I have switched my the pvt IT company(last day March 12 2022) and it was conveyed that by April 30 2022 my gratuity would be credited.. But till now i havent recieved and the reply i got is” my gratituty payment is not been processed by LIC as they are busy closing FY 2021-22 books” . If nps holder employee have 8 years service ..then he eligible for SG in lieu of pension and RG...but if he has nps corpus 8lakh...then only 5lakh in nps account can fully withdrawal so what happened with 3lakh as he is not eligible for pension..

I need some advise. My father is retired army personnel who worked as OT Supervisor on contract basis for 10 years. Also if you could provide some literature where it is mentioned that GRATUITY is applicable on CONTRACT EMPLOYEE. He work for organisation for 10 years continuously. Contract is renewed every year. Also Employee is directly hired by company/trust and not through contractor. Organisation is Hospital run by Charitable Trust. But Hospital do charge patient for treatment. Do such employees are eligible for gratuity? PART-02 Organization also did not pay LEAVE ENCASHMEMT plus Pay for one month notice period, even after 6 months of termination of Contract. What legal remedy could I take?

सर मुझे ये जानना है की मेरे पिताजी मार्च २०१७ मे retired हैं, क्या वो न्यू ग्रेटटुइटी एमण्डेंट के हिसाब से एलिजिबल है? पेंशन मिलती है, लेकिन डेट ऑफ रेटिरेमेंट येअर् के कारन पैमेंट को delay कर रहे है। सेवेंथ पै कमिशन के एमण्डेंट के हिसाब से bataiye प्लिस्। क्युकी उनके ग्रटुइटी अमाउंट में दस लाख और मिलने चाहिए एकार्डिंग सेवेंथ पै कमिशन, मै फिर बता दु की वो २०१७ में retired है।

First you have to add Gratuity amount in your Gross salary u/s 17(1), then Less it in Exempted Allowance column u/s 10(10)

भाई साहब मेरा रिक्रूट मेंट हाई कोर्ट से हुआ मेरी सर्विस रिटायर के समय मात्र 32 वर्ष और कुछ माह हुए माननीय उच्च न्यायालय के आदेशानुसार मुझे सभी बेनिफिट देने के आदेश दिए गए लेकिन एक अनजान डाक अधीक्षक ने मुझे 33 वर्ष का बेनिफिट नही दिया याने kwalifit सर्विस मेरी 33 वर्ष नही थी जिसे कोर्ट ने विभाग की गलती मानी थी मेरी कोई गलती नही थी। कोर्ट ने कहा कि सभी सुविधाए श्री पुष्कर सिंह खाती के बराबर मुझे सभी बेनिफिट दिया जाय क्यों कि विभाग की गलती से मुझे मुझसे जूनियर के बाद नौकरी दी गई। अतः क्या कोर्ट मुझे रिट याचिका दाखिल करने के अनुसार मुझे grechyuyati 33 वर्ष की देगी। बताने की कृपा कीजिएगा मैने उच्च न्यायालय में रिट याचिका दाखिल की है।

ग्रेच्युटी कैलकुलेशन में लास्ट बेसिक पे+डी ए लिया जाता है या सिर्फ बेसिक पे ही ली जाती कैलकुलेशन में? कृपया बताना सर जी

Commutation is maximum 40% of Pension Basic. No DA included.

क्या ग्रेच्युटी प्राइवेट कंपनी में मृत्यु होने पर भी प्राप्त होगी यदि कर्मचारी की पांच साल के भीतर मृत्यु हो गई हों क्या ग्रेच्युटी की रकम के लिए कंपनी को आवेदन करना होगा या स्वयं भुगतान करेगी

Namaskar Sir , sir mujhe aapse ye janna hain k agar koi private employee kisi company mein total 5 saal se jyada kaam krta hai jisme COVID ka 1 saal bhi plus Kiya gya hai. kya us employee ko gratuity milni chahiye k nahi? Jabki employee ko 1 saal k COVID period mein company ki taraf se koi amount nahi di gai thi And company COVID ka baad jab open Hui to employee ne company ko fir join kr liya . KYA IS SETUATION MEIN GRATUITY APPLICABLE HOGI ? PLS REPLY SIR🙏

COVID k bas employee ne fir se wahi company Jain kr li and March 2022 tak job bhi ki , isme employee ki to Kai galati nahi hai na. Company ki taraf se koi termination letter bhi nahi diya gya nahi ye bola gya k aapko nikal diya hai bas 1 saal tak ye bolte rahe k jab government allow kregi tab khol lenge

Sir I have questions . I am the only child of my late mother who served government job from 1992 till 2014. I am married now and I have received letter for terminal benefits. I am aware that I won’t be eligible for pension but Would I be eligible for gratuity? Thank you in advance Thank you in advance

You are eligible for all terminal benefits EXCEPT family pension.
