Yup! This deal was outrageous. An extremely dangerous defendant gets a 458-year reduction just to save time and money on a jury trial!?!? This judge made the right decision.

"Threatened" violence, but, YES. She has marbles for brains, and jail is her only cure for those...Dummy would have gotten away if not for pleading like that...Restitution wasnt even that much; Between CS, and working a few jobs; Could have been clear in a couple years...Those are "I only have a few months to live", type of charges....

@@brentfarvors192 Unfortunately, she still got off incredibly light. She was ultimately sentenced to only 3 years in prison for all these crimes and is due to be released in January 2024.

So, she robbed, by knifepoint, 2 7/11's, a smoke shop and a Circle K, and fought the cops that arrested her (presumably) and her lawyer was able to plead down to no jail time. Mr. Barber must be one heck of a defense attorney, regardless of the judge not taking it!

I got the feeling that she blew up the deal by making herself noticeable, and if she had just gone along with the show and read her lines smoothly, she would have gotten her sweetheart plea deal.

Nope the prosecutors are simply lazy and put in their positions by design. This is why criminals are simply taking over some of these cities.

Thank you, Mike! My adrenaline started to kick in when the judge was re-reading the sentences. Good decision by the judge. This plea deal is of the type that makes people scratch their heads in dismay.

Exactly! And you know she'd go right back to her hang and brag about how she pulled one over on the prosecutor and the judge of the plea deal had gone through! She'd also be right back out there terrorizing the community, too, because she would think there's no consequences for her behavior.

At first I understood why the police say, "Why arrest them when the system is like a revolving door "?! Thank God for judges like this man! When I heard she was going to walk with just a slap on the wrist 😳😲 this was my reaction.

I must say, it seems like this one just hit the judge too close to home with allowing someone with all these counts back free into society. I think he handed it very professionally and I like the fact he said a jury of her peers should determine her outcome.

I'm so glad the Judge recognized what a danger she is to herself and the community. I feel sorry for her lawyer who thought this was a done deal. I hope she gets the help she needs or she's going to walk into the wrong 7-11.

Lawyers know, I assume, that there is always a possibility, thought fairly remote, that a judge will not accept the plea deal.

Thanks @Law Talk With Mike! I couldn't believe what was happening while the prosecutor was reading out the long-winded plea deal. Her crimes could potentially result in a prison sentence of over 400 years but the prosecutor offered her a plea deal that only has 10 years deferred jail time meaning she wouldn't spend a day in jail? That was surreal to watch and I applaud the judge for not just pushing it through.

Nah it’s the process. Practically speaking they really only get that by being to aggressive. Brady violations, overcharging, fabricating evidence that kind of stuff

That prosecutor needs to either rethink her approach to the job she was given to do- and consider the expectations of the community she serves and the victims of crimes- or find a new job! Perhaps she'd be better suited as a defense attorney considering how soft she is.

I learned the hard way, very early on, to warn my clients 'the judge will ask if you are guilty of the charges you're pleading to - if you want your plea accepted then you say yes, if you say no the plea will be rejected and the deal dies'

@@SaraSmilesandCreates the case gets relisted - either a new plea is entered and accepted or the case goes to trial. A court cannot accept a guilty plea when the defendant does not admit guilt

That prosecutor should have known better than to offer that deal. Now the prosecutors actually need to work to litigate a trial. I like that Judge.

The problem is: I think it's the ADA being brought up or directed by liberal DAs. You see it happening all over Cali.....like the cities where the police are directed NOT to arrest shoplifters....you see people literally walking into a store and loading up a cart full of goods and walking out. Then you have Kamala Harris putting up the money to defend BLM and antifa rioters.

All this was in Elpaso Texas. It’s a wonder she lived through these prior charges. The people she robbed had cause to defend them selves From lethal force

Probably why she got that deal, even though she was robbing places may not have been seen as an actual threat to anyone. Could've had a razor to her own wrists etc.

Are they though? I’d reserve judgment until I read the guilty plea in full AND any PSI report done before sentencing. Incarceration is not the answer to everything.

@@dadomac3805 Yes it is. It often is. But I believe they wouldn’t have offered such a deal, with terms like anger management, if she were a serious threat to society. On the other hand, Mike is right that women are sentenced very lightly and that may be what’s at play here. Just watch the movie Hustlers, based on a true story. If men were charged with those crimes and took the Feds to trial, they would have gotten life.

I'm appalled at that plea. That many stores being robbed with a deadly weapon, plus assaulting police officers? I can't imagine that DA will be there long if this is standard practice for them. I don't fault the Defense he did his job. I can understand if it was one night, but these were different time frames!!

There may be evidentiary issues that we are unaware of that justifies the deal from the prosecutor's perspective. There are evidentiary issues and/or mitigating factors that the parties know that we don't that often go into making plea offers.

@@1981lashlarue That is what I was thinking. Was it really a knife or just a letter opener or something? Did she actually threaten people with it, or did she just pick it up when threatened herself? Was there some other mitigating issue, some diminished capacity of some sort? How credible are the witnesses? How good is the video? All sorts of reasons the prosecution might be ok with such a deal.

Idk I don't think assault on a police officer should be as serious charge as it is. Like you're getting mauled and gonna have permanent injuries at the hands of police dog but if you touch it that's life in prison? Fuck that. People need a right to self defence against police brutality too.

I have done more time for misdemeanors!! This is pretty disgusting! I don't advocate for jail/prison, but even first offense armed robbery or violent crimes need to have some time to serve. When I was young and dumb I got caught for DUI when I was 19, am 38 now and I had to serve 60 for that and I did not have a record either.

I got 6 years for my fourth retail theft the reason the da was going to go along with this deal cuz he's one of these woke people it feels nobody should go to jail let murderers out with no bond to just screw America over again I'm glad this was an older judge that wasn't into this work bullshit that's been going on

I couldn't believe this(especially in Texas) so I did a quick search on the DA. It looks like her office is under some serious fire for not being prepared for cases. She basically fired 40 prosecutors when she took office in Jan21. Others have left over the course of the year. The situation looks like a mess. In one case a judge dismissed a murder charge because of 'prosecutorial misconduct'. It looks like the DA tried to upgrade murder charges to capital murder to buy some time which the judge did not appreciate. what a mess. Thank god though that the judge would not let this go through.

Mike great points about the defendant’s life expectancy. Judge Middleton has a great way of putting a positive spin on jail time explaining that it gives the defendants an opportunity to get clean and another chance at life.

What the hell is with this weak sauce APA? I can’t even fathom let alone explain what good could come of that PA as written. And Ms Martinez needs a post-incident disciplinary review up to and including termination. She is derelict in her duties to protect the interests of the State of Texas and its citizens therein. I’d push for disciplinary. Why be so hard on the APA, you ask? Simple - she has never actually worked on this case herself. That plea agreement is an amalgam of individual recommendations made by a subordinate over a period of time as each indictment took place. You can tell as she paws through it she realizes how the plea doesn’t hang together at all. She screwed up big time.

I really liked your comment of high risk low reward conduct. It goes to a particular mindset of criminal behavior and it really articulates how people who engage in that behavior has little regard to others and themselves. Great work sir in all you do, coming from a current LEO of 16 years and counting!

Are you kidding me, even if she did 10 years, she would most likely come out more schooled in crime. Deferred, WOW, again more than likely would not be able to comply with the terms. Bless this Judge, wise Man. Society is sick of weak sentencing, so often making no common sense.

Problem is, we don’t have any institutions that make criminals into better people. Prison programs sometimes work, but it’s hit or miss and many prisons have no programs at all. The options are to put people on probation and hope their probation agents get them into programs that fix them, or send people to jail or prison and hope they’re too old to have a taste for crime when they get out.

@@mrjones2721 we definitely need to reform prisons. They should not just be holding tanks for punishment. They should have robust rehabilitation programs and programs/therapy/treatment for mental illnesses. Most people who go to prison come out worse than when they went in. THAT is NOT helping society at all. Things need to change.

There’s an interesting article that traces the development of American prison culture and points out that it didn’t become the horror it is today until the system was flooded with prisoners from drug busts. (Not that it was great before, but prisons weren’t always meat grinders.) It would be great if prisons didn’t make good people bad and bad people worse.

I think the best part is the reaction of the person in jail that is waiting for his turn. He thought he was hard until he heard how many years that this girl is facing.

This judge is what I picture in my mind a judge should be. He is on the ball and protecting society from this very dangerous person. He is not just rubber stamping these cases.

It's clear that the defendant is a menace to society with all the robberies. Good on the judge for rejecting the plea deal. I will be VERY interested to see what happens. PS: You are absolutely right about female defendants getting much lighter sentences than male defendants.

Jury trial and sentence occurred just weeks later and the jury may have been worse or better (depends on the evidence and the actual circumstances which I'm reading now). Actually it really didn't get much worse for Castorena, maybe even better for her. She got a maximum of three years and entered prison with immediate parole eligibility. Even if parole is denied, she walks out of prison no later than 2024-01-11, which is less than two years from the date of this video. Basically all the community service and the 10 years deferred is gone, no parole or probation. She walks out with no restrictions (other than five felony convictions and five not guilty verdicts). 10 years deferred would almost instantly result in 10 years in prison for even the slightest misstep and would add on post-release supervision for a period of time. This is straight time.

It is absolutely ridiculous. A total of just 3 years in prison (with early release) for a string of violent robberies. I really hope she cleans up her life, but wouldn't be shocked if she ends up going back to robbing people, or worse.

I saw this one last week. Love the reaction of the crook in the prison when he hears what her sentence could be, even he is shocked. We don’t have these type of plea agreements in Australia, people would be so pissed. Great Judge, crappy ADA.

@@silverclaw4 yes, our prosecutions are handled by the Director of Public Prosecutions for each state for more serious crimes. The system here is completely different and are police prosecutors for the more minor cases are not authorised to make many deals. Plus the public hate it.

That was a good one. Maybe there is much more to the story that would come out at trial, but given all of those charges, that seemed like a crazy plea offer from the prosecution. Kudos to the judge.

If this was a tall black man he would get 600 years in jail (yeah, more than the 400 possible she was facing. The DA would not have dropped some charges and might have added more for the exact same crimes)

My mouth dropped when I heard "Ten years deferred". Really? With a record like that, she's definitely going to go back out and do the same thing again. Just because she looks and sounds like Anybodys from West Side Story, the girl that always tagged along with the Jets, doesn't mean she's not a very dangerous person, and if she's out she's got no motivation to change. The judge did the right thing.

Oh my goodness, what this woman is charged with and the attorneys say deferred? That’s nuts and I’m not even in the legal field. So glad the judge ruled way he did, now let’s see how community feels. God bless him.

@Kimisu yes I guess the plea agreement is non binding? So the judge could impose the maximum penalties if they went forward today? He’s suggesting he won’t go by the agreement between the Defendant and her Attorney? Sorry my questions are parochial I have no formal training on the Law.

Go Judge!! The public doesn't always understand that between plea deals and "Good Time", these individuals often do very little actual time. My husband just retired as a CO (Corrections Officer) of 30+ years, he once had a guy that because of a shaved sentence and his pre sentence time calculated in, did one (1) actual day inside. It is truly ludicrous!

She’s never going to be able to pay restitution or court costs and she won’t complete community service, this is a ridiculous plea deal. She needs to serve jail time. She’s a terrible ADA, should work for the defense.

She is lucky all 6 knife robberies didn’t result in attempted murder. The way the defendant didn’t understand shows me she has zero understanding of the seriousness of her crimes. Shame on the state! Please keep us up to date on this case. Fascinating

lol I just looked this up- attempted murder is a lesser crime than aggravated robbery in Texas. She would be facing 2 to 20 (like in the counts that were 'just' robbery) instead of 5 to 99/life.

I love the jovial inmate at the top, just chilling and waiting for his turn! Also she's so monotone and it's not out of respect in my opinion, but a lack of. She's crazy and dangerous. I totally agree with this judge. 👌 I'm curios what everyone thought of the prosecutor?

She reminds me of the new prosecutor out of Vermont. Vermont is getting so bad. This prosecutor is allowing crimes to go unpunished or just a slap on the wrist. But when you live in a democratic/very liberal/progressive state this is what happens. They’ve defunded the police in Burlington and the crime is terrible now etc.

Good call by the judge! Perhaps if she had pled guilty without all the hesitation, he may not have caught on to what a sweet deal she was getting. But then again, the judge is no fool.

The guy in the red & white jump suit nearly had a coronary when the judge said 458 years 😄. There's something not quite right with this defendant, I don't know whether it's realization setting in or what but her expression never changes, her head is constantly slanted, her answer's are sort of garbled & she seam's confused about how to answer the charges.
