This talk was given at a local TEDx event, produced independently of the TED Conferences. Michele Deitch, an expert on prison reform and juvenile justice and an award-winning teacher at the University of Texas, addresses the problem of youth who are prosecuted in the adult criminal justice system and confined in adult jails and prisons. She describes the troubling conditions she has witnessed, and discusses the kids she has encountered in the course of her work who have persuaded her about the need to change the laws and policies that permit this practice.
Michele Deitch ’82 is a Senior Lecturer at The
University of Texas at Austin, where she holds a
joint appointment at the Lyndon B. Johnson
School of Public Affairs and the UT School of Law and teaches graduate-level courses in criminal justice and juvenile justice policy. Trained as a lawyer, her particular expertise includes juveniles in the adult system, the management of juvenile offenders, and prison conditions and independent correctional oversight, and she has authored numerous publications on these issues that have
garnered national attention. Along with her
students, Deitch works closely with Texas
legislators and other key stakeholders to conduct research that helps inform and shape policy and practice. Deitch has been the recipient of a Soros Senior Justice Fellowship, as well as numerous awards for her teaching and commitment to service-learning. She holds a J.D. with honors from Harvard Law School, an M.Sc. in psychology (with a specialization in criminology) from Oxford University (Balliol College), and a B.A. with honors from Amherst College, where she also served on the Board of Trustees.

This was a fantastic speech. One thing left out of the conversation, however, (and I understand why) is that the adult system is often a pretty horrific and counter-productive system for ADULTS as well. I think juvenile justice advocates are harmed in the long run by failing to take that on.

Totally agree with this. I learned a lot from this video but I hated how the speaker seemed to insinuate that these sort of prison environments are acceptable for adults. The conditions in our prisons are horrific and unacceptable for everyone... For anyone interested in the validity of prisons in general, I recommend reading "Are Prisons Obsolete" - a great book about the devastating consequences of prison and how utterly entwined to injustice they are.

Much respect to Dr. Deitch. She works to improve the treatment of juvenile offenders which in turn will benefit society upon their release.Americans have a propensity to conflate 'justice' with 'vengeance' and the result is excessive sentences in horrible conditions. Keep up the good work. Cheers.

+fratdawgg23 It's not 'Americans'. It's the prison profiteers and the 'tough on crime' politicians. A lot of us would love to see rehabilitation emphasized over 'punishment'. For those who can't be rehabilitated, I think a firing squad of with three scoped .308 rifles aiming at the brain stem would solve it. It's the same thing I'd do for a pet that can't be rehabilitated, except it'd just be one .308 rifle. It's merciful and it reduces the risk of future murders. I consider warehousing prisoners a waste of money and cruel and unusual punishment.

Just saw your video and I'm angry at the system for doing that to our children. All of us who believe in protecting these young kids need get together to help change the laws. I believe that kids can be held accountable for whatever crime they commit but in the right environment.

Anyone who is under 15 should not be charged with any crime Mandatory minimums shall also be reduced by a lot No offence should have a mandatory minimum of more than 10-12 or definetly not more than 15 years And lwop or death should be reserved for the most outrageous cases

I’m 14 and could never imagine this..... I am so sorry children are going through this. These are the kinds of things that take away faith in humanity because it isn’t just these situations where adults treat children like them. We dress children as young as TWO in crop tops, ripped up jeans, putting five year old girls in makeup..... what is childhood anymore? People informed me that a nine year old child must have a mental disease because they said “Mommy.” This is what our world is coming to and it scares me. I couldn’t imagine this happening to my little seven year old cousin. The fact someone his age is allowed to be put in jail at all is horrifying. I am so sorry for the parents in this world who lost their kids because of this.... please: help my generation know these things, so they can change it, and make this world a better/safer place for children.

I hear you. I had TikTok downloaded on my phone but never looked. One night I spent a few hours scrolling. I saw clips of toddlers dressed how you said, I saw kids in twerking completions, I saw videos of adults coaching their kids to talk and act like adults. It was a scary experience.

Sadly, there are even some juveniles tried as adults where pretty much everyone who knows of this case is pretty much vile and abrasive towards that juvenile inmate. Torey Adamcik is a noticeable example of this where it even got to the point where a judge denied his post conviction request earlier this year, ONLY because he was swayed by the public opinion. I've been trying to tell the zillions of people who are abrasive towards Adamcik, that just because you all feel that way towards him, it doesn't mean that they should excuse the judge for the fact that he was swayed by them and violated a conduct rule in doing so. But, because of their extreme vileness towards Adamcik, along with the fact that they all were pleased with the judge's ruling, they couldn't care less about the fact that the judge violated a rule in the conduct.

Kinda the origin of justice systems, see hammarabi, punitive measures are necesary for incentives but emotional and vitriolic revenge based justice is not for the modern age and much of our system does resemble this

I was in juvenile 2 times in michigan. Then at 16 I went to jail in North Carolina and it was really bad.

I was one those kids at 15 that were blessed to get decertified I ran out of 🚖 cab 🚖 N the driver tried put his knee in my neck n break it so I stabbed in the top part of his hand wrestled n accidentally in his knee wasn't that deep Too much to explain I never went to the state penitentiary iam 37 was facing 5 to 10yrs the judge said If would have stabbed two inches down I would of charged with attempt murder sometimes kids deserve a second chance I did one 11n half to 23 months at 31for stealing Cooper abandoned houses but I never went to the state penitentiary so give some kids a second chance they deserve it I spent a year a group home prior n psych hospitals that rehabilitated me but I wasn't a Saint but I never went to the penitentiary do u understand u in certain count jails they have watch the P.I.R.A act in the holding cell before u enter to ure cell block this is what u send kids into not rehabilitation

I understand that there are issues with children who are being tried as an adult for what can be seen as petty crimes but when it comes to something we would never expect a child to do like murder then the question becomes more about what are we doing wrong as a society. Children committing murders has risen over the years. So what do we do for them that we refuse to do for the adults in our society? Just curious.

The 16 and 17 year old that stays in a juvenile setting instead of the adult prison becomes a teacher / mentor to the younger kids in the detention centers. Should the state protect the few juveniles that commit violent crimes from the adult system or should they protect the many non violent juveniles in juvenile cernters from the violent juvenile offenders?

I believe we have a problem in schools with lack of education that children can and will be tried as an adult for doing things that harm themselves and others. The true problem is there schools and many parents do not teach or instill in them about their accountability when they decide to join gangs to protect themselves even when the schools they attend cover up all the bullying that occurs because they don't want there school problem to look truly as bad as they are. Kids in every age and every grade should be shown what happens when you break rules and laws and speak disrespectfully to others, adults, authority figures, Etc. Etc. The children that lack education about consequence and responsibility and accountability are victims that make more victims in their path. Accountability is ours as adults to teach them lovingly what their personal accountability to society is. Because lets face it, we are all mortal and we all die leaving these children behind to make up the future society.

Others are as bad or worse, but the U.S. has far more juveniles in custody than any other country. Race is a big factor in the U.S. as well as other countries. Look on KZfaq for Norwegian prisons, they are the most progressive and effective for juvenile offenders.

I think when a kid kills they should be put in juvy till their 18. They should get a neurological work up to figure out what's going on with the prefrontal cortex and ongoing therapy and rehab. And then they should be retried at age 18. There's no way they should be tried as adults. There's so much we can learn from this.

I agreed with you up until the retried at 18. That's against their constitutional rights. I think instead of a retrial, they should be evaluated by a number of different specialists, what they did during their time inside should be taken into account. Such as, taking classes, counseling, religion, etc. & That they should be required to go thru counseling for at least 5 years after release, and that they should be evaluated on a regular basis. I don't believe a retrial should happen.

Is Michelle Deitch prepared to accept responsibility if he is released early and kills again? In that case, is she prepared to answer to the friends and family of his victim? Who is more important here, the criminal or the victim? I think some priorities need setting straight here. Two people have died already. Justice is supposed to serve the public good.

It is ILLEGAL and WRONG to charge children as adults. Do we charge adults as children? No we don't. Children are still children, they don't magically become adults just because they commit a crime.

I don't believe anyone with a sane mind is "defending" such cases. Simply ask yourself, why does the justice system try under age kids as Adults when they commit a crime and on the other hand society does not offer under age kids same advantages and benefits by social standards as adults? I believe it is because kids do no contribute to the economy, they are in fact are burdensome to the economy. But hey we cannot have society without kids can we? How do we create the next generation without them? Rather, the west does not want to spend money and time to mitigate this problem because for us it is simpler to cast kids with criminal offense with bunch of adults in the prison system where it is also mostly privatized. Also, why should the public try anyone based solely on what MLK JR said? As what he said is morally right but how do you define an under age kids content of character? By his parents who raised him, by the grandparents he killed, which perhaps taught him morals and values or do we judge the content of his character based on his undeveloped brain that cannot make certain life decisions and has no clue what the world is really like? It is a double standard and a double edge sword. By the way, MLK Jr is just an ordinary man.

Well good for you. Some kids grow up in some bad households and or neighborhoods and don't get the proper care and discipline that kid needs. Just wait, kids are sneaky, they may be doing illegal stuff right now and they aren't even aware that that is what they are doing. But kids are kids too, give them some damn slack.

Sometimes people don't realize that the reason why children are committing serious crime is due to parenthood. She mentions what can we do to change? I believe crime starts at home. Parents should be engage in a child's life no matter how crazy their work schedule gets. That child did not chose to brought into life, it was the parents and its their responsibility... Don't get me wrong, there are outstanding parents who provide their children with all their needs. Love, discipline, personal needs, etc.. Even if that child is in a good home, sometimes humans make mistakes, yes we all know that we're not perfect. BUTTTT A life should not be taken as a slap on the wrist because of selfish acts. I believe they should own up to their mistake. I also believe in second chances, now three is off to many. reasonable punishment should be hold against a crime regardless their age. At age 16 I already had a job while going to school to help my single mother provide for my siblings. At age 16 my childhood was taken away because I had to grow up and start paying bills. The one most common problem among these speakers is that they are monotone throughout their speech. I like to witness a a true speech; this speakers try to hard to act smart when they are not.

I disagree with her point of view on this matter. However, her support and reasons were very weak that even I, who is opposed to letting kids off the hook for committing adult crimes, can think of better reasons to support her claim than she can.
