On Jul. 20, a 16-year-old River Valley High School student was charged with the murder of a fellow 13-year-old student.
An adult charged with murder in Singapore can face the death penalty. But what happens when the person in question is only 16-years-old? Criminal defence lawyer Josephus Tan breaks it down for us.

The victim parent's heart is very big. I can't. If the boy and his family used mental problem as an excuse, I will go mental and kill them all too. Then I will accept that whatever the judge given for the boy's charge as fair enough for mine. I can accept death too as I can't imagine life without my son.

@@DeeDixon24 Testimony shared by a staff over River Valley High tragedy: I just want to share what my principal shared with us during the staff meeting earlier. It was a particularly tough day for her because she was about to make her way to the wake of the 13-year-old boy who died under her charge. She expected that his parents would be particularly hostile. After all, their son died in the care of the school that she is leading. When she reached the wake, the mother was unusually calm and the father, after crying for a while, ministered to her. The family that she came to comfort was the very one that was comforting her. She testified of how the family lived out the Christian values that they believed in. How the parents said that they were not angry at the 16-year-old boy who took their son’s life. And they asked my principal to convey to the 16-year-old boy’s parents that they should take care of themselves. My principal is not a believer, but she also recounted publicly (this is out of her character to do this because she always maintained secular space in official communication) how the parents of the 13-year-old boy asked the Lord about where their son is right now. From what I understand, two of their friends independent of each other received prophetic dreams that God was indeed the one who had taken their son home and that he did not suffer. The parents testified that he is now at a better place. May this account comfort us as we begin to recognise the Lord’s hand even in the midst of these recent events. Thank you all for praying! Blessings. The school counsellor, who also attended the wake, also testified that the boy’s parents are very comforted and hope that the boy’s legacy (e.g. church becomes united in prayer) will live on.

@@mabeldin7891 Mental Health is the issue here. And yet you say that its an excuse? Helping the 16 year old kid as well as providing help to students all over Singapore is the most important thing that is needed to do to prevent these things from happening.

This video is timely and answered many questions that we didn't take note of as such crimes are rare in Singapore. I saw some folks talking about doxxing so I did a quick search and CNA published on 1st April 2019 : Perpetrators of “doxxing” could face a fine of up to S$5,000 or a jail term of up to 6 months if the intention was to cause harassment, or 12 months if they intended to cause fear or provoke violence.

@@SSBMA1994 There is no guarantee the unnamed murderer might be let into our society some 17 years later as a man of 33 with a very dark dark past and not fully recovered from his mental illness. Btw, the 15 y-o murderer hired by Anthony Ler to slay his wife is now in our midst after 17 years in jail.

E and yeah both are victims, that boy that died was tragic but he is now in heaven, as for that accused, he is now under torture, having to live with punishment and in this world with a shameful reputation, not just physical prison but his own mental prison, its hard for both but i feel the boy that became insane is the real depiction on how neglectful this society is nowadays, its not just singapore, its almost everywhere.

In singapore maybe, but not in other parts of the world. In the US, there is the slenderman stabbing, where 2 12-year old girls tricked their 12 year old friend into the woods, and stabbed her 19 times. There are a number of videos on this on youtube. These girls have mental health issues as well. Mental health is really important, even among kids.

The killer was previously hospitalised for trying to kill himself, I'm not surprised he's doing something this extreme in the hopes the courts would consider charging him as an adult and give him the death penalty.

Death penalty is a relief of his physical pain but his consciousness and soul can never be redeemed. We solved the problem of eliminating the demon from the possibility to kill again but no1 is helping the boy to rid the demon of his consciousness. What is he thinking and what drive that to happen in our society.? Thinking of his source of anger and motivation scare me.

They really should allow actually qualified counsellors to work in schools, my sec sch counsellors were full of shit (excluding the career guidance counsellor) and when my friend made a difficult choice of seeking for help with the counsellers, neither did they help to better her situation or at least provide useful advice they actually made her situation worst. Adults who are not 'qualified' for psychological jobs can impact vulnerable youths heavily even if it was unintentional.

If he's between 7-12, he'd spend a maximum of 20 years for murder in Juvenile Confinement. But since he's passed that, I'd say 30-50 years in prison and 24 strokes of a cane.

I remember going home from the third language center and being completely horrified at the news. My classmates sent me a link to CNA’s evaluation or something and I remember just sitting in the car being completely speechless on the way home. Then, a week later, I hear news about a student falling from height in another school, and then a basketball structure killing another boy. What’s even worse was that the boy who was killed by the basketball structure was a friend of my sister’s classmate, who is devastated. Alongside the sudden spike in Covid cases, this month has been terrible. Also random funny fact: my sister is now a conspiracist. Don’t ask

Working previously in forensics, we come across no lack of serious cases all the time. This is not the first such case in SG anyways, there are number of cases not made public. Usual procedure is: He'll probably be remanded in psychiatric institution, CPC or otherwise, indefinitely. In that period he might head over to CWC or RTC until 21 years old, then transfer to penal unit. Whether crazy or not, he may face life imprisonment in CPC. Sometimes this can be minimum 20 years, or indefinitely in the psych unit. There are also cases where crazy murderers are released from prison after 30 years and into mental institution, the release from CPC depends on juridical decision. So it'll be psych ward from 16-18, then CPC RTC till 21, then either CPC psych or penal indefinitely.

i think they will have a doctor see if they can still go on, if not they will be brought back to recover and once they are well enough, they go get caning again

Depends on what you mean by at one go. If the person faint for 5 minutes can continue? What if faint 30 min? I guess best strategy to siam cane is to let the caning start ... then faint for long enough that they cannot complete the punishment at one go. :)

Yes, a very tragic case. Two lives are lost, the victim as he died and the offender as his life will never be anywhere close to normal anymore whether it is lifetime incarceration in prison or the death penalty. And there's unimaginable trauma and hurt that may go on to haunt the lives of the family and friends for both the victim and the offender. Died due to murder is not right, imprisoning a young 16 years old for the rest of his life is no justice, putting a 16 years old to death is neither right nor justice. This is a tragedy, regardless what is the outcome... My sincere condolences to the victim and his family, my sincere sympathy to the offender and his family... If the offender had needed mental health help, I hope he finally gets it even though it is quite late at this stage due to what had happened... Tragedy and sadness beyond words.

I have a question please. If we interpret what has been presented in the news so far: 1. attacker has gone online to buy a weapon 2. he told students to call the cops cos he killed someone Do these sound like he does not know what he is doing? How will these be presented to court? Mental impairment? Lack of mental soundness as it might be, it was a planned crime. As a society we need to address some of the issues raised by this crime. However, let us also not forget to ask: Who’s giving the 13 year old another chance of life? Thus for the life taken from him brainlessly, shouldn’t there be a price to pay?

High social chaste school. Planned and sane. Just because admitted to imh before dosent mean someone has mental issues. Unless if your are born with a physical mental deficiency, 99% others are all wayang one and behavioral problem most likely caused by upbringing. Even his parents already stated they wont attend his court hearing. He obviously did this for attention or out of spite for his parents. The true example of money isnt everything.

I've met the accomplice of a murder case when i was in prison,his partner was already send to the gallow as he was eligible due to his age,the accomplice since he was still at the age of 16 was sentenced to TPP ( till president pleasure )their case was a terrible one,victim was beaten while still alive unconsious they burned him to death,the case of Rathakrishnan Ramasamy & Ramu Annadavascan in 1981,Ramu met the hangman he was only 22 yrs old,Ramasamy was only 16 when both did that crime in 1981,Ramasamy was a TPP & i met him in prison in 1999,all inmates are not allowed to communicate with Ramasamy & he was always escorted by wardens to be honest he did have that heartless face he would sometime stares at you for a long time,a bit scarry i can say when he gave u that kind of sharp look,someone told me Ramasamy was released in Sept 2001,hope he can change upon released

Missed point here: Did Singapore ratify the UN convention on the rights of the child? I remembered there is a clause saying that this UN convention prohibits life terms to be given to Juveniles (Below 18), The lawyer here says that life terms can be given to under 18s, Did he miss this key clause?

Hi Daniel, What happened is a real tragedy, However the UN treaty was formed with the assumption that juveniles are still developing, And therefore not beyond redemption, They should be sent to jail for a finite term, Because unlike adults they are more capable of rehabilitation, That's the reasoning behind such a treaty in the first place.

This no longer applies already. Now the max sentence teenagers can get is life imprisonment (meaning that the minimum period they'll be behind bars is 20 years, following which there'll be a review every year to decide whether the prisoner is suitable to be released on parole)

Yea, spending money for free food n accommodation for twenty years for a mentally sick person who has commit a murder of some innocent people. After that, be let loose into the society at large and hopefully he doesn't relapse n kill another one. Not sure who think this is a good idea. What's wrong with getting rid of a a defect human? Life is never fair, there's so many innocent people with hard life needing help n never got sufficient help. Why don't we use the fund to help them instead. i am honestly still angered by the stupid comments out there about the 16 year old boy(not on this vid but just everywhere else) like people asking why he's not getting the death penalty. i honestly really sympathise with the boy and is really sad that no one else sees him as another victim that can be helped and instead a cold blooded murderer that can never change. there's something called mental illness okay, no one of the public knows exactly what the boy has been through even me so just stop commenting negative things about him cos it would only make things worse. thanks

What sympathy does he deserve? How is he able to study in a normal school despite having mental illness? Why does he deserve a second chance when he didn't give the 13 year old a second chance? I'm sorry, but the fact that people are pitying a murderer is beyond me. Everybody keeps talking about sympathy but would you still have been doing so had it been your own kid who was the victim? I highly doubt that. Nothing can compare to the pain of losing a child & the only one who has the rights to give any form of forgiveness would be that poor boy's parents!

This and many cases had shown us parents that we need to proper educate them from early age. Parents need to have proper work life balance and commitment to be involved in their child life and mind. Don't just buy them games and eletronics and think "I am the best parent ever!". Companys, bosses and superiors, be understanding when your employees needed time off for family time. Your child or any child might be the next victim too. That is scary for me.

Also in 3:23 of the video says it has to be 20 years at least during the imprisonment, then he can be eligible for "parole interview" aka early prison release temporarily or permanently which shocked me cuz I didnt know life imprisonment can get parole if deemed sane by the doctor after 20 years of imprisonment...
