My husband broke his ankle needed it to be set and needed surgery on both sides of that one ankle. He’s in a lot of pain everyday and just got another X-ray done and his bones are fusing together and he has joint and tendon damage. He has hardware already and they don’t know if a second surgery will help or just do the same so he will potentially be in a great deal of pain the rest of his life. We want to get a settlement but don’t know how much they would even give us and what if we settle and years down the road realize he needs more surgeries and they didn’t really compensate

Thank you for your question. I am so sorry to hear that your husband is going through that amount of pain after his injury. The amount you should settle for is a very complicated question. You need to make sure it takes into account future benefits (medical, lost wages, permanent partial disability, etc.) that would be covered by workers' compensation. I broke my ankle at work. My boss was nervous. (I think he did jot have insurance when it happened) Anyway I got $100 a week for 3 months and a $7,000 check I feel like I was robbed It happened a few years ago. Is there a way to get more money?

Thank you for your comment. I am sorry to hear that you went through that. It sounds like you may have settled your case. Generally, settlements are final and you would not be able to go back and change it now. But, to be certain, you would need to have an attorney review the documents you completed that resulted in you receiving the $7,000 check.

That’s mess up but unfortunately it goes off how much u make a hour. Be because I broke my ankle and got 380 a week and 25k settlement

It can be. In Georgia, workers' compensation doctors are required to use the 5th edition of the AMA Guides to the Evaluation of Permanent Impairment when the rate permanent partial disability in workers' compensation cases. Vertebral fractures often qualify for a permanent partial disability rating under the DRE method of rating spinal injuries. The amount of the rating depends on a number of factors including how bad the fracture is, whether it alters motion segment integrity, and whether there is displacement.

What's the typical settlement amount for a broken foot that put you out of work for four months or more?

Thank you for your question. Unfortunately, that is a difficult question to answer because a reasonable settlement amount will depend on may different factors. In a Georgia workers' compensation case, one of the key factors is how the injury affects you in the future. For example, in most Georgia workers' compensation cases, an injury which causes ongoing limitations that prevent you from going back to work or limit how much you can earn will settle for more than an injury which heals up almost completely. Other factors like the amount of your weekly workers' compensation check and the future medical treatment you may require factor in as well. It just requires a lot of specifics to figure out a reasonable settlement amount in any particular workers' compensation claim.

@@alexclaps8662 Well I broke my foot in November of last year I didn't hire a lawyer until January. We just settled the last day of May so I haven't received it yet but should get it soon. I would recommend getting all the medical attention needed before settling your case no matter how long it takes. It took me 6 months and some change of treatment and therapy before I felt comfortable settling also I didn't want to work at the job where I broke my foot anymore. Hope this helps
