Actually Pennsylvania vs Mimms says a law enforcement officer can order any occupant out of the vehicle for officer safety if the following can be found as reasonable factors (if the occupant poses a potential threat or danger or the occupant has been visually identified as someone who is known has a criminal with relevant history). Outside of other circumstances like (drugs, guns, open containers of alcohol and etc in plain view) the Penn vs Mimms case law DOES NOT afford officers universal authority order anyone from a vehicle. The aforementioned legal precedent must be applicable in every scenario. Or the removal from a vehicle, the extended time of the traffic and the temporary seizure of person items and the person themselves could trigger a 4th amendment violation.

The same rule extends to passengers of a vehicle after the SCOTUS reviewed Maryland VS Wilson (1997). Now.... some states like New Jersey require Officers to have some sort of reason to have passenger out of the car. It does not have to met reasonable suspicion though.... NJ calls it the height and caution rule. Fortunately, Florida does not apply this. Florida recognizes the SCOTUS rule for LEOs to legally order drivers and passengers out of a vehicle for any reason. No probable cause or reasonable suspicion is required. This has been review by the SCOTUS and that is the law of the land. If there are drugs in plain view, that falls under the plain view doctrine which gives officers the authority to order drivers and passengers out of their vehicle as well as search them and their vehicle without violating anyone's fourth amendment rights.

@@NexVex Both of you are right. Pennsylvania vs Mimms does not require a criminal element to be present such as RAS or PC to order an occupant to exit. There has to be an element of danger and that is up to the officers discretion. That could include a weapons check, stepping away from a busy roadway...ect Without PC or RAS the search at most can be a patdown/weapon check but not a search. If any criminal element exists such as PC or RAS then Pennsylvania VS Mimms no longer applies.
