There are several legal steps to take care of that will allow for a smooth transition of assets, closure of accounts, and finalizing of an estate.

You should do one of these lists for losing an elderly parent that didn’t plan Anything and didn’t have much worth anything.

My mom just recently had to go through this with her own mother. There really are so many steps that you don't even realize! This is so helpful!

Don't forget to pay the homeowners insurance until the house is sold & pay the house taxes, water, electricity, etc.

Hopefully the parent(s) have a trust. Things go so much more smoothly with a trust. It doesn't cost that much when all things are considered....

My grandmother and her common law passed. They were my legal guardians. And our family was always told that the house was going to me. But when they passed the common laws brother and sister who I’ve met once in 33 yrs came in and said the house is theirs the brother is the trustee and are trying to sell the house on me even though I offered 200,000 right off the bat so it don’t leave my family. They are refusing to show prof of the will stating this refusing to give me numbers they refuse to give me appraisals, market rate, etc. I’ve been trying to use the equity from the bs family price their gonna give me. Is there anything I can do? What happens if they sell this out from under me then after probate it was givin to me after all? The original copy of the will disappeared as soon as they died.

Hi Tyler, this is a very tough situation. Your steps start with hiring a lawyer in your state to answer these questions. If there is no will, then the house will go according to intestacy laws (default laws) in his state. Without a will, it must go to court (unless there are co-owners of the home) and you should be involved in that probate to make sure it is done fairly. Again, this is a question for a probate litigation attorney in you state.

My parent died and I cannot get any information about any portion of the fiduciary accounting. What should I do?

Would need a little more information, but if it is an account that is in a trust and managed by a trustee, the trustee is typically required by state law to provide beneficiaries (meaning those entitled to inherit) with information. If you are a beneficiary of the trust, then you should write the trustee a demand letter asking for information. If they don't provide it, then you would have to petition a court to require the trustee to provide it. If this is just an account that was held in the decedent's name, then it will go to whomever is listed as a beneficiary and if you are not listed you would have no right to information. Also, if the decedent died and had no beneficiaries, the institution is not required to give you information unless you file a probate and become a personal representative of the estate.
