Assalamualikum My question is as follows: My father were six siblings (all male). His parents and 4 of his elder brothers passed away till 2013. One brother (lets call him X) passed away in 2018 and had no children. Would X's warasat be distributed as 1/4 to his widow and 3/4 to my father? Or children of elder brothers (who died before X) would also get the share?

Salam. After debts if any have been paid and will if any has been implemented, the entire amount will go to the son.

A mother will always get one-sixth of the share unless the deceased had no children nor any siblings. In that case she will get one-third of the share.

I want to ask the same question. It happens in our family that after the death of son the inheritance from grandfather was not shared with the dead son's children and widow. Why did they do so?

قانون وراثت کا جب اطلاق ہوتا ہے تو انہی لوگوں کا لحاظ رکھا جاتا ہے ہے جو زندہ ہوں- البتہ اگر مرنے والے کا کوئی بیٹا اس سے پہلے مر گیا تھا اور اس کی اولاد یعنی پوتے، پوتیاں موجود ہیں تو ان کو بیٹے کا قائم مقام مان لیا جائے گا- یہی معاملہ بیٹی کا بھی ہو سکتا ہے- اور یہی معاملہ بہن کا بھی ہو سکتا ہے کہ- ان کی اولاد بھی اپنی ماں کی جگہ پر مانی جانی چاہیے، بشرطیکہ ان کی اولاد کا مرحوم جن کی وراثت تقسیم ہونی ہے ان کے ساتھ وہ تعلق تھا جو بہن کے ہوتے ہوئے بہن کے ساتھ تعلق ہوتا ہے- میرا یہ جواب روایتی دینی نقطہ نظر سے مختلف ہے-

Salam. In verse 2:180, the directive was temporary. It was meant to apply for so long as the final law of inheritance wasn't revealed. The directive of verse 2:240 seems to be applicable even now on case widows don't get married after the waiting period.

I was just reading Surah alMaidah ruku 14: in it again the command to make a will is reiterated. The first ruku of the Surah contains the phrase that today the deen has been perfected. I’m wondering if it applies to just the food we eat, or to the entire Surah?

Salam. Her husband will get fourth, mother will get sixth, her daughters will share equally from two-third of the rest. The remaining one-third shall be shared equally by her brothers.

1 - In case of only one parent alive, he / she will still get 1/6th. 2 - It will be a big step but it can be done after providing evidence that instead of him being beneficial, he was a source of pain.

1 - Parents, wife, and children are already included in the law of inheritance for benefiting from the wealth left by a deceased. Therefore, there is no question of including parents in one's will. They are already included by the Almighty in list of relatives who will receive a part of the wealth left by the deceased. 2 - If a married woman dies leaving behind husband and children, her parents will get a share one-sixth each and her husband will get a share of one- fourth. The rest of the wealth shall be distributed to the children. There is no way that parents can be left out from the distribution of the wealth of a son or a daughter. 3 - The law of inheritance applies to all muslims, whether they live in a Muslim country or in a country where Muslims are in a minority. In case if a house is mortgaged and the owner of it dies, it will be decided as to how much part of the house belonged to the deceased. In other words, the value of the house that was owned by the deceased shall be calculated and the law of inheritance shall be applied. The grandparents or other shareholders not living in that country should be approached and informed that there was a part of their share in the house they are living in. In many cases parents will forego their right. But if they don't, they should be informed that at the moment selling out the house is not a possibility. Some settlement will have to be made. In anticipation of this complication, the person who is the owner of a house, whether it's a mortgaged house or not, should plan matters of his wealth in a way that the problem is minimized. For example, he can arrange his wife also to be a part owner of the house. There is no way God's law of inheritance could be defied. God knows better what the share of parents, wife, and children should be when a person leaves wealth at the time of his death.

Salam. If the deceased didn't leave a will then the mother will get one-sixth, sister will get half of the rest and the the other half will go to the nephew (not niece). If there are more than one nephews, they will share equally.

السلام علیکم اس معاملے میں ہمارے ہاں اختلاف ہے کہ آیا یتیم بچوں کا دادا کی وراثت میں حصہ ہوتا ہے یا نہیں- ہمارے پرانے روایتی علماء کی بڑی تعداد اس بات کی قائل ہے کہ یتیم بچوں کا دادہ کی وراثت میں حصہ نہیں ہوتا ہے- یہ رائے کسی ٹھوس بنیاد پر قائم نہیں ہے- یہ قرآن مجید کی آیت کو ایک خاص انداز میں سمجھنے کا نتیجہ ہے- وہی آیت مبارکہ ایک دوسرے انداز میں بھی سمجھی جا سکتی ہے- میں یہ سمجھتا ہوں کہ ان بچوں کو اپنے دادا کی جائیداد میں اتنا ہی حصہ ملنا چاہئے جتنا حصہ ان کے مرحوم والد کو ملتا اگر وہ زندہ ہوتے-

وعلیکم السلام جی، آپ کی دادی کا حصہ پلاٹ میں مانا جائے گا اور اس کو ان کے ورثاء میں تقسیم کیا جائے گا-

Eighth part of his wealth shall go to his widow, while two third of the rest shall be shared equally by the daughters. The remaining one third shall be shared by the closest male relatives of the deceased, like brothers for instance. I am assuming the deceased didn't leave any will for the remaining one third.

In verses 4: 11&12 the Almighty mentions the words "after the will is implemented and/or loan is paid" twice, once immediately before the mention of shares of spouses and once before the shares of parents. That is an indication that their shares will be given before the shares of children.
