To have a common law, or "informal" marriage, you need to meet three requirements:
1. You and your partner agree to be married
2. You “hold yourselves out as married”
This could mean:
Introducing each other as your husband or wife
Wearing wedding rings
Filing taxes jointly
And more
3.
You live together in Texas after you agreed to be married.
Some people think if you simply live together for long enough, then you have a common law marriage.
This is false.
The law doesn’t talk about time. You just need to meet the three requirements.
These requirements are also true for same-sex common law marriages.
