F1 international students who have successfully applied for their Optional Practical Training (OPT) Employment Authorization Document (EAD) need to be aware of the next steps involved after applying for OPT. These steps include the following;
STEP #1: Tracking Your OPT EAD Application Packet with your Courier Service Provider
It is always recommended that you receive tracking information from your courier service provider or USPS. With this tracking information, you can monitor the delivery of your OPT EAD application to USCIS. In the event that you encounter any issues with the delivery of your mail, you should contact the customer service representative of your courier service provider immediately.
STEP #2: Receiving Your Form I-797C (USCIS Receipt Notice of Action)
Upon the receipt of your OPT EAD application by USCIS, you would receive a form called the Form I-797C Notice of Action. This form acknowledges that USCIS has received your EAD application. It also contains a receipt number located at the top left corner. This receipt number can be used to track the status of your case with USCIS. Keep in mind that it could take as long as 4 weeks or more to receive this receipt notice from USCIS. Best Tips to Speed Up Processing of USCIS Case
In some cases, your OPT EAD application might take longer than the typical processing time to be adjudicated by USCIS. If you find yourself in this situation, you should not stay idle while you wait for USCIS to adjudicate your case, there are things you can do to make USCIS take action on your case. STEP #3: Receiving an I-797 Notice of Approval and the OPT EAD Card (for successful applications) or a Request for Evidence RFE (for applications requiring more scrutiny)
If your OPT EAD application is successful, you would receive a Form I-797 Notice of approval in the mail, followed by the Form I-766 also called an EAD card. Inspect this EAD card ensuring your biographical information is correct.
What if I Get an RFE from USCIS?
For some EAD applications, USCIS might require more information to adjudicate the case. Under this scenario, USCIS will send you a letter called a Request For Evidence. This document would contain a list of issues with your case and the documents you must provide to rectify them. If you receive an RFE on your OPT EAD application, it is best to contact your DSO to receive advice on how to respond. Your University’s international office (and its DSOs) should have a lot of experience dealing with F1 Visa students who have encountered RFEs on their OPT EAD applications. When responding to an RFE, you must do so within the window described on the letter, and send all the requested documents in one single mail.
STEP #4: Reporting Your EAD Card to Your Designated School Official (DSO)
You should also make a copy of the front and back of the EAD card and send it to your university’s international office or Designated School Official (DSO). Keep copies of this EAD card for your records as well.
Note: As an F1 student you are not allowed to start working on OPT until you have received our EAD card and the valid from date of your EAD card is current.
