That is Hollywood telling you EXACTLY how the US government, "law" enforcement and the "justice" system works. And I'm pretty sure that it is the same way in most of the world, people with dirt in their past are easier to control, and the people that are willing to go to the most immoral extremes, the most refined, evil, high-IQ psychopaths, are the most likely to seize power. The movie isn't even about the Civil War. It's mostly about Bill's belief that Irish immigrants were flooding to America to re-shape the culture. The movie just happens to include events and dialogue about the Civil War because it's set in that time period.
