Walking Away from a Tenant

The plaintiff gave the defendant a deposit for an apartment, but she claims the defendant started making outrageous demands. She changed her mind about the apartment, but now the defendant won’t return the deposit, so she’s suing. The defendant argues the plaintiff lied on her application, so she doesn’t owe anything

The plaintiff's lucky she didn't get sued for one month of rent also. The defendant had every right to collect the rent for the 1st month and possibly longer. They had a signed lease, and the tenant broke it, making her responsible for the rent until the landlord finds another tenant. Most courts will let the landlord keep the deposit and charge rent as long they can physically prove that they were trying to mitigate their damages by finding another tenant. The planttiff got very lucky in this case.

Some are on unemployment, Disabled people, Veterans, Seniors, Widows, Some displaced homemakers and care givers. Who have paid and paying taxes in this country. I had to be a landlord for several years when I signed mortgage for another. She moved out and started taking in renters. When city moved them out when they had no utilities because nonpayment, the insurance company came in to assess damages. That amount was almost 3k they have me. Sadly they do not pay for bedbug infestation. House was damaged, filthy and infested. Ever in that position again I’d be damned fussy who I rented to. Renters also left owing me approx 4 months rent. Took to small claims for rent and was awarded. Never saw another penny from award. Court awards but do not make sure it’s ever paid. 5/6 years later walked into a coffee shop and guess who was taking my order. I gave up trying to collect. In meantime I was paying two mortgage payments. Never again. There are slumlords as well as slum renters.
@LissyVee
@LissyVee 4 ай бұрын
I’m a renter but I honestly think there are more slum renters than slumlords and it’s more mischievous with the renters because they might come across as normal, decent people until like a month or two later. Whereas you can usually spot a slumlord based on the way they keep their properties.

I can't imagine having her as tenant? It's unfortunate because the planes have probably realized after her outburst that she messed up but then she took it too far with those text messages. She's lucky that the defendant didn't file harassment charges on her because that's the little definition of harassment. Personally I probably would have just gave her back the money just to be done with her but legally she is not entitled to that money.

I laughed out loud with the plaintiff went from laughing to straight faced and not even looking at the judge when she realized she wasn't gonna win. I thought,'she's probably acting afool in her mind'. And then at the end when she was talking and admitted she wasn't sorry, I was like yea, she was saying something hahaha. Love Curt. He's such a provoker😂 Him asking what did you mean when you said If I snap don't call the cops? He was trying to get her to admit to past crimes...she smiled like ummm pass. 😂

So, do landlords actually ask permission to visit a prospective tenant’s CURRENT residence to see how they “keep” their place? Is that really a thing?? 😧
@M2161
@M2161 5 ай бұрын
Usually landlords would ask for a reference from previous landlords during apartment applications regarding issues like how the tenant keeps their current apartment, how well they pay, etc. Visiting is definitely odd

Defendant dodged a bullet here and should be thanking her lucky stars the plaintiff didn't move in. Plaintiff getting all wiggy because the landlord was asking for the remainder of the payment and to sign the legal paperwork before she could enter the unit? That's code for the defendant not having the money and shafting the defendant the funds she would have to pay above and beyond Section 8. And then the plaintiff saying she doesn't like the defendants vibe after asking for the balance? Then the txt stream on top of it all? I like the face on the plaintiff as JM reads out her txt's, yes plaintiff, we see you just realized that you are that cray cray. "Have you ever been to therapy?" JM nailed it. Tell us you're a nightmare tenant without actually saying you're a nightmare tenant.

Sometimes embarrassment is good. No one in her family or circle of friends would have pointed out to her how crazy that was. Clearly she was embarrassed because she got to hear how crazy she sounds, while she was unemotional with a clear mind. This lady was ready to risk it all for her $500. She would have made a decision that she would regret. If reading those out loud embarrassed her and could have her to take pause in the future, it was worth it.
