Why Weed Going Legal In NYC Caused A ‘Gray’ Market Boom

In the densely populated Tri-State area of New York, New Jersey and Connecticut, the rollout of legal weed has been called slow and cumbersome, allowing for the proliferation of "gray" market storefronts and businesses to sell marijuana without going through the regulatory process.
As the tri-state metro prioritizes the equitable upbringing of the cannabis industry via social equity applications, councils and funds, several hurdles to entry have limited the number of legal dispensaries able to open and begin business.
Correction: At 03:56, this video mischaracterized the status of New Jersey's home cultivation laws. Bill S353, which legalizes growing or possessing up to six marijuana plants for personal recreational use, is currently pending technical review. Current state law prohibits personal cultivation, and is punishable by 5 years in prison.

@Cheeze Ball how about stop focusing on social justice, woke virtue signaling and create a healthy recreational market ? The recreational market is just trash because of the corrupt politicians. A free market is a healthy market, we have a mixed economy and nothing escapes regulation but NYC politicians take things to a tyrannical level,nothing is well thought out. Everything is convoluted and arbitrary and comes from people who have no knowledge of the market and clearly had no interest in consulting any one who does. Taxing these products based on per mg of THC is the funniest thing I've ever heard and is just one example of how out of touch with reality these people are. If they spent any effort to vet these idea's before implementing that idea would have been shut down in a heartbeat.

No one seems to be learning from anyone else's mistakes. If you try to overregulate weed, the black market will thrive. Alcohol has had over 100 years of trial and error when it comes to regulation (since the end of prohibition). There's virtually no black market for alcohol. Do the same exact thing for weed. Don't try to reinvent the wheel.

The biggest problem is that because pot is still considered illegal on the federal level, these stores can only accept cash and not take cards. Having huge amounts of cash makes these dispensaries more attractive to thieves. We HAVE to decriminalize pot on the federal level. Ridiculous that it’s still that rank.

It's wild to me how when a state legalizes cannabis, the formerly known "drug dealer" is now a highly successful and legalized business that's recognized by the state government as an LLC. That's how it should be, but to think that at various points through out history some of these "drug dealers" were killed during search warrants and/or seizures is somewhat morbid to think about. Just to think that individuals who specialized in botany/agriculture/biology as well as sales/marketing/advertisement/commerce were murdered for growing/harvesting/distributing/selling A PLANT is horrifying. I think that he is referring to the higher potency. I don't think there is a lot of long-term data on what high THC marijuana does to the brain - especially if users start at a young age. The alcohol comparison is a good one - we do have data on that and we have been able to tax and regulate it in a way that limits illegal distribution. With more legal use, I'm curious to see what the numbers will show.

From the very beginning of the push to legalize cannabis in California I have been saying that the street dealers should be the first to get the chance to open up shops , they are the people who already have knowledge of how to sell the product and how to manage the logistics of supply and demand , they have all the experience , same as the underground cannabis farmers they have the knowledge already , they should have been the sages that we looked to for advice on how to run a legal market all along , but as part of the whole class BS we have only the biggest corporate players have been able to capitalize off this market . Here in PA . the up front capital needed to open a dispensary is staggering , so much so that only the richest of large companies could have ever cast bids for a license , then the taxes and the regulations , it is a huge cost here to grow a cannabis plant .
@JamesS.254
@JamesS.254 11 ай бұрын
That part about the cost of a license is why the "Equity" being pushed is just a political joke of empty promises. Tell me how someone they consider to be "unjustly impoverished" is going to afford the licensing to open a business in the cannabis market? It's a dog and pony show and the term "lottery" truly defines the process. Someone who "qualifies" under these so called "equity" rules Wins a golden cannabis ticket that an "investor" a.k.a. huge corporation with millions of dollars comes in and basically buys the license. In no way are they expecting your average low income citizen to be able to afford to open a business with these license prices.

It's weird that they act like the lack of regulations isn't the reason there were so many stores taking it upon themselves to sell weed and then after they do what you make it seem like it's their fault should have had some rules in place as soon as recreational marijuana was passed

They all pass their cannabis laws either recreational or medical and enact them without having any infrastructure in place , so yes the roll out has been a horrible mess everywhere , again if they simply let the people who already knew what the hell they were doing(the black market dealers) run the roll out and the shops things would have been much different , yet still no state will try this they all are following the same bad plans.

NY, NJ and CT have talked a good game about expungements, but those are only for small cannabis offenses...what about expunging or freeing people currently doing time for cannabis distribution?? The states have no interest in that... As a war on drugs veteran myself (cannabis only), i have done over 6 years of probation and ~$45k in fines/lawyer fees/lost property... the states will never return one cent of that. Also, as a social equity eligible applicant, the seed money required for starting/owning my own business is still incredibly high. I say long live the grey market until there is real equity.

On my block there's a large dispensary, on a major avenue in Manhattan, operating in full view, and it looks just like any large dispensary you'd see in California or Colorado. There are six dispensaries within a couple blocks of my apartment, and these are just the ones that I am aware of. NY State's cannabis rollout has FAILED. The state plodded but demand is huge. It's going to be tough to shut it down because the gray market is so so large at the moment. The state's lack of issuing licenses will cost the state MILLIONS of dollars in tax revenue.

Social Equity= Criminals that profited off an Illegal product, fully aware of it's illegality, are awarded not only their license, but the whole cost of the acquisition of property, building/remodeling costs, all legal fees, employee screening and HR, Product, and tax incentives. The Gray market in NY is fed by Legal grows that the state licensed, then promptly forgot. Most are on their 4th or fifth harvests since last summer. Over production due lack of legal shops is causing growers to find markets, or go bankrupt. They don't have all the incentives the dispenaries have. I think that's fair as it can get in NY

I am surprised CNBC did not look at the issues California has with its legalization efforts. The burdensome regulations and requirements to open shop along with high licensing fees and taxes are going to hamper those attempting to get in the game. Another issue is that lawmakers are notorious for creating laws and regulations, but not fund the enforcement part with the necessary staffing and money. Overall, a good effort, but bad execution.

So it’s still illegal to grow in New York State? I thought we could if you had 3 in veg 3 in flower per adult.

On the last day of the year 2022, it became legal for MEDICAL card holders to grow 3 plants per adult, maximum 6 plants per household. Last day of 2023, it becomes legal for RECREATIONAL users to grow the same limit.

Since they force businesses to purchase from local growers, I don't ever think NY will be a leader in the cannabis industry. Sorry, the marijuana in California is head and shoulders above. Marijuana is legal here in Illinois, I went to dispensary and was shocked to learn they cannot carry leading brands like Cookies because they can only purchase from local growers. I purchased about 10 different strains and they were all garbage. I did the same thing in NYC, trash compared to the likes of what Cookies is putting out. The taxes you pay for the marijuana are so prohibitive I don't see a person who regularly enjoys cannabis shopping at a dispensary but whatever.

Businesses should be run by people who are good at running businesses. Just tax the businesses and use the money to help poor people. Putting people in a position they are unqualified for is an idiotic and incredibly inefficient way of handling welfare. Also, it is not like these people were arrested for trying to correct some moral injustice like helping slaves escape on the underground railroad. They were breaking the law purely for selfish personal gain. People don't deserve to be rewarded for that. I am all for the government doing more to help the poor and especially the black community. But this is the most hare-brained scheme imaginable, of course it is going to be a disaster.

Where is right for people and children who don’t smoke and health? It’s not just the weed problem people lace with other drugs to smoke with it which is real threat to health of majority populations!!!!! It should be illegal because the government cannot create clear rules that’s fair for majority populations none smokers!!

not taxed, cash only. I have a medicinal card and there's always a deal. for instance today is buy 1 get 1 60% off, tomorrow $20 off $100. The deals are at the medicinal dispensaries and id much rather know what I'm getting rather than getting the hook up from a friend who doesn't know what he has either. "FIRE" is a myth... I have that prescription.
