Q. Why didn't you talk about good cop bad cop?
A. It seems that while good cop bad cop may be used, it isn't officially endorsed in an interrogation, and isn't part of official training. The presence of it in hollywood movies is way overblown, because it plays into their "high-adrenaline, highly visual" style.
Q. Is this the only interrogation technique there is?
A. No, the Reid technique is the main interrogation technique in America but it has recently come under fire for producing false confessions. See this great New Yorker article: [www.newyorker....]. Because of this, much softer interrogation methods have been looked at that don't try to pressure the suspect. The most popular of these techniques is called the PEACE technique. Q. I'm still interested, is there somewhere else I can go to find more information?
A. Besides the links I've placed which breadcrumb my research process, there is also a great NPR piece called Good Cop/Bad Cop, I think it's similar to this video, focused on the weird dichotomy between real interrogations and how they actually are carried out. [www.npr.org/te...]
Q. Does "lie detection" work?
A. Not really. This is the reason a lot of people have given up the Reid technique. A huge part of it hinges on the idea that a cop can "tell" when you're lying, which is the justification for applying so much pressure during the accusation portion. In recent years this claim has fallen under a lot of scrutiny. Body language isn't as reliable of a signal of lying as we thought. This is one of many criticisms of the Reid technique.
Q. Should I ever talk to the police?
A. Only during a traffic stop, where the cops can let you off with a warning if you cooperate and they're feeling generous. In every other circumstance, talking to the cops can ONLY hurt you. Don't talk to the police!!!

Before they get you in that room you may not know you are a suspect so you aren't thinking about a lawyer. A very important question which I believe thy have to answer honestly is Am I a suspect?" Before giving any testimony about anything always ask this question first. Many people went down because they didn't and the slow witted and poor ones who go down this way often didn't do the crime.

Imagine how exhausting and intimidating this must be to people who are actually not guilty. I could see myself going crazy in a room like that for hours with a guy that tries every psychological trick in the book to get me to confess no matter if I'm guilty or not.

Exactly. If you've committed a crime your mental walls will be up, you'll be full on the defensive from the start and have stories and alibis for days. The innocent will be more open to being friendly and negotiation, thinking this is all a big mistake and the law is on your side. Nope you are the fall guy and the cops easy conviction for a fast closed case. Not only that but anyone with social anxiety or a guilty conscience will admit to things they never did just to escape the pressurised situation. Thousands of people are convicted of crimes they never committed every day so police and detectives have an easier job, don't be one of them, always demand a lawyer before and during questioning.

I wouldnt. I just dont show up to interrogations. You know that shit is 80% just a request? And you can decline requests. And the other 20% you just shut up and ask for a lawyer. Dont talk. Let them think what they want. If youre innocent you cant get yourself in trouble, if youre guilty you could get caught.

Not nessesarilly. Sometimes even if you're guilt is beyond reasonable doubt, they'll interrogate you to decrease your defense options, like proving you are not criminally insane or show premeditation

After a few hours of intense interrogation, I'd go quiet, go into the surrender position and then say "look I'll tell you the truth". "I didn't do it". That piss off the cop so much.

One of my friends was involved in a corner shop robbery. He wasn’t a part of it but for one reason or another the cops thought he was and kept trying to get him to confess. When they started smooth talking at the start he basically got them to give him a full on meal hahah and then proceeded to deny everything with full conviction. He got out that night with a full belly

This interrogation technique put an innoncent Danish kindergarden teacher in jail for quite a while in New York. He admitted to some made-up accusations by his mentally ill colleague because the cops claimed they had evidence and the entire situation stressed him out, so he admitted the made-up crime. He wasn't aware the cops could lie, as they aren't allowed to do that in Denmark.

@giveagoodsong it's for that and also because the more people who are crammed in lockup, the more money that state gets from the federal government. That money is intended to go into making the prisons better and covering cost of living but instead, corners are cut and most of the money is pocketed.

I would be more overt than that. Someone said during an interrogation "I need a lawyer, dog." And because they only said it once, and the cops "didn't know" what a lawyer dog was he was convicted on evidence during the interrogation.

No, you have to say something, there was some dumb SCOTUS decision that ruled that your fifth amendment right to remain silent only applies if you actually mention it. AKA while theyre interrogating you asking questions say something like "i dont answer questions" or "i enact my right to remain silent" or whatever else to have it work. Of course before that just ask for your lawyer and the interrogation will be done with.

If they had enough to convict you they wouldn't be asking you questions...they would be booking you. You can be arrested and later released without charges being filed... King's X, like it never happened, you're free to go... but if you answer questions poorly, that "release" part evaporates quickly. And once you are booked you are fucked.... so don't... fucking... talk... to cops.

Well actually even if they do have evidence they will still question you. Nothing in court is certain so they want to hedge their bets. The key is the more lies they catch you in, the more they can dismiss anything you say in court. Which is why it is important to be silent.

Actually for most crimes there is no interrogation at all. You're immediately indicted, likely jailed, and it's left entirely up to the judge/jury during a trial to decide, unless you are coerced into signing a plea before then. I think it's only for major crimes like murder, rape, trafficking etc that they do the interrogation phase at all. Otherwise it's pretty much guilty until proven innocent.

Look, I know you were there. There are many people who saw you get taken in, and they've told us about it. Heck, we even have it on tape. It's okay, you can tell me. Police are also allowed a long string of bullshit they can spout. They're very careful to get you to do something that they can hang you for. As a lawyer friend told me all you need is 2 questions -- "Am I under arrest?" and "Am I free to go?"

they'd say that the 'Evidence' is pointing toward You, basically they are playing games, they'd say; from their interpretation, the court will agree with them and say "it's You". After that they want you to "tell your own version" and used it as actual Evidence. It is a coin-flip, there's 50-50 chance they are telling the truth, and you have to make a quick decision without complete information.... it could end up with you paying a costly legal battle, or a quick escape where the investigator dismisses the case for free...

Until the lawyers posts your bond you are automatically guilty regardless. If they can't get a confession out of you (truthfully or lie) they have the jail environment to use against you over the course of several days. They can instruct the jailers in secret to put you in a cell with to tougher violent criminal and have them work you over. This is why getting bailed out is so important to a suspect who has never been in trouble with the law before. The majority of the interrogations happen in the jail environment and they will cause you do strange things. A lot of innocent people have been set up to be convicted this way.

They’ll never let you get a sentence that long out, especially if they’re in the “Accusation stage”. “No comment, speak to my lawyer, am I under arrest”, they’re your best options. In Australia, where I’m from, you can request an end to the interview and they have to oblige.

Always get a lawyer. Even if you are worried about “looking guilty”. Always. Get. A. Lawyer. Even if you think you can “clear this up” on your own. If you are ever in a room with a cop that you are not aloud to leave then you need a lawyer. You are not an expert in the law, neither is the cop. The cop has a job to do. A lawyer’s job is to know the law. It is never a bad idea to get an expert on any topic, and this is doubly true when your freedom is on the line.

Cops lie all the time. The are trained to be deceiving. I even think at some point in their life, it becomes part of their character outside of the job. Pretty nasty

Lying is absolutely a core part of police culture. Deception is the greatest tool in the police toolbox. Controlling information and misinformation is critical. However, it's corrosive and they seem to lose touch with when it is okay to lie. Here in Ontario, police face no legal consequences when they are caught lying under oath. The judge only has power to refer the matter to the cop's superiors. Any consequences they face are purely administrative, and often there are no consequences at all.

Nope don't talk, no comment/plead the fifth or demand a lawyer. They will then try to befriend you by reciprocating that - "yeah this room is boring, i hate doing this, it's great outside, don't want to waste your time, we should wrap this up quick and go home" ect. Saying anything leaves you open for negotiation and a weakness to be talked about to make you open up.

Ryan F i was once interrogated for witness tampering and assault (which was false and later found out) i did find myself thinking sometimes that i would be sent down regardless of me being innocent. so i stopped speaking and they had no choice but to let me go as i was just ‘wasting police time’

If I ever were to find myself in an interrogation room, I would just talk about some non relevant stuff, like computer games, hobbies or whatever. And then make fun of them. If they still keep pestering me, I'd just do the "surrender" position and then say "it was just a prank, bro, there's a camera". :D

The weird thing is that you actually have to "invoke" the fifth amendment right to remain silent. As in you can't actually remain silent, and silence can be used against you. If they are asking you anything you have to say something to the lines of "I invoke my right to remain silent" or "I don't answer questions" etc etc each time. That's what the supreme court ruled in 2013.

Innocent people don’t confess. This is designed to use guilt and fear against a suspect that actually has those feelings. If you’re innocent I guarantee you getting investigated by a cop would be far less intimidating.

This doesn't happen simply through interrogations, but they can. Most of them happen because pleading guilty is going to give you a shorter sentence than pleading innocent. This become pertinent when someone is framed or if there is an evidence mistake (wrong place at wrong time scenario).

Nicholas Rickhoff I watched a documentary the other day and they said a percentage didn't get a trial yet. I could be remembering that wrong, I hope I'm not. I do know for a fact that many people still get convicted without confessing though. I once sat in an interrogation silently for 4 hours for something I didnt do. The cop got me to eventually talk by accusing me of stealing her pen. When I said "I didnt steal your pen" she came back with "Oh so when I accuse you of something you didnt actually do, you talk". The judge found me guilty based on that... I appealed and they threw out my case. This took me 6 years to fight, all for just saying I didnt take her pen...

I also had a very shitty lawyer - my logic was that if I was innocent, I wouldn't need to spend too much money to prove that. But this one piece of "evidence" was enough to sway 1 shitty judge. There may have been some politics in play behind the scenes as well. Perhaps my lawyer was told not to give a counter argument to the "pen statement" and before I knew it I was in cuffs. Spent 1 week in jail, I fired my lawyer and paid a much much better one, was released on appeal and won 2 years later. Unreal.. dont take chances when it comes to proving your innocence.

It’s not about “need” per se, it’s about understanding and knowing as much as possible to build a solid case. Even if they have all the evidence they need, a confession just adds an that extra “cherry on top” since now they have it on record that you yourself acknowledged that you committed the crime. For a prosecutor, that helps alot in building a bulletproof case.

German law enforcement officer here, in good ol Germany it is illegal to claim that we have hard evidence when we dont. We are for example not allowed to say "we have your DNA on the victim" when we dont. Its against our rules for "fair trial".

No such thing as a fair trial in the states, our justice system has deteriorated beyond repair. Cops here (for the most part, there are good ones out there just not many) only care about convictions, not how they get them. It's like our cops are turning into the fucking Gestapo...

I was interrogated about my roommate. He asked 3 of us separately if the others had anything to do with his crimes, but being super nice to us knowing that"i" didn't do it. Luckily we all ratted out the same guy as he was a jerk.. now I understand why he seemed so damn nice

General Rommel Even after the refugee incidents, rape rates are far lower (per capita) than in the Usa. Meaning if the us and germany had the same amount of people rape would be far lower. It's also lower overall so even if they didn't have the same amount of people, it's still far lower.

For any brits: 1) If you ever recieve a letter (ASKING) you to come to a police station for an interview, you do not have to go. 2) If a police officer knocks on your door, do not open the door. They're not allowed to break into your house, but if you invite them in they can pretty much do whatever. 3) If a police officer turns up at your house and askes you to come to the station for an interview you do not have to go. (if you did have to go, they wouldn't be asking)

I am not a PC nor am I employed by the Police in any way, yet I've been involved in hundreds of UK Police interviews and while you are right about all of the above I recommend to always go for an interview if you are asked to. You will be asked/invited for a voluntary interview only if the Police thinks that it is not in anyone's interest to arrest you for it and get you into custody for the interview to take place. Yet, the moment you refuse to attend or give them another date that suits you better they will reevaluate the situation and most likely decide to arrest you so that the interview can happen. And about not letting them inside the house, yes, there's no reason to allow them in to snoop around your private business.

1:17 Small correction. Police are not required to read you your Miranda Rights. However, if they have not read you your rights, anything you say cannot be permissible as evidence. It's a small distinction, but an important one.

Treblaine That is definitely an important distinction and one they do actually exploit. They'll call in a suspect to discuss the case without detaining them, even telling them they're free to leave. If they actually do decide to leave though, then cops are instructed to arrest you on your way out and bring you in for a formal questioning, Miranda and all.

Cop shows and law shows have always given the idea that the person that says “I want to talk to my lawyer” are guilty. Seriously, watch any show that has the interaction room scene with the “bad guy/gal” and it happens like clock work. Usually right before or after they’ve incriminated themselves. Best thing to do if ever arrested, keep your mouth shut until you have your lawyer present.

Probably a good idea to remain silent even after your lawyer shows up. To most public defenders you’re just a number and in some cases will work with the police/DA to help get you convicted.

For those of you who are curious this is 100% accurate. Only sometimes they use two people. One to question you and in the end he tries to give you an out by saying something like "I know you didn't do it on purpose" or "you didn't go there with that intent." Then the big guy leans in a little bit closer to make you feel pressured. Good video. Accurate.

The vid depicts people who went in not planning to confess, but it's the same process even when you go in planning to come clean. I think most of the process is to lower the tension, I remember leaving the interrogation room feeling comfortable in a police station, compared to when I arrived where I was very much so scared. It's good to know even when I was a kid they really did treat me respectfully like an adult.
