I find it really sad that at the most desperate times in people's lives they have to consider making the judge happy as opposed to just presenting their case.

That's a sort of oxymoron. Judge's feelings and emotions should not be part of any legal matter - ever. That's why they are supposed to remain impartial.

The fact that a judge's whimsical attitude and beliefs are so much a factor in whether or not you get to parent your children is a MAJOR flaw with family courts. The same facts presented in different courtrooms can yield totally different results. It's a joke.

Have you ever appealed a decision that was made by a judge on the grounds that they made such a decision because they were angry at a certain party? I mean it seems a bit unconstitutional to deprive somebody of life liberty or property just because the judge didn't like their "uncooperativeness" when all they were doing was sticking up for their rights

Judges should not be "punishing" when they hand their decisions down.

It shouldn’t matter if the judge becomes angry or not. They are to be impartial. As a matter of fact they shouldn’t even have the appearance of being partial or they lose their immunity.

Judges need to be held accountable to the system of law rather than being the unchecked Gods that our system has seemed to make them. It really sounds like basically if you are a man there is a good chance the Judge will just not like you and if that is the case you are screwed.

I Wendy, so excited that I found you I just needed a little advice. My boyfriend has been divorced for about 2 years and his ex wife now has primary custody. At the time she lived in Elko but now lives in the same town as us but failed to let the state know. We are now going against the courts custody because the mother can't find a babysitter and is in online school full time plus a full time job. That being said it is completely okay with us that the child is spending more time with us but she sees her for maybe 4 days tops out of the month, those days she is still with a babysitter or her younger brother because her mother works but she is soon moving back to Elko to do a hands on program for school... that being said we are worried her mother will not have the time for her child but she refuses to agree on letting us keep her during the school year. My question to you is if it's worth going to court for another agreement on custody. Other little things we maybe able to hold against her is stability. Within the last 2 years her and the child have more around maybe 6 time, the mother constantly has other males around inviting them into her home, party's she's had with the child home. On top of all of that we are paying child support but completely support the child. The child also has a new sibling with us that we hope she can grow up with.

Hi I find your videos very helpful. About a week ago I suddenly was served Family Court papers from the Police with a Temporary order of protection and a family offense of Aggravated Harassment in the 1st or 2nd Degree. I was flabbergasted. I continued to read the Police report made by my estranged wife. We have an 11 month year old daughter named Josephine Luna Cahill. In her report she made many false claims and gave the court false information about my convictions and statements. At first I was stressed and upset. I couldn't even look at the papers because my heart was broken. It was random. Everything seemed to be going fine as far as our co-parenting relationship. I have a Police report of my wife attacking me while breastfeeding back in September 2015 when our daughter was first born. Which my wife had lied about in the Police report she recently made causing me to not see her or my daughter until I find out what happens in court. My estranged wife already has a history of lying to the court about us being married. She had told them that we weren't married at first and didn't show up for our original family court hearings last Fall and Winter. Now that she made this false harassment claim she states: "we were married" I have yet to been appointed a lawyer and tomorrow I plan on going to get a lawyer. I was happily living in a apartment before all of this happened with my girlfriend right before this family offense hearing came about and my wife used my daughter to lure me away from my girlfriend and apartment convincing me to sleep on my sister's couch promising me a relationship with my daughter. As soon as I'm homeless, jobless, and single This harassment claim pop us and a temporary order of protection. As of now I'm working on getting a lawyer before I go to court 11 days to be arraigned. My spouse is 21 living with her Mother and I'm staying at my sister's house reunited with my girlfriend which I plan to marry one day although I live at my sister's separately for the time being until we can get a new apartment. I know that there is no way that she can prove any claims of me harassing for that the statements she made were completely fabricated. Judges are just like other people despite their legal education. They bring their personal story and biases to court like everyone else. Be good if lawyers could had a complete list of the judges in their district, their personal leanings, political stances, any bazaar rulings, and other red flags. With that, a lawyer could prepare, and most importantly, prepare their clients before they walk into a court room. If not, then there's really no strategy when it comes to preparations.

The parent who lost custody is seeking domicile parent role but the petitioner is stating that it is a liberty interest that before the child is removed from their home, proper evidence needs to be provided as well as evidence that proves the petitioner to be unfit. The child has resided with petitioner since 2014 when the defendant originally lost custody.

If the children were in an abusive environment and dad needed sole decision making to keep them safe, the matter should have gotten transferred to a different court that manages child abuse. There is a lot more due process in those courts than you have in Family Court, where the only objective is to kiss the judge's ass. The dad should have pushed it to trial and use child abuse statues to back his case, and appealed to a higher court if the children were still in an unsafe situation. This is HORRIBLE advice to have parents cave in to the whims of judge. Awful awful. This is why we have a family law crisis in America.

Currently, I am in a high conflict custody battle with a narcissist, I am representing myself as well because I am a full-time college student. I just so happen to be studying to become a mental health counselor. Having written numerous essays thus far on narcissistic parenting, ADHD, TBIs, and mothers with mental illnesses, I as well as the Judge (I presume), am absolutely disgusted about the request for sole custody. With the amount of "research" attorneys do, you would think that some of that time would be spent on researching the positive impact parenthood has on mother's with a mental illness.
