The woman, who multiple judges found was wrongly charged with negligent homicide for the traffic death of Officer Paul Rutherford, is set to sue the City of Phoenix for malicious prosecution. Nubia Rodriguez filed an official notice of claim on March 15, a week ahead of the four-year anniversary of the accident. On March 21, 2019, Rodriguez hit Rutherford in the two-way turn lane on Indian School Road near 75th Avenue. Rutherford, who wasn’t wearing a safety vest, was working a traffic accident when he suddenly ran into traffic without looking both ways.

The worst part is that there are no consequences for the cops & prosecutor who falsely charged her. They tried to ruin this woman's life but nothing happens to them when they get caught.

Not the prosecutor, they charge based on evidence. The police “collect” or frame up the evidence and submit it to the courts. The police set her up because they didn’t like her attitude.

⁠@@yodaamiexcept the judge took one look at the video and dismissed the case. The prosecutor had much more time with it and decided to bring charges anyway. He or she should for sure be included.

@@karinaz8756 to be clear, she didn't say THEY have no idea where the foster child is. She said SHE couldn't get any answers about where the child is. Which is how the system works, since she was/is a ward of the state, the state is under no obligation to disclose any information about her whereabouts to the former foster mom. The former foster mom has no legal rights.

The American mantra, when things like this happen, is to say, "It’s only a few bad apples." Unfortunately, they are all rotten. I'm sure there were officers who knew this was an accident, and this woman was innocent. Did any of them speak up? They were willing to allow this woman's life to be destroyed in order to protect their jobs and their lying colleagues.

We can understand someone dying for a person worth dying for, and we can understand how someone good and noble could inspire us to selfless sacrifice. But God put his love on the line for us by offering his Son in sacrificial death while we were of no use whatever to him.

That should not happened. Being accused of a crime is not same as being convicted. You are innocent till proven guilty beyond reasonable doubt plus the child was not in danger.

Things need to change with CPS, also. Did you know that Levoy Finchem, who committed federal felony crimes at both Bundy Ranch and at the Oregon Bird Sanctuary was under federal investigation before the feds killed him? And he made his living off of being a foster parent for 20 kids at a time, and his wife was involved by supporting and benefitting from his psychosis. But even after the Bundy Ranch Standoff, CPS still allowed those foster kids to remain under his care, and with his wife after he was killed. Their only reasons for fostering was so neither had to work, and to indoctrinate vulnerable children. That's dangerous, and I bet his wife is still fostering. CPS workers lack the same moral compass as the police, and they sleep in the same bed.

Not by the actual police, it's just a routine the child services or just about any agency do that on their accord because the person is accused of something serious even if it's just accusation not conviction: they presumably side with precaution measures rather than being accused of negligence themselves later.

A prosecutor is not required to show all evidence to a grand jury he only needs to present evidence that supports his case. Regardless of that the case he brings to trial must be valid and in this case it was clearly not. He should be charged with misconduct.

The dumb cop ran into the street without looking both ways. They didn't want to disclose that to the public. They didn't want the public to know the cop died being a dumb idiot. That's why they tried to pin it on her, so that it looked like it was her fault and the cop did nothing wrong. What a bunch of tyrants. RIP dumb idiot cop. He needed to be removed from the gene pool, anyway.

Man, it gets even worse than this. I once read a story about how a traffic stop of a woman turned bad in some way (sorry, can't remember the details) and another cop came to the scene in his car and ran somebody over, killing them. And then the woman in the traffic stop got charged for that person's death because of the "felony murder" doctrine. Because in the USA you can get charged and sentenced for things somebody else did. (I tried to find that story again but I couldn't, US police kill so many people, it's impossible to find something specific.)

Yep! That officer didn't even have a justifiable reason to arrest that man, but the man was charged nonetheless... EDIT: I recently saw news reports stating the man has been released from jail on the murder charge, but the dead cop's boss is still claiming that the dead cop did nothing wrong. Now, the man is being held by a different agency until he can be deported.

No, the reminder people need is to never fight a cop in the streets. Fight them in the only place you can win. In court. Almost all of these cases would turn out without death if people just did what they were told. Telling people to not cooperate will cause more of this not less.

They do it all the time, but unlike this situation, are usually never caught in the act and publicly outed. In 1968 my brother and I were riding with my mom at about 7-8 pm in Phoenix on 16 th street going south. We were at a traffic light waiting when it went green and my mom started across the intersection. Suddenly a Phoenix PD cruiser came speeding from our right into the intersection and hit us in the front fender. We spun over to the left and the cruiser careened off to it’s right and into a telephone pole on the corner. No lights, no siren…no headlights! They tried to say the light was green, but all three of us were adamant that that was wrong. They didn’t give her a ticket, but later sent her a bill for the damage. Her lawyer had to go to court and get them to admit it was the cops fault. They never rescinded the demand letter, but never took any more action. Lying trash. Now this. What kind of mental illness does it require to think it’s ok to pull that kind of trailer trash BS?

As a former foster child I have to say, it's your dream as a foster child that someone will want to keep you and be your mom, for most of us this never becomes a reality, and for a false accusation and trumped up charge to take that away from a child, there has to be consequences. I haven't cried in a long time, this brought tears. I hope this family can find the child they were adopting and get her back.

Nothing will happen to anyone. The judge, the DA and the police all have qualified immunity which means thay can NOT be charged or convicted for wrong doing in the line of duty. IT's the old I was just doing my job routine. End qualified immunity and you open these people up to civil actions. But normal people don't know any of this until it happens to them.

This happens all the time. I was accused of a violent felony many years ago. The prosecution withheld the evidence that proved my innocence clear up to the trial. I went bankrupt fighting a charge for two years, that they knew was false within days.

As a former IA investigator, the city or country prosecutor needs to be disbarred, the supervisors, section chief and officers within the Phoenix PD need to be held accountable within that suit. "Internal Investigations" should be made illegal. ANY investigation into a law enforcement agency should be conducted - externally - by one agency higher than themselves at a minimum and the findings verified by the NEXT highest agency. No more "we investigated ourselves". Local level? The state agencies investigate. State level? The federal agencies investigate. Federal level? DOJ investigates directly. When the responsible parties are the ones handling their own potential crimes, you get the system we have now. ZERO transparency. ZERO accountability. ZERO integrity.

Based on the video it is clear the officer walked into the traffic lane in front of her SUV, she had no way to stop, I am glad the judge was able to see the video and dismiss the case. It is unfortunate that the officer did not look both ways before crossing the street as all of us were taught to do by our parents!!! This is not a total win, the woman will remember this the rest of her life, and the child should be restored to her because the fingerprint card was taken away under false pretenses!!! She should sue the city for anguish, attorney's fee's court costs, and the loss of the little girl she already fell in love with!!! I served wearing a badge twice, it is imperative to serve with complete honesty and integrity, Phoenix Police failed on that one!!

I feel for this lady. I had the same type of experience. A vehicle ran a red light right in front of my truck resulting in 3 deaths. The cops tried everything they could to charge me even though there were over a dozen witnesses. They even went so far as sending a confidential informant to try to get me to say something incriminating. It’s hard enough to deal with something like this without the stress of dealing with being prosecuted.

I feel so bad for this lady and hope that she prevails with her civil case. I know of a case out of Minnesota where the cops and prosecutor did something equally bad but by the time the victim had the evidence the courts ruled that the statue of limitations had expired. I hope that doesn't happen here.

In my area several years ago, a cop was responding to an emergency call. He was driving at a very high rate of speed with no lights or siren. He rounded a curve just as another driver was pulling out from a stop sign. The cop avoided a collision by swerving off the road. He hit a tree and was killed. He was not wearing a seatbelt (this fact was covered up in the investigation). Likely, if he were wearing his seatbelt he would have walked away from the accident. The other driver was charged and convicted. He never had a chance because they were determined that someone else would be found at fault for the accident. They ruined that poor guy's life.

Fun fact - the number one cause of death in the line of duty is car accidents. Stemmed from negligence just like you described. That is awful. Did the person ever get a chance to appeal the case? Is he still in prison?

The outcome was not the same, but many years ago a Georgia State Trooper acting stupid like that ran over and killed the wife of a member of the Atlanta Braves Training staff in the middle of Atlanta. I don't remember if there was ever a settlement. I do know that Trooper lost his job.

In my area exact circumstances only the cop was chasing someone and T-boned a girl in a car and killed her and nothing ever happened to the cop

Wonder if it was because of the benefits the estate would receive in the event of his death why they falsely claimed she killed him, disgusting behavior from the police and prosecutor, everyone needs to be held accountable

Life insurance pays out double if a person is killed while working. Aslong as its not Suicide. Dont matter if they are murdered or a accident. Its the same pay out.

Good point. Especially since they didn’t file the charges until after the fact. This is why EVERYONE needs a dashcam. This case never would have gotten legs. Her lawsuit should be a HUGE payout.

It's this woman's fault!!! She should at least slow down, or stop, since police car was flashing. What a shity argument that the Officer run to her viechle for suicide? Isn't the truth that her car knocked down and killed the Officer?

ALL DRIVERS should have a dash cam, period. Let them make their bogus charges. If they hide the truth as they often do you'll have a copy of your own.

It was obvious to the judge when he saw the video. It should have been obvious to the police and the prosecutor! They ruined this woman’s life. Everything that was taken from her needs to be restored and charges filed against those who sought to prosecute her!

All I needed was that short video of the cop walking into her path to know it was an accident. There are some evil people in the world. Thet took over a year to charge her. I can't imagine her shock and stress over something that was clearly an accident.
