I’m curious how that list was dreamt up, as a 45k a direct support tank maintenance mechanic I just can’t understand why that wouldn’t be on the list , especially because of all those turbine engines we were constantly exposed to. And of course the normal motor pool crap.😎

For my tinnitus claim I was asked if I had ringing in my ears, I said yes. Then they asked me my job in the Army, I was 11C. I was approved.

The c&p examiner cannot use va treatment records that were not done in service. The reason why it never happens is because the VHA and C&P are two different entities that cannot have a relationship. VHA is only to treat the patient not compensate him. The c&p organization handles the money. The VA claims that this is purposefully setup to counter potential bias from the VHA.

The unfortunate part of a DD214 is that they may list your MOS but not your service record, big issue ‘ not only with hearing but stressor rating and others. My 19 months in Nam along with 9 months stateside did not reflect my duties , not one time did I work my MOS . Citations for combat awards finally prevailed but cost years of anguish and frustration…should be a better way.

So if the total occ and soc inpairment box isn’t checked but in symptoms it has multiple 70% and 100% symptoms checked does the Box 3A or 4 matters in this case? Reason asking is because my C&P Examiner checked “Occupational and social impairment with reduced reliability and productivity” but I have a lot of severe symptoms that’s check off in symptoms for 70% and 100%

Who was the ignoramus that put Air Force Security Forces (3P0X1) on the "moderate" list for noise exposure? We patrolled flight lines exposing us to extremely loud aircraft engine noise and A.G.E equipment, for hours on end. This and we didn't wear ear protection because we had to try to hear our radios. The mos noise exposure list needs to be revised and updated. It's obvious that whoever agreed to this list never served a day on an active air force flight line!

out of 11 items in my claim they deferred 7 items and denied 1 item and awarded 1 item. the denial was for non combat ptsd caused by many events while on duty... suicide of friend on duty with his service revolver, (had buddy letters), dispatch to beach where a young boy was washed up who had drowned, dispatched to car accident on base, drove one body to er thinking he was passed out due to no available ambulance and found out he was already doa.. a chopper crash between islands in okinawa my friend died in china sea and i was on standby to catch a ride back.. it is hard for me to understand how the va could not connect that to non combat stressors.. I think it might be worth appealing with attorney but still have deferred mental health disorders , etc. confused confused. QUESTION how can i see the dates the decisions to defer were made, wondering all on same day, is that possible

So, I was awarded 100% PnT for Pact Act claims today. I filed July 2022 and I think they made a mistake for back pay and dating my award. The Chronic Rhinitis at 10% is dated 2022 but the Sinusitis which is a pact act claim at 50% is dated June 30 2023. I have to appeal this right? Or file a supplemental form For the back pay? I was currently at 90% and if they would've given the Sinusitis the same effective date I would be 100% as of Aug. 10, 2022. Look at the wording on my decision letter. Are they wrong or am I wrong? Chronis Rhinitis WE CONSIDERED WHETHER YOUR CONDITION RESULTED FROM A TOXIC EXPOSURE RISK ACTIVITY (TERA) IN SERVICE. THE EVIDENCE OF RECORD SHOWS PARTICIPATION IN A TERA. (38 U.S.C. 1168) THE EFFECTIVE DATE OF THIS GRANT IS AUGUST 10, 2022. SERVICE CONNECTION HAS BEEN ESTABLISHED FROM THE DATE OF THE LAW CHANGE ALLOWING VA TO GRANT THIS CLAIM. WHEN A CLAIM OF SERVICE CONNECTION IS RECEIVED WITHIN ONE YEAR AFTER A CHANGE IN LAW, AND ALL THE REQUIREMENTS WERE MET FOR A GRANT ON THE DATE OF THE CHANGE IN LAW, THE EFFECTIVE DATE IS THE DATE OF THE CHANGE IN LAW. (38 CFR 3.114, 38 CFR 3.400, 38 CFR 5110) AN EVALUATION OF 10 PERCENT IS ASSIGNED FROM AUGUST 10, 2022. Chronic Sinusitis WE CONSIDERED WHETHER YOUR CONDITION RESULTED FROM A TOXIC EXPOSURE RISK ACTIVITY (TERA) IN SERVICE. THE EVIDENCE OF RECORD SHOWS PARTICIPATION IN A TERA. (38 U.S.C. 1168) THE EFFECTIVE DATE OF THIS GRANT IS JUNE 30, 2023. SERVICE CONNECTION HAS BEEN ESTABLISHED FROM THE DAY VA RECEIVED YOUR INTENT TO FILE (ITF) A CLAIM FOR COMPENSATION. WHEN A CLAIM OF SERVICE CONNECTION IS RECEIVED MORE THAN ONE YEAR AFTER DISCHARGE FROM ACTIVE DUTY, THE EFFECTIVE DATE IS THE DATE VA RECEIVES THE INTENT TO FILE WHEN A PRESCRIBED FORM IS RECEIVED WITHIN A YEAR OF THE ITF. (38 CFR 3.155, 38 CFR 3.400) AN EVALUATION OF 50 PERCENT IS ASSIGNED FROM JULY 27, 2023. Why?

So if I was seen and they checked the "total social and occupational impairment" box on my DBQ. I also was taken to the ER and hospitalized for suicidal ideations about 2 weeks prior. I tested really high on the PTSD questionnaire as well. I'm at 70% for PTSD currently. My doc said I also have a probable TBI with no evidence, anxiety, depression, inability to establish and maintain relationships, and memory loss issues. Do you think they would bump me to 100% for that?

13B (artillery) and denied hearing loss but SC for Tinnitus. Submitted supplemental for hearing loss three times in 2023 and denied each time. Denial letter says I need a nexus letter to connect current hearing loss to service time. VA acknowledges that I have a hearing loss and an event occurred during my service.

I was an HR guy in an FA BN for 8 years. I was a good shot. For that reason, I was made a unit Armorer. I trained troops in CQC tactics, was on a PSD team, a QRF team and was a squad leader for a maneuver element (mounted/dismounted). Patrols hit several IEDs with at least three directly on the truck, a couple of TICs while looking for weapons caches, HVIs, etc. and clearing villages. Loud exposures for 3 back to back deployments. I’m worried about fighting the VA for the tinnitus C&P exam I have coming up because I’m “just an HR guy.” Hopefully they will see my CAB as a form of supporting evidence. Anyways, You asked for a story. There is mine. Thank you for all that you do in getting this info out!

Out of military 51 years before I filed my first disability claim for tinnitus in January 2023. MOS was 13A10 Artillery and was given 10% tinnitus. Also claimed hearing loss but was denied. Fighting to get a SC on hearing loss. In November I filed a supplemental claim with new evidence for hearing loss with ENT notes and Nexus letter saying hearing loss is because of service-related artillery, and also have diagnosed vertigo from my ENT. Only hoping that I at least get a 0% SC for hearing loss. From what I have read, my expectations are low that I will get the 0% for hearing loss.

@@amiepizzica6145 I received another denial from the VA on April 4, 2024. Frustrated and disappointed I just filed the denial letter away and then walked away from the entire VA process. Needed some personal time to just vent and not think about the VA and trying to get SC for my hearing loss and vertigo (BPPV). At this time, I have decided to just let this go and not pursue it any further. I'm at 20% for an ankle injury and tinnitus. The extra money I would get for the hearing loss and BPPV is not going to make any significant change in my life monetarily), so it is best I leave this stressor on the back burner. After being discharge 51 years ago, I'm happy and satisfied with my life and what I've accomplished. The 20% SC I received last year is just an unplanned annual Christmas gift for my service. Here is a summary of what the VA opined: Service connection for benign paroxysmal vertigo (BPPV) is denied. Service connection for benign paroxysmal vertigo (BPPV) as secondary to bilateral hearing loss is denied. Service connection for benign paroxysmal vertigo (BPPV) is denied. I provided new documentation from my ENT stating that my severe hearing loss is the result of my time in the military and exposure loud noise caused by artillery. He also diagnosed me with BPPV. Based on all of my new medical information, The VA again said, "because my service records do not contain complaints, treatment or diagnosis for these conditions, the evidence does not show an event, disease or injury in service". Also, the evidence does not show that BPPV is related to the service-connected condition of tinnitus or the non-service condition of bilateral hearing loss, nor is there any evidence of this disability during military service.
