What is a wheel witness in a traffic ticket?

Hello, everybody out there in social media land, it's your personal injury family law attorney, Derek Bernstein here to give you a little civil citation, a little car crash legal questions coming here. And one, I want to teach a little bit here is called what is a wheel witness. What is a wheel witness? So that comes up a lot in court are cases when you're trying to get dismissals and things like that, you need somebody who can actually place you behind the wheel of your car. So if you have the door open in your car, the ignition's on and you're outside, And then the cop pulls up and it's like, hey, what happened? And you listen to my other video so you can keep your mouth shut and you don't say anything. They can give you a DUI, but guess what they can't do? Put you behind the wheel of your car.
They can say, there was an open door and the keys were in the ignition and the person went into the 7/11, and they were going to come back. That was their car, it's registered in their name. Well, guess what? They can't about a shadow of a doubt say that you were driving that car. There's a lot of other weird explanations of why that car was there so there is no wheel witness. Just talking with somebody, you get people, if a witness, or a cop comes up after a crash, tries to sight you with something, well, they can't place you behind the wheel to do that. Don't admit to things to cops, don't talk to cops. My other thing, you need a wheel witness. So if you get into an issue, you got sighted, and you're like, man, I don't think anybody can put me as being the driver of the vehicle. That's the wheel witness, that's your way to get things dismissed, that's the way you fight it.
