In almost all cases you can take photos on private land or public. Only laws broken would be trespassing laws if it was a condition of entry not to take photos and that would have to be written somewhere, signage etc... Taking photos is separate from publishing 👍
@TheSadButMadLad11 ай бұрын
Nearly spot on. There is no public land in the UK. All land is privately owned. What we have in the UK is public places, which are always on private land, even public rights of way. Anywhere designed or open to the public is potentially a public place. Even a corridor in a block of flats used by people as a shortcut. But not a pathway to a hostel entrance to which only residents can gain entrance. But having said that, even in such non-public places, the only affect is about what is a crime on it or not. Photography is never a crime anywhere anytime except in a very few limited places such as courts and prisons.
@gsommerfeldt11 ай бұрын
@@TheSadButMadLadNearly… the UK has “common land”, which is just about the exact definition as “public land” or “public space”, but includes privately owned, publicly accessible land, not just land owned by government entities like councils and the NT.
@TheSadButMadLad11 ай бұрын
@@gsommerfeldt Yep, common land is still privately owned - by the commoners. Land owned by government entities is still privately owned.
@gsommerfeldt11 ай бұрын
@@TheSadButMadLad Private land in the UK is land “alienated from the Crown” in some way. So not all land is privately owned - some is actually publicly owned - even in the UK. But land laws in the UK are complicated - in practice you’re absolutely right. Now even highways are “private property” since the formation of National Highways, a company, whereas before, they would probably have been considered actual “public property”… I’m nitpicking, but only because I think the UK system is quite interesting. :)
@TheSadButMadLad11 ай бұрын
4:15 Correct. To meet H&S laws and rules, there should be a sign on the entrance stipulating all the rules such as hi-viz, safety boots, etc. To be told it means they've either failed H&S or they are just making it up as in a gaslighting attempt.

6:55 A successful bit of gaslighting from PCA. Technically the user of the land/property can ask a person to leave*. So a lessor can ask someone to leave, but only the bit they lease, which typically is just the building on a plot. That they make use of some land outside the building doesn't necessarily mean it's part of the lease. * A tenant of a rented property can ask someone to leave their home. The landlord cannot ask anyone to leave the house, only the tenant - when they fail to meet the conditions of the AST. Similar with a leased property. The lessor can say who leaves, not the owner. The owner can only say that for the unleased land shared by all tenants/lessors - and even then they can't just say it because they don't like what a person is doing.

You handled this well but you need to brush up on the law a bit. Having an implied right of access generally means you can cross private land to get to a business for example, but it's not an absolute right. It doesn't mean you can go wandering around doing what you like and if asked to leave you should leave. A leaseholder is perfectly entitled to ask you to do that. There's no such thing as "tresspassing" someone in England - that's an American thing where a business can ban you from their premises without a court order.
