0:15 Assault doesn't require touching or any physical contact. It's the threat of physical contact. Actual physical contact is battery. But he is totally and utterly wrong to say that filming him is assault - well not unless you were wielding the camera around as a weapon, but then the video would be extremely blurry. And without his implied consent? He gives implied consent by talking to you knowing that you are filming.

You don't have to touch him for assault but you have to at least threaten to do so. Common assault (section 39, Criminal Justice Act 1988) A person is guilty of common assault if they either inflict violence on another person - however slight this might be - or make that person think they are about to be attacked. They do not have to be physically violent - for example, threatening words or a raised fist could lead the victim to believe they are going to be attacked - and that is enough for the crime to have been committed. Other acts like spitting at someone may also classed as common assault.

Oh dear. Good luck trying to prove that one in court, mate. That's assuming the police can stop laughing long enough to perform an arrest and charge. 🤣 What he doesn't realise is there is no, 'implied consent', in a public place, if the subject matter of recording isn't primarily focused on them. If they so choose to put themselves into the frame of the camera view, then that's their choice. It's not as though the camera is being pushed into his face, with him trying to get away from it. This idea that it's, 'assault', is nonsensical. I was more interested in the young man doing tricks on the scooter. I assume that's part of his job description(!) The chats you had showed how open some people can be and the atmosphere overall is very amiable. But then, there's always one who has to spoil it. The rubbish he comes out with as a way of trying to stop you doing what you're doing is laughable. A typical case of minding everyone else's business but their own. There's no alternative but to laugh at these clowns. They think they can throw their weight around and exert authority where non exists. A true legend in his own lunchtime, that one.

He's wrong on the photography. It's not assault. However he's right on the question of touching making an assault. It's not part of the test. Illegal arrest by police officers, with the threat of handcuffs etc, is assault.

The company really need to be swapping their roles around. Ian certainly outperformed him on 'every' level.
