yeah, I've seen on dash cam and even police dash cam where you can hear law enforcement actively searching for something and working to change the focus and blame the person that they hit or killed. And they wonder why the public has lost faith in their ability to police? There needs to be accountability, that means no one is above the law. Anyone that you can hear at any point in time trying to figure out a way to rewrite the truth or omit parts of truth is obviously not someone who should be trusted with a gun

I lost my 2 bf's almost 10years here in Vancouver when a cop went thru a red light at over 100km/hr striking them on the drivers side. They had just left my house 4 blocks away. No sirens, just lights at an intersection that was obscured by trees. The cop had no injuries and received a $200 fine. We were friends since kindergarten. Not a day goes by that I don't think about them.

Regardless of what the DA decides to do, this was a criminal act. Going to a call or not, 78 in a 30 through red lights is inexcusable, badge or no badge. He was way behind his buddies and wanted to catch up.

I lived around Troy my entire life. If you did too, then you know Hoosick Street is a deadly place to be. My mom only takes that route in the day, including driving by RPI, cutting through the park off of Oakwood. I have no idea why she takes that route. I prefer sticking straight along on Oakwood where we pass our deceased relatives. You should take Oakwood too. Some places are dangerous no matter what time of day. I have been on Oakwood at all hours and it is nice. I treat siren lights like deer. You see one run in front of you, you watch out for others because that first one ran by and then boom, the second one jumped in front of you. Deer and emergency vehicles are rarely alone. Though seriously I am cautious because if you are speeding when they have their lights on rushing someplace, the first few cars don't care but that 3rd car trailing late often knows that they are extra and can veer off and change course to go after you. I've seen that as a passenger. No Troy cop ever gave me a ticket...yet. I don't think one of them ever pulled me over either. There was an angry red faced bald one that used to walk into the gas station when I was buying candy and tell me to get out though. Happened a few times. He was just jealous I have a full head of hair. I eat a lot of eggs.

Although they can run light the paramedics are one of the worst. Don't know any who are fast. Fire trucks are the best they go as fast as they can without being too timid m paramedics will sit way too long at reds and I've seen dozens of them driving at or below the speed limit. I've caught up to paramedics in an emergency multiple times just casually driving.

When I was put behind the wheel of a fire truck, my company officers gave me some really good advice. We can’t be of any help to the people who called us if we cause a crash; with radios and cellphones a quiet interiors; no one sees or hears us until we are on almost top of them so don’t get frustrated and drive accordingly; we don’t stop on a dime; your second family is riding with you and their family wants them to come home, too. Basically, he was telling me to not be selfish and to think while I am driving. Two things this officer failed to do. He only thought and how fast he could get to a call, ignored everyone else, chose not to warn anyone else, and wasn’t thinking about the possibilities of what could happen at a blind intersection. He should be charged for negligent vehicular homicide. Being negligent is not a part of an officer’s job. He also violated the clearly written state statute governing how emergency vehicles (which include police vehicles) shall be operated when being driven to an emergency scene. Just because he was on duty and had been dispatched to an emergency call does not mean he was “doing his job.” Breaking the laws and policies he agreed to abide by when he became an officer is not “doing his job.”

There has to be a separate governing body when an accident or crime involves the actions of law enforcement. The fact that the mayor, city council, and police leaders could not answer a simple question regarding current emergency response policies should be a violation of "right to know information" If the action involved 2 citizens they would have immediately recited what violations occurred.

He's simply saying as a father of young children himself he knows how important it is for the father to be there and what a monumental loss this will be for the family. Through his experience of being a father, husband (presumably), and a backbone for his family, he has a greater sense of sadness/sympathy knowing how badly this man's death will likely effect their family. It's not weird at all imo.

The Cop was 100% at fault all departments say that an officer in a pursuit or responding to an emergency will come to a complete stop or at least slow down enough when they have a red light to make sure it is safe to proceed and when in pursuit of another car regardless if the other car runs the red at full speed the cop can not public safety is the top concern.

I was at a red light on Burdett Ave further up Hoosick at this time when one of the cops barreled down Hoosick.He too went down Hoosick at an extremely high rate of speed .He did not have his siren on and he did not slow down at the light.I did not see him until he was at the light.Thank God I had the red light or I would have gone and been a victim as well.I had an angel on my shoulder that night.What happened to this young immigrant father should not have happened.Hoosick St is a dangerous road on a good day in broad daylight.

Saw a car chase with a trainee behind the wheel. Training officer coached him thru every intersection, talking him thru why they slowed here and came to a full stop there and just cruised on thru some place else. He did an excellent job. So did the rookie doing the driving. This was a failure of due caution. He wasn"t going to be the first or second officer on the scene. His rash urgency was overkill. Literally.

@@NickyD I drove a PM rescue squad and fire engine for 18 years. Our driving laws do not exempt emergency vehicles from due regard. In an intersection you must obey the basic traffic laws. You can go through a red light but you must have control of your vehicle and assume responsibility for your actions if you do go against a red light. That cop should be treated like any other person that runs a red light and kills someone.

domestic calls are the most frequent deadly encounters for police , dont judge what you dont know. I agree this was reckless driving for the conditions. we need to hear the 911 call and how it was dispatched to properly assess the type of response this officer had to drive this fast and not slow for intersection.

The same thing happened in my hometown, St. George UT. The officer was flying down the road at 80mph when 2 elderly women misjudged his speed and turned in front of him. They both died from their injuries.

The general orders of ALL police agencies clearly stipulate that even if going "hot," that is "lights and sirens," an officer must exercise due care and prudence. This means that when approaching an intersection, YOU MUST SLOW DOWN TO CHECK for traffic. Even if you have your sirens on, many will not hear you. Obstacles, structures and buildings all distort/block sound, people are on their phones, listening to music and so forth. An officer cannot just "blow" through an intersection just because they have their emergency equipment activated. These officers either lack the maturity or are just too excited that all their training goes on vacation. No police academy in the US trains officers to drive through intersections EVER just because they have their emergency equipment turned on. The officer made a fatal error of judgment. Period.

A lot of times I'll hear sirens and can't even tell from which direction they're coming. So police officers should never assume that traffic will stop in all directions.

I look both ways at green lights, even if I have the right-of-way because you never know who isn't paying attention, or if there are first responders coming. This unfortunately happens a lot.

I was taught when driving look both ways before pulling out to an intersection. Clearly shows the Honda driver was texting or on the phone. Didn't pay attention. Now if the Honda paid attention he would have saw and herd the police 🚔 vehicle. Can't fix stupidity.

Ambulances/fire tricks slow at intersections that they can’t fully see around, they do no one any good if they are dead or their patient. Police the same, they do not do anyone any good if they are delayed due to accident, killed or kill innocent people. Trying to be the hero while being incredibly reckless is no hero. It’s just a matter of time before incidents like this happen. Siren on wouldn’t matter, what if a person was dead, it’s their responsibility to drive responsibly even when in a hurry!

My Ex-father-in-law was a police officer. While in a high speed chase the suspect ran a red light at nearly 100 mph and he followed with lights and sirens approx 200 yards behind. A minivan with a mother and her 2 small children had the green light at the intersection just after the suspect drove past. She went straight across and the ex-father-in-law struck her going about 85 mph in the drivers door. It killed all 3 in the minivan. He sustained serious injuries as well and ultimately had to retire. He never got over that and I've heard him say many times he wished he had just let the suspect go, he already had his tags...

He should be in jail and that family that lost all their loved ones should've have gotten any and all of good retirement and whatever other monetary goods he had. He took the lives of 3 innocent people for what? He had the tags, there was no reason to pursue in guessing it was some misdemeanor charges to begin with. It's no different than this situation except two baby's and their mother were taken for no reason other than "contempt of cop". The car went 100 mph through the intersection and the woman with two kids still fight to go to the intersection. That was a really stupid move on her part. I’m not trying to be insensitive. I know that when I’m driving and I’m on the road that I have to watch every intersection I go through. I have to be defensively driving and we’re taught this in school. If you hear sirens and lights flashing because you’re paying attention at an intersection and you see the cops are in pursuit of a vehicle slamming through the intersection, why in the world would you continue to go. Why would anyone continue to go? Because their radios up loud, they’re not paying attention to traffic. If she would’ve been there a few minutes earlier they may all have lost their lives. There’s so many different scenarios that could’ve happened with this whole situation. She could’ve pulled out in front of a speeding car that was being chased and caused a cataclysmic series of misfortunate events. Overseas everyone is responsible when there’s an accident because people are supposed to be paying attention on the road. Period. I feel sorry for her and her two children but the kind of parent I am I would not have gone to the intersection and they were many times when my son was little in the car when things like this happen and guess what - we didn’t drive to the intersection or get in the way of emergency vehicles. I am terribly sorry for the family and yes terribly sorry for your father-in-law. Which sometimes people don’t realize what are your faults or not and you hit someone else you’re there with them when they die and that is forever life-changing.

They were focused on the the thrill of the chase and had no regard for human life and 3 died people for that. Not many countries make each party at fault because that's not how most collisions work. In Australia, the chase would have been called off long before it got to those speeds - for this reason. Its far too dangerous. How could you victim shame that poor mother? You should see some of these domestic disturbances that happen. Not just some yelling at the wife cause the foods kinda cold. He had no business running that hot thur the intersection when he had the red light. Lights and sirens means then can run red lights but they have to do it slow and in a safe manner so crap like this doesn't happen.

This has NOTHING to do with qualified immunity. Emergency vehicle operators are charged all the time for this kind of negligence. Police more than anyone due to the fact that there are more of them in individual cars.

Drivers need to be aware of they're surroundings. I see people on a daily basis pull out into a busy intersection once the light turns green without looking beforehand. The traffic signal does not guarantee you can safety proceed only common sense after looking both ways and then verifying it is safe to proceed can.

They distinctly said it was a blind intersection with a building obstructing the view, in addition to the officer NOT having the siren on and going 80mph in a 30mph zone through a red light without stopping or slowing. The driver that was killed did nothing wrong and this could of easily happened to anyone who was unlucky enough to be in the path of that reckless police officer who I'm sure violated some department policies that day.

I don’t know if the laws are the same as here in Florida but here if you’re a cop, fire rescue or ems going lights and sirens regardless of the call you treat every red light as a stop 🛑 and if you cause an accident you’re at fault . Lights and siren is basically you’re asking for permission to pass it doesn’t mean you could speed way over the limit or take red lights like if it was green or drive reckless.

When you see a car in the distance, even a police car, you don't expect it to be going 78 in a 35. That cruiser was on top of him before he knew it if he saw it at all. But you do expect high speed on the interstate. This is why crashes involving young guys and old people happen. The nurse behaved like a professional driver, rather than an Amazon driver.

As a first responder in Commonwealth of Virginia from 67-83 we were required to take and pass an emergency driver course given by the State Police. Back then an emergency vehicle, police and or fire and rescue could exceed the posted speed limit by on 12 mph when responding to a call. But did not apply in a pursuit situation. Is there still a restriction on abusing the speed?

I got pulled over for speeding a couple of years ago. I was driving UNDER the speed limit and yet I was cited. I had a dash cam at the time of the incident. Well, while driving doing my daily routine, my dash cam would catch police and highway patrol officers speeding excessively when not responding to emergency calls. Needless to say, my citation was dismissed on the spot when I took the dash cam video to the law enforcement agency's IAD. Always always have a dash cam in your vehicle. Hope one day this family finds peace...

The point I was making for your unintelligent responses was that if the victim had a dash cam, there would be indisputable evidence for the family to use in the lawsuit against the agency and the city. This way, it shows from the perspective of being inside the victims car. What was recorded such as sound, video, what was caught on the video of the victim making a lawful right turn showing the intersection with this "blind spot" and the before and after of what the victim had to go through before his untimely death. That was the purpose of mentioning what I mentioned about a dash cam. Sorry if this wasn't conveyed in a way you didn't understand...and yes, what I mentioned about being ticketed is because this agency in the video may try and pull a fast one on the victims family like they did to me citing me for speeding when in fact I wasn't. Hope that makes sense....

Cops complain about the general public speeding, but they're equally responsible for driving without regard to public safety themselves. I realize they're responding to calls, but to run through intersections, ESPECIALLY without sirens on is just asking for a situation like this. This is on them. We understand that an emergency necessitates quick response BUT you have to do so safely. They are supposed to drive with due regard. This is where you are supposed to treat every red light intersection as a stop sign they are supposed to come to a stop or atlest a slow roll to ensure the intersection is clear before speeding through. These accidents are easy to happen because sound and people react slowly. A siren means nothing if it's approaching you at nearly 100mph the Doppler affect will make sure you don't hear it until it's abit late and most modern cars are built for comfort so they are well insulated from outside noise, reducing your chances of hearing it even further.

yeah, I've watched videos of Ar. State cops do just that, slow down at an intersection, the bad guy may get away but at least the cop slowed down. Now the local cops do not slow down.

The Doppler effect does not affect the speed at which sound travels as that is fixed, it only affects the pitch of sound by compressing the frequency as the object closes. In this case it appears as if the siren was not activated!

I've never seen police stop on an emergency, but most I've seen slow down.

During non emergencies absolutely. But I dont want to wait 20 minutes if I've been stabbed for a cop to wait at every red light with his lights on. However, like most departments do now, a policy of clear, at red lights or stop signs, slowing down and checking both ways to ensure people see you, before proceeding. Often with too, passenger checks right side, driver checks left, and both outloud say "clear," hence the policy name. Would have absolutely prevented this

@@merrikkplayzgamez understandable but you also got to take in consideration the public’s safety also. Just because something happens to you doesn’t mean or make it right for emergency vehicles but most of all police to be speeding that fast through red lights. One person is not worth risking hurting or killing somebody else also like in that video.

massive negligence from all of these officers. literal complete disregard for others. so much selfishness, and utterly no realization of the fact that 1000s of other people are also driving on the roads they are. i have NEVER once seen a officer run a red light where I have, ESPECIALLY AT 78 MILES PER HOUR!!!!!!!!!!!!

What a horrible incident. I feel for his family. The officer made a mistake. Even if he had his lights and siren on, he still needs to use due caution. Since it’s a blind intersection, he would have to slow significantly to safely go through that intersection. In my years on the job I worried about things like this. I was always very careful, but not all others were. If I’m a minute later for 99.99% of the calls, it doesn’t justify the mistakes he made here. The risks to the public are simply too high.

I'll never forget, about 12 years ago, I was on my way back home after taking my kids to school a police suv just barely missed slamming into me at what had to at least 70 miles an hour. The officer had on no siren or lights but chasing someone that had just passed me in a broken down pick-up truck. Because there were no lights or siren, I had no clue they were coming behind! The officer passed my vehicle so fast my car shook so hard it almost made me run off the road. And what's worse, the right 2 lanes were completely clear, but they both traveled at a high speed behind me. I only imagine what could have happened had they crashed into me😓. Seeing this horrific video brings that all back to my mind. 💔

In our town, the police, fire and rescue have something that turns all lights red at an intersection. This town can’t afford that?

In my home country there is a statement in Drivers Manual that "drivers of emergency vehicles must slow down before intersections and proceed only after making sure other motorists give them a right of way". I didn't see it in US Driver's Manual but I guess they have some kind of orientation or training before getting in an emergency vehicle.

They should of rendered immediate assistance to the innocent driver that was struck by the Officer's 78 Mph. Crash not wait until they checked on the officer first when he's the one who caused the crash, That's ridiculous!! 😢

Yeah but in fairness they wouldn't have known who caused it, bet my bottom dollar the other officers wouldn't drive like this one did so probably thought the car caused it. I can't blame them.

this is exactly one of my biggest fears blind intersections you never know if someones either id be police or civilian vehicles driving in excess at high speeds or simply not paying attention to traffic lights.. please be safe everyone. On this planet you only get 1 life. use it wisely pls

Dont create an emergency when responding to an emergency. You can drive faster than your lights and sirens can warn drivers and their reactions will be delayed if you stsrtle them.

Ive seen lots of officers in our town when they have their lights on they still slow down at intersections to make sure it’s clear, everyone stops and allows police vehicles to proceed. That’s the way it should be done, Officers who are concerned for public safety and citizens that comply to get out of the officers way. Not driving like a bat out of hell driving in a very reckless manner with complete disregard for public safety. 😮

UPDATE 25 SEPTEMBER 2023: A New York State Police crash reconstruction report shows city of Troy officer, Justin Byrnes, was traveling at a speed of 88 miles per hour (in a 30mph zone) moments before he drove through a red light at a blind intersection on Hoosick Street. The report also states that the “primary contributing factor for this collision was (the officer’s) failure to exercise due caution, while in emergency operation, when entering an intersection against a red light.” The State Police report indicates Byrnes pressed his brake pedal about four seconds before the collision with Alalkawi’s vehicle - while traveling 88 mph. But two seconds before the crash, he began to accelerate and then suddenly pressed his brake pedal, “approximately at the time of the collision,” reducing his SUV’s speed to 65 mph as he broadsided the Honda sedan. The airbags in Alalkawi’s vehicle deployed but did not save his life. He suffered an internal decapitation from the force of the impact. Officer Byrnes was not wearing a seatbelt but suffered only minor injuries. The investigation could result in criminal charges being filed against the officer, Justin Byrnes, if his actions are determined to be reckless or negligent. The TIMES UNION reported previously reported that Byrnes had violated the department’s emergency response policies and had not activated the siren in his marked 2016 Ford Explorer. Law enforcement sources said turning on his siren would have activated his SUV’s dashboard camera. In Troy, a departmental policy requires city police officers to have their lights and sirens on during emergency responses. Byrnes was placed on administrative leave at the time, and there are not any updates to that status. The New York State Attorney General's Office started its own investigation in March, but has not posted any updates.

This is so sad. As upset as everyone should be about this tragic accident on both sides, I pray the family and 2 sons know that this police officer had absolutely no intention of causing their father's death. It was a terrible accident. I wonder if there's a ground me page for this man?

I would like to add that, I wasn't at the scene so cannot say that there were no sirens, but looking at this very distressing event. No one mentioned that there were no emergency lights on the police vehicle working at the second of the crash either. My condolences go out to Sabeeh and his family all he was doing was providing for his twins. So sad.

Not defending his poor actions, but the lights clearly were on. If you look at the video around 4:12 you can see it. The main footage doesn't show the lights because the significant front end damage immediately disabled the battery and electrical, and by the time you see the vehicle the electrical is already disabled. Sirens also would have made zero difference in this particular situation. Not saying that justifies anything. Still an incredibly dangerous and irresponsible code response.
