If you're impaired or just commited a crime then keep your mouth shut. If you've been pulled over for doing something stupid while driving, speeding, stop sign, etc. admit it and be nice. You don't have to talk, and the cop doesn't have to let you go with just a warning.

All this do not talk to police sounds good but if the cops pull you over and insist of searching your car THEY WILL. The system of today is YOU ARE GUILTY UNTIL PROVEN INNOCENT> So they will search your car no matter. With luck they will not plant drugs cause that DOES HAPPEN. THIS IS HOW IT ROLLS FOLKS!!!!!!

I'm dumbfounded how certain aspects of evidence or certain evidence at all, is just not presented at court. This seems like a miscarriage of justice.

Recently, another one of Donald Trump's attorneys sold him out and disclosed private information. Of course, we are not Donald Trump. This is one of the reasons why we so distrust attorneys. It is a reasonable question for you to ask an attorney you hire if THEY TOO will sell you out. DRP law, what do you think? Sanjosemike (no longer in CA)

Wow, what universe do you live? In southeastern NC, people drive way over the speed limit, race on roads and the speed limit IS NOT enforced. These lawbreakers have to be punished in court. The police have to start setting up devices to nail these lawbreakers. There in no excuse to speed.

One thing is important is if a person has any kind of a criminal record they are automatically on the opposite side of the fence from the police. This applies even for low level nonviolent felony convictions decades in the past. Today with records checking and syndicated computer systems they can find out a lot about you in a short time. They're going to be more hostile with you once they find out about any criminal record. Don't lie to them if they ask you if you have one and you do.

A lot of cops are very egotistical. They got into law enforcement so they could always win. They WILL punish you for anything they consider to be a threat on their fragile egos. They make the good cops look bad as well.

In Australia, at a DUI stop you get pulled over and get breathalyzed and action is taken according to the blood alcohol %. if it is 0.05% or over the you get charged for DUI. Apart from that there is no bullshit hassels from Australian police unless you behave like a real dickhead. A couple lawyer friends advise saying to much to the police and the police are never your friend, that is their advice.

When the officer says: "I know why you're not talking because [ some load of bull crap ], a great response is, of course, a question: "How do you know officer?". Because he or she was pulling that knowledge from a place where the sun never shines.

What scares people into talking is the fear the officer MIGHT act indignant by your unresponsiveness and say to you, “Okay I’m taking you in! Get in my squad car!”

Especially if their demeanor and comments/questions are offensive/dishonest and unclear, don't lose that anger but use it to retaliate in the sense of expressing yourself as honest and the police as deceiving. Tell them since they want to lie and play games with their words, your not going to feed into it. Express the fact that they are offending you in a way that's not too insulting and continue hacking at their lying. Trust me, all they do is lie, they are trained to deceive. Never believe them even if they're stating facts, there is some sort of lie along with it.

I don't even think those "sobriety checkpoints" are even there to stop drunk drivers (at least not primarily). I think they're there to see if people have arrest warrants or are carrying drugs or anything they can come up with. It's just an excuse for them to find ANYTHING they can and to violate your rights.

Don't think that because police tell those they've arrested that they have the right to remain silent that only people have the right to remain silent. Arrested people are *reminded* that they *still* have the right to remain silent. Everyone has the right to remain silent, before and after an arrest. You don't give criminals the right to remain silent but deny,law abiding citizens that same right afforded to all of us by the Fifth Amendment.

Yes,we get it. Defense lawyers always say "never talk to the police". I've never been questioned about a crime but if I was my attitude is: if I'm innocent...if I know I've done nothing wrong...I'll talk to the police. If it's a minor issue I'll talk without a lawyer.If it's a serious matter I'd probably bring a lawyer along. OTOH,if I know I'm guilty the only thing I'll say to the cops is "my lawyer's phone number is "X"...give him a call".

I was leaving statesville on i 77 headed north back to Va trooper was sat in between trees I had just moved over into the passing lane to get around a slower car I thought I was going 75 but i went by him and he clocked me at 88 mph 18 over what I was charged with was gs 20-141 j1 which is a class 3 misdemeanor if convicted I have hired a lawyer hoping I can get it reduced

I hope everything works out for you. Try to get the fine reduced to a non moving violation. I went 20 over the speed limit in Matthews, NC. I went to court and they knocked my fine down to improper equipment which isn't a moving violation.

The same thing happened to me this morning, I was passing a car going below the limit (70mph) and when I passed the car the speed limit changed to 55mph. He clocked me at 81 mph, I could have sworn I was going 75pmh. What happened when you went to court??

Is this statement true or false? Permissible scope of a sobriety checkpoint Law enforcement officers are permitted to use nonintrusive methods in order to detect impaired driving during a checkpoint. Such methods may include observing the driver’s eyes, observing the driver’s clothing, engaging in conversation to determine if the driver emits an odor of alcohol or speech patterns indicative of impairment. Absent of reasonable suspicion, an officer MAY NOT order a driver out of his vehicle, order a driver to undergo field sobriety testing, or require the driver to submit to a portable breath test. Please note that even if reasonable suspicion of impaired driving is present, a person is never required to submit to field sobriety testing or a pre-arrest portable breath test. Read more here. What kind of advice are you giving us, if a cop says you can't record then we should document the unlawful order. Bologna, we have the absolute right to record the interaction and the camera is a witness that can't be argued. You're an attorney man, come on.

I've seen many videos like this, but in my relatively normal life my interactions with the police would have been made far worse if I clammed up and refused to be reasonably cooperative. This is mostly minor stuff involving my (now adult) kids, routine traffic stops, and the like. I've gotten quite a few breaks and very few books thrown at me.

That doesn't work in Turkey, the car stop scenario, you must answer the questions in a positive manner otherwise things go worse if you refuse to answer if you dont have a lawyer to call immediately or not a PM or someone. Even the lawyer does not help in some situations and they call other lawyers. Sometimes even all of them doesn't work and you don't have an option other than to obey until you're sure that you're safe.

I want to ask a question. I recently had my yard vandalized and I call the sheriff's office. An officer came out and looked at it and didn't do a thing but on getting ready to leave he asked for my driver's license. I asked do I have to give it to you? He said yes! He took it and snapped a digital photo with his cell phone. I don't like that and complained to his Lt and the Lt told me if you don't want to give us your DL then don't call us! My question is, do I have to give my driver's license when I make a call and allow it to be photographed? A rogue cop could get hundreds on DL stored up and could sell the information or use for some other purpose other than intended. It just takes on bad apple. I live in SC.

In my opinion, if asked if you've been drinking, the only thing you should say is "No", then you can go into the "I'm not answering anymore questions" speil. If you refuse everything else, they'll have to go on odor and maybe the appearance of your eyes alone, and the impairment you displayed while driving. Those are not enough to convict you.
