i dont agree with rating all mental conditions the same. if someone was sexually assaulted and has ptsd from a combat situation. they should be able to claim both. How is that not just basic common sense?

Great video sir; appreciate your expertise. If a veteran submitted a va disability claim for service connection to shoulder disability for a documented injury (evidence of this accident in the military) along with a current diagnosis, all medical evidence of surgery, various treatments over the years and a nexus letter from a private md do stating that the shoulder disability is more likely than not and in fact highly likely that the current shoulder disability was caused by the injury in the military but the c&p examiner wrote that it was less likely than not due to lack of chronicity as there was a gap in treatment over the years(injury was sustained in 1981) despite all the medical evidence of treatments and surgeries but there was some time there was no treatment but the symptoms have been there since the injury in the military. The claim was denied despite all the veteran submitted; the veteran is considering hiring an attorney to do a high level review to argue that despite there being a period of time since 1981 that there was no treatment there has always been symptoms. Does the veteran have a good chance of having the denial decision reversed if the attorney (a VA accredited attorney) does a higher level review on behalf of the veteran and should the veteran be on the call with the attorney when speaking to the DRO? Also, will favorable findings in the decision letter stating there was an in service event and there is a documented disability help? Thanks

You can call The Veterans Benefits Administration (VA) National Call Center ( just GOOGLE that to get the number and hours of operation) and once you are speaking with a representaive request it - VA Ratings Code Sheet. You can request that they email it to you, otherwise the default is to mail it to you. I did this a few months ago, requesting that they email it to me and received my VA ratings code sheet back by email within an hour.

Casey Walker with the VA Disability Group help secure my VA Benefits after 30 years of trying to get them . I doors slammed in my FACE dozens of times by the VA as I struggled with all my Panic Attacks and other nightmares, rage, Anxiety that went full THROTTLE! I just could not live like this almost wanting to end it all. he won by VA Disability and I really did not think I would win anything? "Thank You" Casey Walker and Team VA Disability Group! We will see where this Economy takes ALL of us because the VA is Broke. They may reduce Benefits or go after Veterans and charge them with crimes to take them back by kicking them off using the legal system. However, this TEAM does win, but keeping them may be out of their control?

No doubt the future of VA benefits is always in question. Every year there's discussions of sweeping changes that would have a profound impact on benefits. How about accumulation of low level blasts like firing multiple heavy mortars like 4.2in and 120mm munitions? Also anti tank munitions like AT4 and M47 Dragon anti tank? The concussive forces from those can cause TBI and long term residuals.This is my issue and I just had a C&P exam for it recently. Waiting for a rating now.

You definitely have a case. What you will want to do is compile as much literature as possible supporting your claim. Send the actual literature to the VA (not a page with website links). Also, you need to document that you have an actual condition/TBI attributable to these concussive forces. That's what the medical opinion/exam is for you just went to. My mental health is the worst part of it. diagnosed MDD anxiety and panic disorder. 7 hospitalizations 1 5150 hold and a suicide attempt. I was even forced into a medical retirement from the state of CA after 18 years because of these symptoms. With videos like yours I finally zeroed my issues down to a possible TBI. Please keep making them. they help us tremendously.

Yeah don't take care of them over Vietnam guys that lived in the jungle for a year make sure you get a young guy that suffers from PTSD because he had to work in the supply room

Well, we would agree with you to the extent Vietnam Veterans have had some difficulties obtaining benefits over the years. Thankfully, presumptive conditions have at least helped that cause. It can be frustrating seeing others with shorter combat deployments or "less combat" receive benefits while others are denied. The system is woefully inconsistent, and that's unfortunate. There's no doubt that certain people experienced more "combat" activities than others, but we think it's healthier to fight alongside all combat veterans from different eras as a team towards a mutual goal. A Gulf War supply clerk with mortars and rockets exploding daily near his shop has reasonable reason to conclude he is under attack and in a combat situation. Thanks for the comment.

Does the premium payment stop once you have paid the benefit amount? For example, if I have paid the annual premium at my current age, 56 years old, $1988.80 X 20 years = $39,776. This doesn't even account for the cash gains.

It's not cheap, but it's actually competitive with other insurances, and in many instances it's cheaper. Also, many insurers won't provide life insurance to individuals with disabilities. The VA system at least gives Vets a chance. No doubt...it could be better - much better. Thanks for commenting!

Hello, so just to confirm of what I understood at the beggining of the video. Im in active duty still about to start the medboard process I am already diagnosed with PTSD due to some stuff that happened while deployed. My question is does losing close relatives while being on active duty would be a service connected event that could help the outcome of the rating if mentioned? I unfortunely lost my father, mother and sibling a couple of years ago while I was deployed I dont really like talking about it but it would benefit me if i was to bring it up or should i just focus in the deployment events? If you are already service connected with PTSD, then you should be good to go as long as you didn't have a mental health condition documented before entering active duty. Yes, the death of your family members can suffice as a valid stressor for PTSD purposes. Unlike combat, where the stressor is conceded, a non-combat stressor needs to be verified. Well, a death certificate and statement that these were your family members should be more than adequate. Sorry for your loss That's a hard pill to swallow. Be well. Hope that helps!

Proving the radon exposure can be tricky and hard to prove. You have to show elevated levels of radon during the time you were there. You then need a nexus/medical opinion linking your lung problem to that exposure. If applicable, the easier argument is gulf war exposure. If you didn't serve in the gulf, I would also contend that job duties and environmental hazards also caused your lung problem. Hope that helps. Consider the following for more insight.... Radon levels are tested on military bases. However, the frequency and consistency of testing can vary. Here's what we know: Department of Defense (DoD) Requirements: The DoD has a Radon Assessment and Mitigation Program (RAMP) that requires radon testing in all DoD-occupied buildings. However, a 2023 report found systemic deficiencies in the management of radon in military housing, suggesting that testing isn't always consistently implemented. Navy Radon Assessment and Mitigation Program (NAVRAMP): The Navy specifically has its own program to identify, mitigate, and prevent radon contamination in Navy/Marine Corps-occupied buildings. Individual Base Initiatives: Some bases may have their own programs or initiatives to assess and address radon levels. For example, Marine Corps Base Camp Lejeune has a radon program with information on testing and mitigation efforts. Concerns and Resources: Protect Environmental: This organization has raised concerns about inadequate radon testing and mitigation in military housing, especially given that radon is the leading cause of lung cancer among non-smokers. Base Environmental Offices: If you're concerned about radon levels on a specific base, you can contact the environmental office for that installation to inquire about their testing and mitigation procedures. It's important to note: Radon testing is the only way to determine if hazardous levels are present. If you live or work on a military base and are concerned about radon exposure, it's advisable to inquire about the base's testing protocols and results. You can also purchase your own radon test kit to assess your living or working space. I hope this information helps!

Well...nothing with fibromyalgia is ever straight forward, but essentially this is saying you have musculoskeletal pain and tender points about 8 hours a day (one-third of the time). Hope that helps. I thought this and PTSD from the Vietnam War were all the same. I also have all the systems that you show when this video started, severely. It got so bad last year that I had an Heart Attack, While at local Hospital they ran a CT scan and I also had an Abdominal Aortic Aneurysm so large it could burst at any time. Sent by ambulance to the Specialists in Grand Rapids. Dr Kimball , who was going to do the operation, told me how big it was. I stated that I had C&P in 2011 for A.O. and they said there was nothing wrong with it. Dr. Kimball stated: BULLSHIT, It would take , AT THE LEAST, 30 years to get this large. VA, just did not want pay you for it.. The funny thing is , in 1984, my youngest son, who was born with a Birth Defect. had an operation on it and Dr. had tissues tested and they came back + for chemicals in A.O. I thank you from the bottom of my heart for this prestition.

I had pain problems in the army 1968 in Korea and was instructed to take ex-lax or peptic-bismol by the nurse never was able to see a doctor because TDY from Seoul. After severe pain my bowel finally moved. This happened constantly during my active duty in the army. Now I'm in my seventeenth and because I been mis diagnose by my doctors I have IBS. do I have a good VA Claim. Thank you for your information.

You definitely have a viable claim. You will want to provide as much detail as possible in a sworn statement about the symptoms you experienced while in Korea and how those symptoms have persisted since separating from active duty. Because your symptoms began on active duty, you could pursue a direct theory of service connection. You could also potentially attribute the symptoms to environmental and AO exposure. Lastly, you could potentially link the symptoms as secondary to treatment of a service connected condition. If any of these are applicable, I would pursue all that apply. Good luck!

He began to talk about all the books he wrote pertaining to mental health and after about 15 minutes of hearing him talk, he said ok we are done here. I agree with the file and i believe you have PTSD. I'm going to put in the remarks that "you need intensive inpatient mental helath treatment" has this happened to anyone else? Not sure if this is a good thing or not

He began to talk about all the books he wrote pertaining to mental health and after about 15 minutes of hearing him talk, he said ok we are done here. My c&p examiner kept telling me that I had anxiety and not ptsd, after a private doctor said it was ptsd. this examiner would say things like "if you can't remember certain conversations after the incident, then it's not ptsd. Because people with ptsd can remember those incidents". I just told her what I experienced and remembered, I'm not gonna lie and give her a reason to disregard me.

I've reviewed over 50 youtube videos on this subject, and this video tops them all!!!! Thank you. I was diagnosed and treated for PTSD while on active duty; however, the VA C&P Examiner diagnosed me with Major Depression Disorder (MDD) and General Anxiety Disorder (GAD); therefore, I was VA rated at 30% for MDD and GAD. Afterward (for the next 15 years), my VA psychiatrists and psychologists diagnosed and treated me for PTSD roughly 95% of the time and roughly 5% for MDD and GAD. I am now submitting an increase claim for MDD and GAD. (Note: The VA's 38 CFR and M-21 lump all mental health diagnoses and conditions under mental health, so I'm submitting an increase claim for MDD and GAD). Question: Do I need to include the VA Form 21-0781 considering that I'm submitting a claim for MDD and GAD, even though the majority of the after-service treatment was for PTSD. Maybe I'm overthing this, and my anxiety is kicking in.😄

Generally you should help the examiner complete as much of the dbq as possible. The examiner should complete the examination part of the dbq. For example, if possible, you should help them complete the medication, objective testing, history, etc. this just makes it easier for them. It’s a case by case decision as some examiners want to complete the entire thing. At a minimum, the examiner should be reviewing and agreeing with anything prepared before endorsing it. Hope that helps.

My main issue is tinnitus hearing loss migraines major MH conditions like MDD anxiety and panic disorder. 7 hospitalizations 1 5150 mental health hold 1 suicide attempt. A lot of other stuff...

I got chronic hepatitis b, i got it from the Jet vaccine injectors that were being used back in the late 80’s. They stopped it in 97 because it can give people bloodborne infections. Mine was never documented by the army. However, when I joined the police dept i was vaccinated for hep b that should have protected me. Doctors are saying the vaccine wont help if I already have the virus prior to the vaccine. I was vaccinated sometime in 92-93. I was exposed to the jet injectors in 89 when I went through basic training. What is my chance in getting disability?

This is more common than people realize. We agree that the injector guns were problematic, which is why they don’t exist anymore. Keep in mind that hepatitis b doesn’t compensate that well; however, you can link it to other organ problems as you age. Write a detailed sworn statement about why you believe your hepatitis was caused by the military. Gather research and submit the articles and statement with your claim for benefits. It may take 4-6 years, but I think you have a good chance. Good luck!

Thank you for taking the time to help us. Veterans better understand this process. I, for one, sincerely appreciate your efforts. I have a question I was hoping you could answer. I 1st filed for PTSD in 2009 along with Tinnitus. I was extremely unstable at the time. I missed the C&P exam for PTSD and was able to make the exam for tinnitus.I was, of course, denied on tbe PTSD and awarded 10% for tinnitus. Fast forward 15 years later. I have been recently diagnosed with chronic PTSD I also have a mountain of evidence in regard to the real-life effects my mental health has caused in my life. Everything from a 5150 hold at the Va to chronic homelessness, a letter from my Law enforcement father that he told the VA " I burned all my bridges: which shows how isolated I am, to broken hands from fights documented at the Va to a SS employment records of the last 20 years of employment being under poverty levels to lastly Alcohol usage disorder. I just took a mental health evaluation at the VA, and the clinical social worker put 1. Chronic PTSD, Anxiety Disorder, and Alcohol use disorder. In your opinion, should I file a supplemental claim for the 1st denial for PTSD in 2009? Or should I file a new claim with Mental Health with all 3 of my diagnoses?

VA rep called me twice and informed me that I do not qualify for property tax exemption with 100% disability, must be permanent and total. Since when is cancer not permanent (lung (2), skin, pancreas, spine) plus loss of hearing, tinnitus, acid reflux, ?) . Should take each case on own merits. Been at disability processing for more than 14 years, plus after retirement Jan 1985!

The cancers can be so maddening. Generally, skin cancers don’t compensate well, and almost all cancers only involve temporary total evaluations. Once remission is achieved, they evaluate the residuals. It’s a difficult process. I would love to see regulatory changes in this regard. Be well!
