So let me give you the situation here. This guy turns up at your property, shows you no ID, refuses to show you a warrant and refuses to leave. I would have put this goon in a full nelson until he passed out.

Had a visit from a major debt recovery firm. They were looking for my neighbour so why did they bother me?. The debt recovery agent made threats to attack me so i told him my neighbour new post code he drove off. About 20 mins later he return screaming abuse threatening me , to cease my car ( odd as i aint got one ) he shouted did he think i was smart ...id sent him to cemetery...i replied yes thats right she died a week or two ago her funeral was yesterday .

Ive since found out from the next of kin of my deceased neighbour that they recieved visits. But it seams in law the debt dies with the debtor ... in any case her estate was valued at just £ 3000 .infact the family had to fing another £4000 for her funeral and burrial

Contact the original lender and come to an agreement to repay the loan, they cannot refuse a reasonable attempt to repay. Once that is in place the Bailiffs are left powerless and out of pocket. They will try and recoup their fees but they don't have a leg to stand on.

ALWAYS have a full list of items in your property fully detailed with serial numbers etc .Then make it into a receipt of sale .Signed, dated and witnessed . Then have a detailed "rental" agreement showing you are now renting it all for a sum of £3 a month .Copy to plod and bailiffs etc .Thats them fucked as you can prove nothing BELONGS to you . Just make sure who ever you "sell " it to does not have any debts etc !!!!

Clearly untrained as a bailiff. His implied right of access was revoked. Anything he did on the property thereafter was invalid & he was tressspassing any coming back to the property would make it aggregated tresspass which is a criminal offence.

Pretty sure you don't need a wet signature (this is being written in 2019) anymore. But the digital warrant still needs to be signed electronically.

"On the matter of ‘wet ink’ signatures, Rule 109(3) of the Magistrate Court Rules 1981 states: “Where a signature is required on a form or warrant other than arrest, remand or commitment warrant, an electronic signature incorporated into the document will satisfy the requirement.”"

An electronic signature must be a facsimile of an actual signature, not one using one of the True type fonts or Adobe fonts. There must also be the full name of the person signing it on the document. This means that the person signing the document takes responsibility for the documents and the subsequent results.

That bailiff said he would defend himself. I had a bit of trouble with kids from off the estate damaging my fence well not just mine quite a few of them. I turned my outside tap on and gave them a good old soaking the police said "well done"

As you may have guessed, yes, I'm from Australia, from the first word "G'Day", short for "Good Day", Y'know, kangaroos, meat pies, holden cars, AND politicians who are NOT performing to the "Will of The People" and all that!... I've just googled "PLC" regarding "Marstons Bailiffs", and here is the result: "Marstons Limited Liability Company" (LLC) "A limited company grants "LIMITED" liability to its shareholders and, to a "LESSER EXTENT", its management. Being a public company allows a business to sell shares to investors in order to raise capital"...May 4, 2019. LIMITED LIABILITY: The basis of limited liability is that all debts incurred by a company are the company's liabilities and are not directly the legal liabilities of the shareholders or of the directors of the company. The company is a separate legal person from its shareholders and the directors. I don't know whether this is in any way helpful, but it seems that these bailiffs and private debt collectors are merely collecting monies for the benefit of shareholders, and NOT the people... I just wonder how much bailiffs get paid in the field?...or are they paid on commission? Don't worry, I'm also researching rules and regulations here in Oz too...

That is not a legal proof identity. Anyone can produce one of those. What needs to do is show his high court signed (in wet) certificate. They both failed to do so, therefore their actions are illegal.

Paying the council direct after the bailiff is instructed Pay the "amount outstanding" to the council by cheque by post, and the enforcement power ends. If the bailiff has taken control of your goods, the amount outstanding then includes costs paid by the bailiff for taking your goods - "costs" The Law: Paragraph 6 of Schedule 12 of the Tribunals, Courts and Enforcement Act 2007 (the 2007 Act) states: 6(1)For the purposes of any enforcement power the property in goods of the debtor ceases to be bound in accordance with this paragraph. 2)The property in any goods ceases to be bound- (a)when the goods are sold; (b)in the case of money used to pay any of the amount outstanding, when it is used. (3)The property in all goods ceases to be bound when any of these happens- (a)the amount outstanding is paid, out of the proceeds of sale or otherwise; (b)the instrument under which the power is exercisable ceases to have effect; c)the power ceases to be exercisable for any other reason.

The police frequently refuse to give enforcement agents a penalty notice for traffic offences. I have seen them park on a pavement and on a single yellow line. The police excuse was that it was up to the local council to issue the ticket. This is a lie as these are traffic offences, not local council parking offences. These must be enforced by the police!. HAHAHA.

This is a High Court warrant that last for 99 years on your credit file that affects you credit rating you cant even get a mobile phone even employers now adaya look at your credit ref to see what kind of person you are and if it shows that you have a high court warrant against your name they will not employe a person that cant even pay his debts to the highest athourty in the Land. Brilliant, lets none of us pay our bills or fines and when the bailiff turns up be a smart arse and put it on youtube, who likes to pay bills but where will the world be if we all adopt this smart arse attitude, who's to say this is not related to a fine for having no car insurance, all you lot praising him on here would be the first to start crying if your car was damaged by a non insured driver or you were injured by one, no water through the taps because no-one will pay the bill, same with gas elec etc etc
