The plaintiff says he purchased a used washing machine from the defendant that was guaranteed to work, but it only functioned twice. The plaintiff is suing the defendant for a refund. The defendant insists the plaintiff had the machine for a while, and she has no idea why it stopped working.

Yep. Me too. She did say that she told him that he had to press a "Reset" button ...so that tells you she's aware that some sort of problem exists.

Same. I think she knew the trick with the rest button that it would work for 1 or 2 loads and that’s why they were ok to test it for him. They had it for a year. She knew they didn’t work

A basic washing machine without all the extras is like $400 An old one that's built like a tank is still in my grandma's basement from the 80s still runs.

One tip I picked up over the years, as an occasional seller at least, is if someone's coming to pick something up usually they have to come into your house so rather than asking them if they want to inspect it working, just turn whatever it is on as they're coming in. That way it negates people saying they don't want to test something for whatever reason, there's also a small psychological reason in that sometimes people assume inspecting something running will take time or just can't be bothered but if it's already on as they get there or as they're coming in it means they're more likely to actually stay to inspect it properly.

I agree. She only used it for a year? They knew it worked for 1 or 2 loads with the reset button that’s why they were ok to show him and test it. I feel like ppl are looking at this “respectable” woman like she would never lie. Scammers don’t have a certain look

She didn't say a phone call was better. She said a phone call conveys tone and the context of what you're saying better than text which is 100 percent true. She also says all the time to have a call and follow up with an email or text reiterating the conversation which is what I always do with my clients. Almost every phone call gets an email follow up to document what we discussed.

I know me personally I make an appointment and if I don't write it down immediately I'll have to call back to confirm because my brain doesn't always process 😅 That's why when I switched a shift with a coworker over the phone I followed up with a text and she confirmed.

I went to buy a used washer...when I got there the woman explained it had been "acting up" and the repair man said it was a hose, but wasn't positive. She ended up giving it to me for free and my bf didn't have any problems setting it up!! There are SOME honest people out there...then there's people like this woman 🤦🏼‍♀️

How is she in the wrong she offered him the opportunity to try it before buying and again to set it up to try it? Sometimes things break , could be user error or maybe maintenance guy hooked it up wrong or broke it. 🤷‍♂️

She offered to let him to come to her house and test it. If I though my washer was bad I wouldn’t let someone come to my house. The guy is clueless and probably has poor logical thinking skills. He most likely sloppily threw in heavy towels in a bunch and messed up the belts that get thrown off if load is unbalanced.

This man just described my exact issue with my last washer. I had buckets of sopping wet clothes all over...almost lost my mind. Pretttly sure the basin was out of balance. Ended up treating myself to a new one I was so frustrated 😠

if they're not level, not calibrated correctly, not hooked up right, using the wrong detergent, and 789 other things can cause this. been through many washers in the last 30 yrs, it's a common problem.

Three years ago we purchased a brand new washer for a rental property from Home Depot for $421. Simple machine but works very well. They delivered, removed old machine and set up new machine for a small fee.

I think I wouldn't assume someone us a Karen.. you really cannot say that with certainty.. it may have broken in transit or computer components aren't resetting properly after moving.. I think society as whole looses when we assume.. you may have an opinion that leans that way..but to say you are certain?? I think people need to admit that it's not certain.. and if you are wrong.. you are being very harsh towards someone that doesn't deserve your judgment. You may be right... but you may be wrong

All these comments demonizing the defendant are ridiculous. When buying USED items, the onus is on the buyer to do their due diligence. Used appliances are very iffy and people take their chances with them. Sometimes it works out, other times not. The defendant did nothing wrong here. People need to buy NEW items (with warranties) if they expect things to work perfectly for a long time.

I bet she was having problems out the washer and it was working intermittently; but I digress. I had the same problem with a whirlpool that was brand new from the day I moved. It had all these new sensors and was replaced atleast twice so I feel his pain....glad the machine is in my lease so I asked the landlord for a cheap basic model instead of the middle of the line it has worked fine ever since

Why?? Maybe a family member moved out of state and had a 2000 dollar set .. maybe they moved into a new home that had brand new appliances.. its all irrelevant anyways.. The guy could have put his pants in the wash and coins were in there and wedged under.. maybe he overloaded it.. if he needed a washer for some time he mightve been impatient and over packed it.. those things can happen and I wouldn't want someone buying my used machine that worked for me then 2 days later claiming the third load they did wouldn't work.. then I may be taking a loss when he broke it??! Maybe his maintenance guy screwed it up! Who knows..

I just brought a washing machine. It was $700 plus $135 for expanded maintenance, plus tax plus removal $35 of old one. Around $1k, you get what you pay for. A used washing machine from a private has no warranty. And he’s the third person who brought it!

As someone that had one of those small Agitator energy efficient washing machines it's probably working as designed but putting more than 2 towels and it is just too much because those things are absolute trash which is why The defendant probably got rid of it. Another green idea that ended up using double the electricity an time to do half the load of laundry an barley got the clothes clean.

I HATE those type of washers with the nipple agitators they are so sensitive to everything. If you don't load it properly (you have to load it like a donut and not cover that nipple part) it won't work. Worst of all Is the amount of water it does the load with. 4 items or 9 items uses the same amount of water, not very much. I still have the washer cause I paid 500.00 for it years ago and iam gonna get my money using it before I die.😄

Based on his description I bet it’s a Samsung. They are notorious for problems with the washer. Defendant is right there are a bunch of things that need to be right for it to work. His description sounds like it wasn’t balanced so when there’s a big load it will just stop. He needed to balance it, then reset the spin cycle.

Mizzmist - E, that's hilarious. Anyway, our house was 20 years old when we bought it, the washer and dryer are as old as the house, here it is 6 years later and they still work great. Some people just have bad luck with appliances. If you have to buy used, then buy from a used appliance shop that will give you at least some kind of guarantee like maybe 3 months or whatever, when you buy from a Mizzmist - E, you're taking your chances.

The washer looks like the same Whirlpool brand that I purchased from Lowe's a little over a year ago. The defendant probably had the same issues I am having. She knew it was a piece of junk when she sold it to him.

This is exactly what happens when folks decide to purchase used items as oppose to new. I say it all the time that if you're going to buy used items, homes, cars etc..that you do so at your own risks and have no body to blame if or when things go wrong but yourselves.

The defendant knew that the washer is faulty- why is someone going to replace a 3 yo washer, or someone give them one if it was fine? That being said , she sold a defective machine purposely to the plaintiff. The plaintiff should emphasize the wording in her ad, and the verbal comments she made , to show that she misrepresented the item - which I believe is the case. If the judge has some leeway and choice in the case, she should side with defendant. Return the washer and give the money back less $50 for delivering - that way both litigants would be back in the same state they were in the beginning and no harm is done .

I wonder if he ever tried arranging everything in a donut (leaving the middle empty)? We had a similar machine without an agitator and someone suggested we try it. I’ve not had an unbalanced load (stopping the spin cycle) since.

Guarantee, he put too many towels in it at same time! My washer does this & its a brand new, huge front-loader! Any machine won’t spin right if you overload it!!!! (400 for a 3-yr. old washer is pretty good deal actually considering brand new ones - depending on brand, are easily upwards of 1,000 these days).

And can be something stuck in the washing machine. I have a stackable and one day the machine filled with water and stopped working. The repairman took the from panel off and fished inside and found a sock that stopped the machine. So never just throw two to three things and expect the machine to work right.

Some of these washers have to be level for them to run correctly especially the spin cycle usually won't come on unless it's level.

The ad said that the washer worked like new, then gave a list of things to “try” to get it to work correctly. Sounds like false advertisement to me

My stupid washer was getting stuck on the spin cycle. I just stopped using it. They wouldn't have sold it if it was working properly.

He’s claimed to be a long time viewer of the show and he thought because she didn’t wright as it is in the ad that that was a problem. JM has said that so many times that it’s an as is sale if it’s used. 😂

Sadly this is an AS IS sale (whether mentioned in the advert or not), and whether she knew or not that it was dodgy (her smug smile tells me she knew it was dodgy), but he bought it and that is that! Even if he had seen it 'working' he wouldn't have waited for the whole cycle, to see if it spun correctly, so would have bought it anyway. It's better to buy from a second-hand shop that guarantees that it is in working order or else buy new, buying off Craig's list is just like playing Russian Roulette, but with only one empty bullet chamber...
