Amen! Awesome brother! Thank you for this. QUESTIONS: What if you own another home out of state, and what if you are away from your primary home but needing to set up the POAs and Trust? My parents are at their small cottage in NY state for the Summer, but their primary home is in TX. Mom has dementia (incapacitated, but not yet legally declared so); Dad's health is declining, but he's still capable. Dad wants to know if there is any way to get the POA's done while they are still in NY. He wants me to have full agent authority immediately. I'll be visiting them in NY state soon for a couple weeks. Do it then? Thank you so much!

Hi Edmund @treeoflifelawfirm, Thanks for educating us. I'm grateful for your help. I have a specific question about listing assets in the Living Trust Schedule A. If the trust is a beneficiary of an asset upon death of the grantor, would I list that asset in Schedule A? For example, California DMV allows a very easy way to specify a "Transfer on Death" (TOD) beneficiary for vehicles. That beneficiary can be an individual or an entity such as a trust. Rather than changing the current ownership of my vehicles to the trust, I am simply recording with the DMV (for $10 per vehicle) that the trust is the TOD beneficiary. I have a few other assets like retirement accounts where I have listed the trust as a contingent beneficiary. In all these cases where the trust is a primary or secondary beneficiary, should I list those assets in Schedule A? I am asking because the trust is only a beneficiary not the owner of those assets. I live in Dallas, Texas, with my parents. I'm a disabled adult, and my parents are my primary caregivers. I have a few questions 1. My dad is the only one on the deed. Should he add my mom to the deed now in case something happened to him? They both are in their early 70s, and he bought the home in 2002. 2. Should they then put into a Lady Bird Deed so it can transfer upon death to my children. Since im disabled they want to leave the house to my children because I'm assuming they can't leave it to me since I'm on Medicaid and receive long-term care at home . What do you think? Blessings

If using one of the online services, Law Depot or another, for peace of mind you could take it to an attorney for review. Another thought is to go to your state's Revised Statutes on Trusts and review them to ensure the downloaded documents are up to date. Edmund, I came across this video by chance and will be taking your class. I think what you're doing is wonderful and thank you greatly for it.

My husband purchased an old house on auction and bid it and won. He was so elated because the house had a 2 car garage where he could house his old cars. He did nothing to Improve house. I had a new roof put on and new windows Which I am paying on. When he died I had to get paper work to put in my name solely The house that he bought with his credit cards only had his name on it. I do not want to go through Probate. We own property in NY state the spouse gets 100% if there are no children. I do not want to go through Probate here in Minnesota for a house . I want the privacy do not have . If I have a Living trust can I add house to it so I do not have to go through Probate?

I have a question: My mom own a paid off house and she put me as the only person on the living trust. Now if she sold the house and buy a new one right after that. I know the living trust name will carry over to the new house for propertie tax, Nothing change My question is does she have to go to the lawer office to let him update the Schedule A in a living trust with a new house info? Because right now the Schedule A of that living trust still have old house info (the one already sold) In the case that she have to update new home info for Schedule A, she just have to deal with lawyer for him taking care of it, or she have to ask the lawyer update to the county as well?

How can we keep the county from trespassing against our will, in order to send us a higher property tax bill? This home they ignored the signs and we expect that to happen again. We bought a home for 87K because that's our entire savings, we need out of this Mortgage we are behind on.
