His claim that the mandate after the separation of Jordan left all the rest to the Jews is completely unfounded. The mandate incorporates the Balfour Declaration, which specified a Jewish "national home" (which is not even necessarily a sovereign state) "in Palestine" (which is not necessarily in all of it), while explicitly safeguarding the rights of the non-Jewish population, which can be understood to protect them from coming under the rule of a Jewish ethnostate. At the time of the Balfour Declaration, "Palestine" as commonly understood did not include Jordan (other than perhaps the immediate East Bank, but not extending far east), so the later addition of Jordan to the mandate is neither here nor there; that area was never meant for a Jewish national home, and its separation did in no way clarify matters in Palestine proper. Certainly Arabs in Palestine could not be considered adequately protected by saying they could go to Jordan if they didn't want to live under a Jewish state. Hence the British partition proposal already in 1937. No one at the time thought the whole territory should become a Jewish state by default. The British sought to get an agreement both sides could accept and, failing that and in the face of Zionist terror, ultimately just left. As the General Assembly's partition plan was not binding, the territory still remained under UN responsibility but, without a new trustee, there would have been a vacuum, so war was inevitable. The unilateral Zionist state proclamation had no legal basis whatsoever and Israel's application for UN membership in 1948 was accordingly rejected. Only after the 1949 armistice was Israel accepted and the armistice lines became, by default, the de facto borders. Thus Jordan's control of the West Bank had the exact same legitimacy as Israel's control on the other side. After 1967 the West Bank became Israeli-occupied Jordan and, after 1988 when Jordan ceded its claims to the PLO, it became part of Israeli-occupied Palestine.

His remedy, ultimately, would be to penalize the student whose hardworking and responsible father worked tirelessly to improve his family's future so as to "level the playing field" with a student whose father was not, especially if they are a Black family. This is not an example of undeserved privilege but of how our society should honor and reward hard work and discipline, regardless of the color of a persons skin.

A person who works hard and studies hard and then passes this ethic on to his children and grandchildren often falls under criticism by people like Mr. Wise as having privilege, when it was the hard work and dedication to literacy that is to thank for his and his family's successes. Now take another example of a man who doesn't value education, who doesn't marry the women he produces children with nor take an active role in their upbringing or in setting a positive example for them. He is not making progress. He is ensuring that his children and grandchildren will have a tougher time making progress because he has failed to lay the foundation for them. When we wait three generations and compare the two groups, one a cohesive family, the other a collection of near strangers existing as antagonists and protagonists, we see that inequality exists. Mr. Wise would have you believe that one family has privilege and the other is disadvantaged. He will only attach racism to the difference in outcomes if the successful family is white and the other consists of people of color. What if the successful family is black and the others are people of color? Is racism still to blame? No, it is not. Culture and personal choices are largely to blame. The proof of this is everywhere. It is becoming increasingly common for Asian households to outperform white households in earning and education. Asians place a greater emphasis on education and business than do whites on average who tend to place greater emphasis on those things than do hispanics who, on average, place greater emphasis on them than do blacks. Systemic racism does not exist. If it did, they would point it out to us instead of trying to convince everyone that they have internal biases and micro aggression. Tim Wise is a race grifter..

Big fan of how Professors Conkle and Sanders really broke down the Dobbs decision on a legal level but I didn't like how Madeira's analysis seems too partisan, almost furious. She criticized the Bruen case being at odds with Dobbs but never acknowledged that the 2A is an enumerated right and then whined about McConnell manipulating the Senate confirmation process yet completely ignored how Bork got screwed over despite being an obviously qualified candidate on any objective level. Obviously she probably cares about abortion and is emotionally invested in it but if that's what I wanted, I'd go watch MSNBC. And yes, I know she's the only woman who's answering these questions since Professor Widiss was just relaying them and Ochoa didn't really answer anything until near the end. However, I know I'd say the same if she was a man because I literally stopped listening to male lawyers on podcasts who had the same attitude. I'm here to learn about the constitutional nuance of the topic, not just "GOP bad, Dems good" or vice-versa. In fact, I wouldn't be surprised if Conkle and Sanders leaned left politically anyway. I do want to add that although Roe was almost a 50 year precedent, it becomes a catch 22. Should precedent be overruled when it's young or when it's old? If it's too young, then it makes the court look wishy-washy but if it's too old, are you disrupting a societal reliance on it? I will say however that SCOTUS has overruled cases that were only a few years old and cases that were even older than Roe. Plessy v. Ferguson was older than Roe and in fact the pro-abortion lawyers got tripped up by that because they struggled when to say Plessy should have been overturned. It's definitely a bad look if you say Plessy should have stood for even a day XD But it's also a bad look to say that Plessy should have stayed because it was old. Then there's Lochner which was also decades old precedent that got overturned and it removed a fundamental right to a contract, which is an economic bodily autonomy if you think about it.
