There is no such provision in the law that makes written partition mandatory. Partition can be done in four ways, first written and registered, second oral partition, third partition by decree of court and fourth memorandum of oral partition. Of these, what is the legal status of oral partition and how it will be proved in the court? This is told in this video in the light of the important decision of the Supreme Court.

Sir, My Grandfather (died in 1966) was the only son to his father ie My Great Grandfather, he had made some properties, my grandfather had also aquired some properties, he has two sons and two daughters and left all his properties to his sons through Will ( Unregistered ) , elder daughter made a unregisterd partition with her brothers and took some share in year 1997 which later gifted(registerd) to her son in year 2000, later the two brothers and youngest gaughter made a registered partition for the remaining properties between themselves in year 2002 and they are enjoying their respective shares. Now the son and daughters of the eldest daughter have filed a partition suit against the brothers claiming equal rights. Can they claim Pls advice.

Sir, there was an oral partition of property between my father and his sister after my grandfather died intestate in 1945 leaving his self acquired property.Since then no claim was raised by his sister who is now dead. Is not raising any claim by the sister or her heirs enough ground for an oral partition.

Nice but you did not explain what document is sufficient for oral partition. Is the stamp paper with their signature on the deed ok ? 10 Rs or 100 Rs Non judicial stamp with signature of all parties. What would be the language of that deed , is there a format. Please guide with complete information as you would understand that process should be clearly understood and no questions like these should remain unanswered. You make simple and very effective videos and your greatness is your simplicity

Sir after partition within blod relation and occupied their shares and living at that shares for last 30 years. Now we wants to this parted property to be registed as per sec 17 of registration act. Is it should be Realesse or Transfer or Sale or any other method which should be less expensive. Please advise

Sir मुझे वाराणसी या लखनऊ मे प्लाट लेना है। तो मुझे यह जानकारी चहिये थी कि जो मैं प्लाट लेने जा रहा हु उस plot को किस डिपार्टमेंट से approve होना अनिवार्य है यह कैसे पता चलेगा??? जैसे कोई plot city से 40km दूर है तो उसको किस डिपार्टमेंट से approve होना जरूरी है?? अगर कोई plot शहर से 15km range में हो तो उसको किस डिपार्टमेंट से approve होना जरूरी है??? किस/जगह के plots को जिला पंचायत से approve होना जरूरी होता है और कौन से plot को LDA/VDA या DA RERa से apprpve होना जरूरी होता है।??? क्या plot लेने के लिए approval जरूरी होता है या बाद में घर निर्माण करते समय नक्शा पास करवाना केवल जरुरी होता है???

After my father's death my grandmother got her name in succession . Since last 20 years she lives with my uncle and my uncle has occupied most of our property now the rule is that after my grandmother's death her survivors will be my uncles. My grandmother herself has lots of property in her name which grandmother sold all money took by uncles. And few properties were taken by uncles from grandmother in their respective names. My question is why me has to suffer ? My father died before my grandmother. Is that his mistake or mine. Is that can be challenged? How much chance is that we will get the grandmother's share after her death which she got from my fathers own acquired properties. I don't have much money . This is a peculiar situation . My brother did suicide due to sufferings because of the money. Is there anyway anyone I can approach to file PIL. because these rule is helping domestic violence in one way. Any help will be appreciated 🙏

आप सुप्रीम कोर्ट के फैसले के बारे में जानकारी देते हैं अच्छी बात है मगर एक जानकारी भी तो दिया कीजिए कि निचली अदालत से उत्तम अदालत तक पहुंचने में उस प्रकरण को कितने वर्ष लगे ताकि लोगों को पता चले कि भारत की न्याय व्यवस्था में न्याय पाना कितना कठिन

Sir मेरे दादा जी दो भाई थे। दोनो भाइयों मे सारा जमीन का बटवारा 40 वर्ष पूर्व मौखिक रूप में हुआ था। और जो प्लॉट मेरे दादा जी के हिस्सा में आया उस जमीन के सामने से एक सड़क गुजर गया। जमीन का वैल्यू बढ़ जाने के कारण मेरे दादा जी के भाई का पुत्र अब हमसे बेईमानी करना चाहता है। हम मुखिया के द्वारा लिखित कागज भी त्यार करवा लिए है। और गवाह भी है। मेरे पास और मेरे दादा जी के भाई के पुत्र विपक्षी case भी फाइल कर दिया है। तो इसमें कुछ सुझाव दीजिए sir please 🙏🙏

सर अगर किसी एक प्रॉपर्टी मैं 2 नाम है पुत्र और माता का माता के स्वर्गवास के बाद वह प्रॉपर्टी क्या स्वयं पुत्र के नाम हो जाएगी या माता के स्वर्गवास के बाद उस प्रॉपर्टी में पुत्री भी अपना अधिकार मांग सकती है जबकि प्रॉपर्टी को बनाने में पुत्र का पूरा पैसा लगाया गया है माता से कोई सहयोग नहीं मिला

सरजी नमस्कार। मेने एक खेत का छठा हिस्सा खरीदा था उसमें आपसी सहमति से एक कोना मुझे मिला कोई लिखित नही कराया उसमें मेने दो टयुबवेल करवाए वहां बिजली कनेक्शन भी लिया 5000फिट वहां से पाईप लाईन भी लगाई पर अब एक हिस्से दार के लड़के कह रहे है कि वो हमारा हिस्सा था जबकि उसका बाप मोखिक बांट कर गया था कल मेने उसके बाप से बात कि तो उसने सही कहा कि फलाणी साईड का हिस्सा आपको दिया था हो सकता है अब वो बच्चों के कहने पर अब मुखर जाये तो करता वो कोल रेकोडीग माध्यम होगी आपकी बड़ी मेहरबानी होगी कुछ बताऐ

Lekin hamare bade wale dada ji ke beta ka death hogaya 1976 mai aur ye shadi nahi kiya tha inke naam se 8 decimal ka khatayan 1970 sarve ke samay khatiyan ban gaya hai.inka two sister hai .aur humlog dono sister ka 8 decimal dediya kiya inka sisters ye land ko selling kar sakta hai..pls.give me reply.

सर मेरी एक प्रॉपर्टी जो वर्ष 2001 में मैने अपने पिता की मृत्यु के बाद सरपंच द्वारा सजरे में केवल स्वयं को ही वारिश दिखा के अपने नाम करवा लिया था ।जबकि मेरी तीन बहने भी थीं, उनका नाम सजरे में नहीं दिखाया या यूं कहें की बिना उनकी मौखिक सहमति के ही केवल अपने आपको इकलौता वारिस दिखा के प्रॉपर्टी अपने नाम करवा ली थी । लेकिन अब मेरी एक बहन, जिसकी मृत्यु वर्ष 2018 में हो चुकी है उसके वारिश द्वारा सिविल कोर्ट में अपील की गई है की उसका भी हिस्सा बनता है, क्योंकि उसकी मां मेरी बहन थी और उसका भी संपत्ति पर अधिकार है । सर मैं क्या करूं सर । क्या मुझे उनका हिस्सा देना पड़ेगा ।
