Social Security disability claimants over age 50 generally have better odds than younger claimants for winning disability benefits. This is not to say that you cannot win if you are less 50 years old with compelling medical records in your file, but our experience has been that Social Security judges tend to give older claimants more of the benefit of the doubt.
As discussed in this video, claimants who are 50+ can use the grid rules to ask for an approval, whereas this theory of disability is not available to younger individuals. Older claimants also often have longer work histories and a long and consistent employment record is a positive factor in any disability claim.

I was recently diagnosed with small blood vessel disease in the brain, as well as arthritis and a bulging disc, and a spine disease. Everything hit me so hard when I turned 50. I applied for SSI and hoping I get approved. I spent 20 years on my feet and consistently bending and lifting and my body has paid the price.

i turned 49 sept 29 2019, it is now oct 30 2019, i have broke 3 vertebrae broken compression fractures documented with x rays and many l and i claims for my back during my working career before i hired my lawyer i was denied twice, my lawyer denied the video hearing and says i should get the new hearing in 10 to 12 months if i get my hearing a couple months before i turn 50 will they consider me "over 50" or apply the as you put it biased towards me i know you don't know the whole case its the age im wondering about

What if your rfc is lift 20 lbs occasionally, but your limited to 2 hours a day standing? This doesn’t line up with light or sedentary ?

I am 50 with bipolar disorder , ptsd , anxiety and a right knee that will soon need a replacement . I don't have any transferrable skills and no high school diploma l should qualify under grid rule 201: G am I correct Mr Ginsburg ?

I am 56 with herniated disc, arthritis, COPD, depression, anxiety but don't think grid rule applies because of education. Can you elaborate

Did you look at 202.04. The education part asks if your education provides for direct entry into skilled work. And even if the grids don't apply exactly you can argue that the grid framework applies.

You just need doctor objective documents and a lawyer. I have Degenerated disc disease (X-ray) plus other nerve pains and anxiety and depression. I was software engineer with BS in CS with long work. I last work at age 49. Exhausted short term disability. Denied LTD. I applied SSDI at 51, denied few times and won at age 56. I paid a lot in taxes for many years and may as well get them back as earlier as possible.

I’m soon to be 55 very soon, I’ve also been trying to get my disability as well since 2012, I have multiple health issues, along with autoimmune disease’s as well, I have been denied 8+ times, I first applied for disability soon after I turned 46 & had 6+ heart attacks in 2 hours, 3 months later I had a mini stroke then syncope I pass out from due to my heart, along with many other health issues, fibromyalgia, also got RA through my body, right at 4th stage endometriosis, 2nd stage glaucoma, bulging disc in lower back, sacroiliac joint issues, sciatic nerve damage, my syncope has caused me to pass out more times than I can ever remember & I know in 1 year alone I’ve gotten 5 concussions due to falling & hitting my head hard, I have memory loss due to it as well & I can’t concentrate for long periods at a time, can’t stand or sit for long periods at a time either, but I keep getting denied for what I rightfully paid into when I was able to work….

I'm 55 and I worked at a nursing home for 8 yrs. I haven't worked in 2 and half yrs. I have been a Cna for about 20 yrs of my life. I have Lumbar Spondylosis and arthropathy on my back. Dengenative disc dieasese osteroarthritis on hands IBS and Raynaurd syndrome also on hands Also other things but to many to mention. I have a hearing on October 25 at 9:30. Do you think I have a great chance to win? I started my disability on April 27 2016 Can you help me wth this question sir! Thank you for your video's they have helped me alot!

I'm 58 with Lupus and Rheumatoid and meniers. I was on SSI 30 yrs ago. Now I just cant function due to all the pain. I've had 2 back surgeries. How hard is it going to be to win my disability case?

Gina, the key to winning is not based on your diagnosis, but how your medical conditions impact your capacity for work and whether your medical records document those limitations.

HOW DO I GO ABOUT APPEARING BEFORE A JUDGE TO PLEAD MY CASE? SINCE I HAVE BEEN DENIED 3 TIMES THE LAW FIRM THAT I WAS WITH DUMPED ME AND TOLD ME GOOD NEWS YOU CAN NOW PLEAD YOUR CASE YOURSELF BUT DID NOT TELL ME ANYTHING ABOUT HOW TO DO THAT.. HAVE I EXHAUSTED ALL OF MY APPEALS AND DO I JUST START AGAIN WITH A DIFFERENT FIRM THAT DONT GET PAID UNLESS THEY WIN MY CASE..I CANT REMEMBER WHAT FIRM BUT I WAS MOSTLY KEPT IN THE DARK ABOUT IT

These Law Firms don't do anything to assist with people's cases. I just had my phone hearing. The Judge had zero clue about my condition of Lymphedema an COPD. HE had not received any records. He's now sending me to a "don't gaf doctor" for an evaluation. I'm prepared to lose for the THIRD time. I will appeal my own case, upon losing again!!!

I am a RN and was diagnosed over two years ago with occipital neuralgia which causes chronic head/face pain, I have constant nausea, I also have been told a I have fibro, also have documented tmj disorder, I have applie and been denied tree times... my memory and balance are not good anymore..I dont know what the nest step is, I had one of those law firms that doesn't get paid until I win my case well after the third and final time the firm told me I would get a hearing before a judge then promptly dumped me...I will be 52 in march..should I find another law firm? There is no cure for my condition and occipital blocks have not helped

That happened to me also. I'm 56 and applied a little over two years ago. I even had a hearing and still got denied. I think I exhausted all of my appeals and they told me I'd have to go to the courthouse and file a civil suit. I have no idea what that even means. I would've gotten a lawyer except I had to sell my car a year after I applied and have no way to get around to these various places now.

I know and disability law firms say you can only make x amount of money..well how am I supposed to live off of like 1200 dollars when my house payment alone is 900...I could see living off a fixed income when I get approved for disability then I will find low income housing but that's impossible for me to do right now

I'm 54 and 100% VA disabled for PTSD. I have been adjudicated unemployable by the VA. Social Security has denied me TWICE!! I just sent my appeal for a judge to decide. I guess this is the final step. I don't get it!!

@@jeffnations6649 my late father in law was 100% disabled, he was also a veteran, before his son & I met 10 years ago, he had already been trying for at least 4+ years, well after 10 years my later father in law finally was approved for it all as, va disability, but the time he has gotten it all his health went down considerably, his last few years he couldn’t really enjoy life, he had a massive stroke 4 years ago, spent his last 2 years in a hospital bed at home, I guess what I’m saying is I wish they wouldn’t make a veteran wait so dang long to receive what is rightfully theirs, it sickens me how our vets are treated, although I really need & deserve my disability as much as the next that rightfully deserve theirs, I’d give mine up just so a vet could get theirs, they are so so many treated worse than the dirt we walk on….. I also know of a young man that gets ss that does noir period deserve it, he told my husband & I one time he played crazy to keep getting his social security, I went completely off on him (well before I give my life back to God)……. I’m thankful for the vets, they put their lives on the line daily for us, to all vets on here, I personally thank you for your service & all you do, God Bless You 🇺🇸❤️🇺🇸❤️🇺🇸

@@lynnburton7873 thanks I agree with you. It's just very hard here in Alabama and they want proof that you have an injury. How can you provide proof when you was a newbie going into the military and by the time you get out, you don't know if your entitled to anything. That's what happened to me. I was paying dental and medical insurance only to find out that I could have gone to the VA. That was probably a lost of $35,000 over my life time when working. Plus they turned me down many of times for ringing in my ears.

I wished I would have found him before I did the lawyer I had, I’m sure I would have gotten approved soon after I first applied back in 2012, still fighting to this day for what is rightfully mine, now doing it alone & also in federal court as well….

I've been working as a barber for a long time 10 years my back is not the same as I used to be for standing 12 hours a day cutting hair will I be able to get disability benefits I am 50 years old

Dovan you need medical evidence (i.e, an MRI or equivalent) to determine exactly what is going on with your back. If the MRI shows a severe issue consistent with your symptoms then you have a chance at winning.

im 56 and ive been at my job for 30 years. I am ready to retire but after reading some of these posts, i dont think i am eligible. I have a bad knee, shoulder and hand but I'm still working. I just needed something to supplement my pension when i do go.

At 20 you would have a real uphill battle. The definition of disability is the same for SSI and SSDI but at 20 your medical record needs to be extremely strong.

SSI is a welfare program that does not require the payment of taxes or work credits to become eligible. It is often confused with SSDI which requires such. The only commonality is that the SSA administers both programs and the definition of disability is the same.

My husband & I know a young man that started getting social security in his early 20’s, and to be honest nothing is wrong with him except being lazy, he even admitted to us that he will tell them he is crazy & baam he got it & he is now in his mid to late 30’s, he can work, heck he does just to get money for his cigarettes soda etc (no he does not so drugs), it is so wrong how he manipulated Social Security to get it….

I am 58 and had to retire after 35 years working because of C-PTSD. One month and 4 years and I would have reached 40 years and received much more. I have a long history of mental illness and have doctors and therapists documentation. However, I am afraid of being denied. If they deny someone with a visible disability how can someone with a hidden illness win?

Stacci, my experience has been that SSD judges look for evidence that your mental health conditions significantly impact specific functioning that you would have to do at a job - attention/concentration; pace of work; emotional stability. A long work history helps as do extensive treatment records and support from your psychiatrist. But most cases come down to 3 types of evidence: 1. recent inpatient hospitalizations; or 2. recent suicide attempts or 3. multiple failed treatment efforts by your doc - such as multiple efforts to find medication that controls symptoms, none of which work consistently.
