He didn't ask for a lawyer. Invocation must be unequivocal. He said I'm not going to answer questions without an attorney that wasn't invocation. He then continued answering questions.

@@paleo704 Actually its way safer to just say "I need a lawyer" and then remain silent. In the U.S., there have been many times where interrogating police will try to manipulate you(even in the case where you're trying to help) to admit to a crime that you didn't do(but someone else may have done). They will usually try to wear you down by questioning you for many hours, put words in your mouth, or use the good cop/bad cop technique. If you admit to something(even if false) then the court will automatically find you guilty. Sadly, many people don't know you can legally leave of your own will after 48 hours if you are not under arrest.

Yep. There's a few different ways that they play the game. Be able to recognize the BS that they'll fling your way to put you at ease. It's very common to tell you that they're reading your rights because "it's standard for anybody entering this room, it's just a technicality, hehe, buddy, pal!" (Yeah, right, it's standard for a suspect that they're interrogating. When I've given a statement for a car accident that I witnessed, they didn't read me my rights or tell me about the penalties for perjury.) They usually won't tell you that you're a suspect, instead it's the ole, "We're eliminating you as a suspect, just a formality!" (Your lawyer would have a field day with that line of crap. It's a clever way to shift the burden of proof to you. Everybody is a suspect until they prove to the cops' satisfaction that they're innocent, uh-huh, right. It doesn't work like that--unless the guy being pulled into the room allows it to go like that because he doesn't know any better.) I think I'd also be asking, "I'm in an interrogation room, not an office cubicle. The door behind me is locked and you're telling me that I HAVE TO be here. Tell me again that I'm not under arrest."

@@respectdawildo_danjones508 You'll know that you made the right decision when the cop trying to buddy up to you suddenly gets real cold and starts looking at you like the drunk uncle at a family gathering that is looking a little too hard and long at your daughter. They'll also tell you some shit like, "We're just trying to get you out of here! Doing it our way, you're on your way in half an hour. If you get a lawyer, it'll be days before you can get him in here, is that what you want?" Yep, that's what I want. They wouldn't have you there unless they were trying to railroad you. I've seen plenty of videos on how they treat witnesses, that's bad enough. If you're anything but that, they're looking to send you to prison for as long as possible on as many stacked-up charges as possible. They don't get pay-raises and promotions for declaring you innocent and sending you home. If you're in that room, you're a target and nothing else.

It's obvious he wanted to know why he was being looked at without saying anything incriminating. He wanted them to give him some info so he can clean up after himself and eliminate any witnesses or accomplices in the crime but being a criminal he can't just guess which crime they're investigating because he's done so many.

He was blessed with another attorney in the area with prostitutes and cocaine. But because he knew how to think like a criminal he knew how to beat the system. You? Are. Absolutely? Being detained requires a reasonable articulable suspicion of a crime. They're refusing to tell him why he's being detained. That's when you get up and walk out. They won't say why he's there... Wrongful imprisonment. Way to go Bacon bits

My last interaction with police was about ten years ago. Someone had used my credit card number to buy video games online and I had obtained the local address where the games were delivered. I figured they might want to pursue it. Instead of taking the information I had for them, they seemed more interested in me. Who I lived with, what I did for a living etc.. They also asked if they could come inside my home and look at my computer and phone. I asked what any of that has to do with someone using my credit card to buy video games online. I was told it was all part of the investigation. Told him hard no and thanked him for his time. Found out months later that the address I gave the police was the home of one of their officers... and that the officer's kid was friends with my GFs son. I assume the kid had been to the house and got his hands on my credit card. So instead of being honest and working it out, they decided to try play games. Will never speak to the police again without a lawyer present.

This has happened to TWO of my friends. Not with games but once w/ a stolen card and one with drug possession that they tried to say they couldn’t get caught bc their dad was a cop…couple days later that kids dad arrested my roommate for possession of the very same bag that his kid had been caught with. His kid was never charged but my roommate was…fuckin pigs

A kid without a license hit my car and it turns out, he was a child of a lady who worked for a judge. She came out to accident with a police officer who strong armed me into not filing charges. So these stories do happen. If it does not happen to you consider yourself lucky.

Interrogation room: cops come in, do intro, question 1 to me, reply: I plead the 5th amendment. I do that until they get to really why I'm there, then I say lawyer. With nothing else to hold me on, and/or no evidence tying me to anything, I leave, go have a leisurely lunch, dinner or breakfast, retain a lawyer, they get full discovery, then I go about my universe if & until they wanna come back with more questions. Which they won't because I'm not a criminal or even about that life. But a friend of mine who is a criminal lawyer in the D.A.'s office advised me as a homeboy THAT is the only way to handle a fireside chat with police in their hotseat. Even if guilty he said follow same procedure. He point-blank said "Its NOT what you do and say with the police that HELPS you, it's what you DON'T do and say that DOES Help you".😎👍🏾

Cops can’t lie to a suspect to get a confession ive been a lawyer for awhile now. I’ve had cases where that did happen and all charges were drop and they were very serious crimes.

We must have watched different videos because that guy in this one gave them all kinds of information. He's pretending not to be able to figure out why he is there despite it being blatantly obvious based on their first few questions. He refuses to talk about anyone EXCEPT the one person he knows might tell the cops the truth. That person he talks all kinds of crap about to try to discredit. And while still being tight lipped about every little detail he still goes out of his way to give information that if it were true would remove his motive for killing the guy... despite still at the time claiming he had no clue why he was there. The list goes on and on. Combine all that with other suspects' interviews and evidence and you get at least enough for that search warrant.

I once was interrogated like this, trying to get me to snitch on a friend, so I told them everything I had to say, and at the end of the interview, they had a pretty good understanding of the book Ender's Game, they were unhappy with me.

Man. I was harassed once and told through the phone that if i dont show up at the precinct for questioning, that theyll pick me up at my known addresses. I immediately called a lawyer. Lawyer called the detectives and I was never harrassed again by the detectives.

I basically had the same thing happened to me not too long ago. With police trying to use bullshit scare tactics against me. I told the police officer on the phone “Come over I’ll be waiting on the front porch.” The police drove by the house a couple times and each time I waved at them from the front porch. The police never stopped to pick me up. All I can figure is word got around that I never answer questions and because I wouldn’t willingly come to the police station and had no charges against me they chose not to waste their time.

He was given a pass that time and only kicked out but then came back later, broke into someone's home and committed a kidnapping and a robbery. Years ago I was accused of a crime by a neighbor. When the crime occurred I was with a detective sergeant, welding a forge for him. The neighbor was initially accused. He denied it and pointed toward me. When I had a detective as my alibi they sent a female cop to question me and offer to pick me up and drive me to another county for a polygraph. After I stopped laughing I reminded her that it is inadmissible and the likelihood of passing after a 45 minute drive with her would be very unlikely. I told her to charge me or leave me alone. She called the detective who corroborated my testimony. The detective told me to get an attorney. Innocent people need lawyers more than the guilty.

You should definitely not talk if being interrogated in this setting under these circumstances. However, many people think this works in all settings with police. Which usually backfires. If you try this tactic, for instance after getting pulled over. They are going to break your car, throw you on the pavement at Mach 4, and take you to jail. And then laugh at your bravery and lack of actual legal understanding.

I’ve been a defense attorney, and I’ve been a prosecutor (did defense for much longer than a prosecutor). Just ask for a lawyer. This guy did a good job at evading answers, but you know they can lie to you. Just respectfully request an attorney and let the cards fall where they may. There’s a great video on the internet from Richmond School of Law (I think) that goes into detail about why you shouldn’t talk to cops even if you’re innocent since they can use your words out of context at trial (or even in probable cause affidavit). When in doubt, ask for a lawyer. Everyone thinks they can talk their way out of it, and the vast majority of people are wrong.

Okay but now... let's say you are the murderer they are looking for. As much as you KNOW you need a lawyer, I think quite often the need to hear what is going on in the investigation overrides your own logical sensibilities. Do they have my fingerprint? My DNA? Did someone see me? If yes, then where? What made them decide to speak to me?

@@harpoon_bakery162 You’re right. Also, asking for a lawyer doesn’t equal “the police will release you.” Lawyers make sure the law is being correctly followed. But you can still be arrested for a crime. Just remember “What YOU say, can be used against you.” Not what your lawyer says.

The thing that has always pissed me of is: it is common practice for investigators to lie and manipulate a suspect...but if the suspect lies to them ...its a crime.

Even if you lie that you did something that you didn't, it may not be a crime but at the same time they keep repeat asking the same questions, they make people feel like they are going to be locked up either way so a lot of them will just lie that they did it to get out of the interrogation, and what kind of justice is that? the criminals are still out there.

I got arrest in my early 20’s for marijuana. I bonded out they arrested me again for same exact charge and they went to my family’s house and arrested my dad took my son to social services. Just to try and get me to talk. I mean cold blooded. I got a lawyer and they backed off.

As a lawyer, don’t try to out smart the cops. Just keep your mouth shut. This guy didn’t do himself any favors by talking. At best they get nothing, but 99.99% of the time they do. Help your lawyer help you: respectfully assert your right to remain silent and ask for an attorney.

I saw a case about a type of prosecutor that was accused of killing his Son and Wife. I saw the entire case, what the guy did was "ask for lawyers" pretty early after the cops started to interrogate him. He talked with the cops at the crime scene as he was the one that called the cops over. There was no evidence he committed the murder. the 2 people were both shot with different weapons. Those weapons were never found. The dude (fat and in his 50-60s) had to run quite a large distance from his house to where the killings happened and back to get rid of all that blood on his face and stuff. Regardless it was obvious that he didn't do it. But everyone hated that guy as he was a piece of **** and financially scammed a lot of people. What happened during the trial? The prosecution used the fact that he asked for a lawyer against him over and over and over again. Implying that he did that only because he was guilty. And in the end he was convicted of both murders. As a side note, 1 year before, he helped this "son that he killed" get out of an accident where this son killed someone (I assume unintentionally). So, I think you are over simplifying things with "ask for your lawyer right away". It seems that is being used to "he is guilty" mark people anyway.

Had a friend interrogated by the police. He didn't do anything, they were fishing. He answered simple questions UNTIL they told a lie to try to trick him. He told them to shut their mouths right there until a lawyer was present. When they tried to talk to him he told them they were liars and he didn't talk to liars and to shut their lying mouths. The cops blew it.

Texas law says you only lose your liscence if you refuse tests. I was pulled over for going over 80 on a 4 lane highway. The cop said he smelled booze. He told me the way it works is that he takes us to jail, and if the tests come back negative, than I get set free. I passed all the tests, and my voluntary blood tests showed 0.04% BAc, which is halfway under the legal limit. I was thrown in jail and tossed into solitary confinement because I had Covid at the time. I tried to tell the officer, but he profiled me because I was sick. Also, I was honest with the cop and told him that I had a Hot Toddy since I was sick. I was arrested in late December 2020. My case was FINALLY dismissed on April 19th, but I lost my car and had to pay $200 a month for a breath test during the almost year and a half of pre-trail. Imagine losing everything just because you were raised to be honest. Imagine losing everything because of a cop when you didn't even commit a crime. I remember begging to eat, as I hadn't eaten in almost 2 days when they did bloodwork. I almost bloody passed out when they took the 2 viles. Everything was cold, and in black and white. I was losing control of my body, as I saw the silhouette of the officer coldly telling the guards "Throw him in the cell." It was a God awful experience. Literally, it's all about money. If you don't have money, the laws WILL have thier way with you.

I cursed out a cop after they were giving my 4 year old son to his mother.. who had JUST threatened him to his face that she was going to kill him. I cursed that cop out and was IMMEDIATELY tortured off and on for HOURS! I have had to have MANY surgeries to correct what they did to me. And now because of them my hand is deformed and my pinky is now L shaped.
