As a Dual Citizen and retiring in the Philippines and a Balikbayan, you can bring your household goods tax free but not your car. All you have to do is process your household goods inventory (with your Philippine Passport or Oath of Allegiance and Reacquired Filipino Citizenship paperwork from the Philippine Consulate) through the Department of Foreign Affairs for approval and off you go. A friend retired in the Philippines with 18,000 pounds of household goods and did not pay a single centavo. Also, your income coming from the U.S. is tax free. The only taxable income you will pay in the Philippines is any income you made if you work or have any business there.

If you are holding a dual citizenship from the U.S.A, you still need to file taxes for Federal & the state of your last residence. Check w/ your U.S. accountant or check w/ the U.S. Embassy or Consulate (in the Philippines). Social Security pensions are taxed after $32,000.00 & any other sources of income coming from the U.S. as in dividends or other forms of pensions (as retired w/ a "defined benefit plan" as in the educational system). Overall, you won't be paying taxes to the Philippines for income coming from the United States.

Former Filipinos can own land.Former Filipino citizens who have taken foreign citizenship can still own land in the Philippines even before reacquiring Filipino citizenship. Section 8 provides:SECTION 8. Notwithstanding the provisions of Section 7 of this Article, a natural-born citizen of the Philippines who has lost his Philippine citizenship may be a transferee of private lands, subject to limitations provided by law.The limitations provided by law are fairly generous:If the land is for residential use in urban areas, formerly natural born citizens can still own up to 1,000 square meters of land. This goes up to one hectare if the land is rural (Batas Pambansa Blg. 185).If the land is for commercial use, formerly natural born citizens can own up to 5,000 square meters of urban land. This goes up to 3 hectares if the land is rural (Republic Act No. 8179).

Philippine embassy abroad told me it would be wise to get my dual citizenship because I have 2 1/2 hectares farm handed to me by my parents while I was leaving abroad . If you owned land in the Philippines, you may need to double check with the Department of Agrarian reform or proper agency in the Philippines if you still retained ownership of the land.

M & C mc You do not need to be a dual citizen to inherit some from your parents. Even if you are a US citizen you can inherit and own that land without any issue as long as you were a former natural born Filipino citizen.

@@pennylane385 I'm not aware of any age restriction to buy medical insurance. However, it will depend on the type of insurance you are buying, and if that would cover you where you are located.

Benefit of dual you can stay in Philippines as long as you want with out paying anything returning to u.s Your in Philippines you're pilipino your in America you're American...it's not gonna hurt pension...I got dual citizenship. ..

It's good to know what you have said. Well I'm already retired & I will not complicate myself to get dual citizen from Canadian & PHILIPPINES. Spending to get dual citizen I rather give it to charity in the Phil. It's hard for me to travel @ all . I love Phil but in my own way I will just give some donation ( bahay kalinga, & etc ) @ least I can give some to what I'm receiving fr. my pension here in Canada. Canada have a lots of benefits free for health insurance especially for senior citizens , discounted in bus fare , movies , restaurants & etc. Hoping most Filipinos abroad will give some to those in need in the Phil. Some Pilipinos goes back home but in the end they come back here for so many reasons.

you can still own a land but with restrictions: (Former natural-born Filipino citizen) Land Aquired before the 1935 constitution Acquisition through hereditary succession if the foreigner is a legal or natural heir Foreigners who acquired Philippine property when they used to be Filipino citizens, will maintain ownership of those properties even after their change of citizenship. Former natural-born Filipino citizen subject to the limitations prescribed by Law (Batas Pambansa 185 and R.A. 8179) 1 - For residential purpose - 1,000 square meters of urban land or one (1) hectare of rural land (BP 185) 2 - Cannot own both urban and rural land. Choose one type only. 3 - Previous ownership (when still a Filipino citizen) of residential urban or rural land will lower the 1,000 sq meter and 1 hectare limits above. 4 - Can own a maximum of two (2) lots only. 5 - Those lots must be in different cities or municipalities in the Philippines. 6 - A transferee of residential land acquired under Batas Pambansa Blg. 185 may still avail of the privileges granted under R.A. 7042 as amended by R.A. 8179.

@virtuoso clan A U.S. citizen is allowed to buy a condo since you are not buying land. You are basically buying stock in the Condominium. It is the condominium that owns the land. As far as I know, there is no limitation on the number that you can buy.

Thank for the explanation po. I have seen the english version of this and I fully understood it. Most of our kababayans just look at the advertised exchange rates without considering the fees involved but they just settle to that amount because of the convenience of the remittance center being in the vicinity of the stores where they shop.

The small property was acquired prior to my coming here and becoming a citizen and which was later titled it in the name of my daughter who later became a citizen, too. She doesn't want to relinquish it as it is a product of my long years of working before we came over to the US.

I would encourage you to consult with an immigration attorney. It is likely that you can still own that since you owned it prior to losing your citizenship. Or, maybe you are still considered a dual citizen. It used to be that when you become a U.S. citizen, you give up your rights to be a Philippine citizen, but that may have changed. Not sure. Let me know.

My wife and minor 7 yr old daughter just became dual citizens yesterday in Chicago. One of my adult kids just regained it by me filing their report of birth. 2 more adult kids are in process. Now my entire family are dual citizens...except me. I can't, but I still benefit some from them. Nice video.

Sir, Your KZfaq video is presented for the benefit of natural born Filipinos who have emigrated to a different country (such as the United States) and acquired citizenship in that new country by naturalization. At one time, under Philippine law, these Filipinos automatically lost their Philippine citizenship when they acquired foreign citizenship. Under current Philippine law, natural born Filipinos may regain their Philippine citizenship by proceeding to the nearest Philippine consulate or embassy in your host country and filling out an application form. You will be asked to pay a small fee and then return to the consulate when the application is approved, to swear an oath of allegiance to the Philippines and receive a Philippine passport. The Philippine consulate in your host country can provide the details to you about doing this. As a dual citizen, you will have all of the same rights in the Philippines as any Philippine citizen. The Philippine government is clearly encouraging balikbayans to return to the land of their birth and spend their savings there. But your video does not explain that the situation is very different for foreigners. Foreigners who are married to Philippine citizens can enter the Philippines on a tourist visa or balikbayan visa and then apply to the Bureau of Immigration to have their visa changed to a resident visa. Once they have a resident visa, they can remain in the Philippines as long as they want, and as long as their Philippine spouse wants them to remain in the Philippines. However, foreigners cannot purchase land in the Philippines under their own name. Their Philippine spouse can purchase land with their joint savings and allow their foreigner spouse to reside with them on the land. After five years of continuous residence in the Philippines, foreigners living in the Philippines can apply to be naturalized as a Philippine citizen. However, Philippine law does not allow natural born foreigners, who want to be naturalized Philippine citizens, to retain their previous citizenship. Foreigners are required to surrender their previous citienship in the embassy of the country whose citizenship they are renouncing. Foreigners who are willing to do this should consult their embassy in the Philippines to understand the required procedures and consequences of this act. It is not a trivial thing to do. For example, if you are receiving a government pension as a retired U.S. citizen, such as Social Security or a military pension, you will lose it when you renounce your U.S. citizenship. You will also have to pay a hefty fee, based on an estimate of your net worth, to the Internal Revenue Service of the U.S. when you renounce your U.S. citizenship. Also, if you ever desire to return to the U.S. for a visit, you will be required to wait in a long line at the U.S. Embassy in Manila and apply for a tourist visa. You may even be required to convince the U.S. Embassy officials that you will not go TNT when you reach the promised land! So look very carefully before you leap. I am speaking from personal experience. I married my Filipina wife 34 years ago. After we lived and worked in the U.S. for 24 years, we decided to retire and spend the rest of our lives together in the Philippines. My wife has dual citizenship status, and purchased a residential lot in Davao del Norte province. I have a permananent resident visa, and every January I return to the Bureau of Immigration office in Davao City to file an annual report of my current address. I considered naturalization here, but I decided that the price of giving up my pension was too high. We enjoy the charm of living here and the low cost of living, even if I am not allowed to vote in local and national elections. After living here for ten years, we have never regretted our choice.

@@rosemaryyoungso1327 I agree with you. But I have met so many educated Filipinos here in the Philippines who think that the U.S. is still the promised land. Although salaries in the U.S. are higher than in the Philippines, the cost of living in the U.S. is also much higher. Personally, despite occasional brownouts, I think that the quality of life is higher in many places in the Philippines than in the U.S.

I’m sorry that it appears from your explanation that it is very punitive for a Filipino (foreign-born) naturalized Permanent resident to buy and own land in the Philippines, this is why the USA is such a unique model contrasted to many other countries. It’s (USA) economic opportunity is also an important reason why many leave their motherland, present company included, so a chance to recapture Filipino citizenship is becoming more and more attractive for so many baby boomers making the turn into their golden years, if not just to buy more “life” with their pensions or savings from decades of sacrifice in foreign lands as it is becoming more and more difficult to make those funds work with the cost of housing, healthcare, etc. in the west. God bless you and you’re new home, perhaps one day things will change. We can only hope for the better.

Not all countries allow duel citizenship, so it's advisable to check with the authorities in your country of origin first.

Balik bayan (former Pinoy citizen) can own up to1 hectrare of rural farm land as far as i know.... automatically given 1 year stay upon entry.

You can through the naturalization process. But you may not want to go through the process. It may be better to get a permanent resident visa such as an SRRV senior retirement visa, or a 13A visa (if you are married to a Filipino citizen).

One question and one comment: Question - How long is the process to obtain Philippine citizenship for a foreigner. I was under the understanding that you would have to live in the Philippines continuously for ten years. However this might be different if you are married to a Filipino citizen. Comment: If you are married to a Filipino you can get a one year Balikbayan visa upon entry. You have to provide a marriage license document if you and your spouse have different surnames on your passport. Once your year is nearly expired, you can apply for a visa that allows you to become a permanent resident. It is my understanding that you must check in with the Bureau of Immigration annually in order to maintain good standing with that visa. Salamat po para sa video! Ingat po!

Advantage. You receive credit in the US for S.S. credit in the Philippines upon retirement based upon national reciprocal agreement.

You don't have to be dual citizen to own land if you're natural born citizen. You'll be classified as Balikbayan and can own limited size of land as explained by Vien Bantog down below. Your information is somehow lacking.

Iam a US Citizen who was born in California from Parents that served in WWII. I'am currently married to a Filipina from Dumaguete City, Natual born of both her parents being Philippino's. My wife and I were discussing on that I should be a Dual Citizen of both Countries. At one point I had the 13a visa for 2 years but not no longer. I also at one point had the 30 day tourist visa for the Philippines. I plan to retire in the Philippines once I get to that age with my Social Security. Now with all that being said in your opion would my plan work without any major problems for me ??

Dual citizenship is granted only to Filipinos who were previously Filipino citizen. Consider applying for SRRV visa.

I am a US citizen and my wife is a Filipino with dual citizenship. When we travel to the Philippines, I enter on a Balikbayan Privilege. My question is, Must I have an onward ticket from the Philippines or can I go to the Philippines with no return ticket and come back to the US when we please within the one year of the Balikbayan Privilege. I enjoyed your video on dual citizenship very much!

The problem would with the airline ground staff at the port of exit. The airline is heavily penalized for an incorrectly-boarded passenger and they also bear the costs of returning that passenger. Ground staff of PHL-based airlines, like PAL, understand the nuances of the special PHL immigration programs, like Balikbayan, and might let you on board without an onward ticket. It is more problematic with other international airlines. As a workaround, some US passport holders would purchase a cheap onward ticket that is dated within 30 days of arrival in PHL. You can find some cheap onward tickets to Malaysia or Hongkong online, sometimes for less than $50. It is less expensive to forfeit a cheap onward ticket than to forfeit a round-trip return ticket.

@TerryJones If you do a little math and analysis, round trip airline tickets cost less than buying a 1 way ticket (combined) each time (when allowed). Most round trip tickets have a 1 year validity... re-booking fees should be affordable for the work around that you have in mind.

If you're married, I would suggest discussing it with Philippine Embassy or Philippine Consulate. If he is an American, he will not be allowed to be a dual citizen because dual citizenship is only granted to former Filipinos. An American citizen can be granted Philippine citizenship after five years of residence in the Philippines if married to a Filipina. I assume you will need to get an SRRV visa to establish residence. There could be other type of visa you could obtain. This is why I suggest talking to someone at the Philippine Embassy or Philippine Consulate. Hope this helps.

I have a friend.who is now a US. Before he went to the US , he worked in the Phils. For 14 yrs. Can He still collect his SSS benefiits .He is now living in the US. Thank you so much for your kind attension

Sorry, but I'm not familiar with Philippine SSS. However, I believe that he will be if meets the required minimum requirement. I only worked in the Philippines for one year. When I went to inquire about SSS, they told me that I could collect if I pay them a certain lumpsum to make-up for the deficiency in contribution since I only worked for one year. Of course, I did not accept the offer. If he worked for 14 years, I'm almost sure that he will be entitled to something. In the US, you are required to put in 10 years.

Can you please provide more information regarding the effects of reporting Philippine assets on IRS form 8938, as required by FATCA? Are dual citizens required to pay U.S. income tax on all income earned in the Philippines?

Any income earned in the Philippines is taxabe in the US but you get credit (not a deduction) for taxes paid to the Philippines. However, any income earned in the U.S. is not taxable in the Philippines. So there is no double taxation here. Now what is the effect of filing 8938? As long as you're paying taxes in the US, it has no effect. It's just a reporting mechanism with no taxes being imposed. Now if you have millions of assets and earning tons of income in the Philippines, and not declaring them in the US, then that's the only time you will be in trouble. Otherwise everything will be fine. It's just an information return to catch people who are hiding their assets to avoid paying taxes.

Applying for Philippine Dual citizenship is a fairly long and complicated process (maybe even expensive) for former Filipino citizens. It is probably even worse for foreigners living in or outside the country. Before I decided to return home to retire, I did not know whether to be a dual citizen or not. then the Philippine consulate in L.A. California mentioned an option - 18G visa aka Balikbayan visa. It's for former Filipino citizens who are now, in my case, naturalized American Citizen(s). It is a "Permanent Resident" type visa that lets you stay in the country indefinitely. You don't have to exit and reenter the country just to reapply for a visa. The 18g visa cost $150 each for me, the wife and a daughter. It to around 3 months, maybe less, to get. We have now been here since 2001 and all we have to do is report every January to the Bureau of Immigration, Manila or their nearest branch and pay Php 310 pesos per person. You get an Alien Registration Card that you renew every four years. The advantage to this 18g visa is it's a permanent resident visa just like the US green card. You get all the Philippine "perks" and you get to keep all the US "perks" that this video list as "disadvantages" to dual citizenship.

Well, let me tell you. I went to the Philippine Consulate office in New York City early in the morning (almost before it opened). I filled out an application for dual citizenship. I was interviewed by mid-morning, and paid my dues (I believe it was only $50). We were asked to return in the afternoon for oath taking. We left and walked around NYC, had lunch, and enjoyed the rest of the day. I came back at 4 p.m. Had our oath taking, and we were handed our dual citizenship papers. Thereafter, I applied for a Philippine Passport. It only took less than a day to get my dual citizenship. The passport is a different story because the application filed here gets sent to Manila for processing and issuance of passport. That took 3 months. But with dual citizenship papers, I was able to go in as Filipino citizen without Philippine Passport. Maybe before it took a while, but not anymore. You're right though that you must be aware of the disadvantages of being a dual citizen. 🙂

I think you mean 13G, not 18G visa. RA 9225 was passed in 2003, so dual citizenship was not yet available to you in 2001. It was a one-day process for us at the LA Consulate and only cost USD 60 in 2016. We do not have to report to BI every January and pay PHP 310. We can buy and own land, etc., etc.

I do not have much to share about this. I did not have much experience on this, because I dropped the idea as soon as I found out that my personal belongings will be tax after being allowed a very small exemption (something like $200). I also found out that I cannot move my vehicle if it is older than 5 years. if your car is younger than 5 years, it also gets taxed heavily. It did not make sense for me to do this at all. It's better to buy everything in the Philippines, and only move certain assets using balikbayan boxes, which is tax-free.

Thank you for the video lessons. It is very helpful. The pension was mentioned in the video, but for clarification, a Filipina and naturalized US Citizen, worked in the US for many years and now retired and collecting SS pension. If she retires in the Phils, is her SSA pension taxable in the Phils? She will continue to file US income tax and report her SS pension in US Income Tax. For the sake of argument, the pension will be received while she is in the Phils. Is this taxable income in the PHils? Thank you.

If you are a dual citizen, it is not taxable. Philippines will only tax income sourced from the Philippines.

A lot of potential retirees are very concern about shipping their household belongings to the Philippines. The practice was very common during the time when imported goods in the Philippines were scarce and too expensive. *Scarcity of imported consumables & appliances (no longer true). I was 14 years old when we move to the United States i never seen my pilipino passport or birth certificate now that im adult i like to visit the Philippines again i was there 2019 for family reunion and all I have is American passport my question is what else do I need to go back to the Philippines so many laws changes like you said is confusing just like you pilipino government can't make up there mind they need to see a psychiatrist

That is interesting you said non residents, can stay 90 days, and 1 year if married to a Filipino. Maybe you can message me back or post where it says that. I was traveling with my wife back to the Philippines, and our stay was 32 days and I got fined for the two days. Being married to a Filipino and having our marriage documented in the Philippines and Canada. Also at the time she did not have her Canadian citizenship yet, along with she is a natural born Filipino? Would be interesting to know more about that.

You have to pay taxes to the Philippines. You also have to pay taxes to the U.S., but you credit the taxes you paid to the Philippines.

Srrv visa ID. Card can get senior discount starting last year...Also we pay good money to get SRRV instead of 13 A ..So my wife being a filipina should be able to buy land same as a dual citizen ...otherwise why have SRRV.

Yes you do, but The U.S. and Philippines have a tax agreement where you can deduct the tax you paid to PH from your U.S. tax. This was done so you don't get taxed twice. I would definitely look more into this just in case I missed or misunderstood something. I think I found this info in the Philippines Consulate site under taxes.

John Thanos comments saying that by converting to dual citizen, you lose your pension that you are receiving from U.S. Is this true? Because, there are so many Filipino American that are in the military like myself that are receiving disability and military retirement that if you go home to P.I. and converts to dual and lose all your entitlements. Maybe, I am reading it all wrong.

No, that's not true. You only use your Welfare check, if you're getting one, but not your Social Security benefit checks. I also know that your private pensions will be left intact. I don't know much about military pension. I don't think you would lose that either.

60 Years old to be considered senior in the Philippines. For military draft, I don't know for sure but it is likely to be under 60. 🙂

Sir You need to speak on shipping house items and your stuff to thePhil. I used LBC cost a lot, no extra cost on arrival. Although some items were stolen, I had no insurance.

Being a dual citizen does not entitle you outright to senior discount. You must also be a six months resident of the Philippines.

The rules regarding the senior discounts are loosely observed by the restaurants. They know that they will get the discounts back, anyway, when they file their business taxes. There are incidents where customers were not even dual citizens and still got their senior discount by showing their California driver’s license.
