Another issue is, who's egg did the surrogate get pregnant with? If it's her own then she's under no legal obligation to hand over her own child in the same way as if you get pregnant and decide to give the baby up for adoption and then change your mind. If you are carrying your own genetic child usually the mother has no obligation to give it up.

I empathize with both parties, on one side the surrogate mother is carrying the child and having doubts (and i don't blame her), while the couple is longing to have the baby (its very easy to judge them though, but who are we to judge?) this is their lives that they have chosen whether or not society accepts them, which they will most definitely not with their backstory and age gap!
