In florida, it doesn't matter how much time you spend with the child. What counts is who's home the child sleeps in. In other words, you can spend 16 hours every day with the child but if the child sleeps at the other parents home then the court sees it as you spend 0 time with the child and you will pay a lot more child support. This info may come in handy for anyone who works the graveyard shift like i do

@Gisela Irias if the child is alternating weeks then I would assume the number of nights spent with each parent per month is equal. So in terms of custody time for each parent, it is 50%

It is a LONG process. I filed for enforcement and it took a year to establish the order.

So then how do you stop a waste of life that steals from you when they say your never there but your always working so many COUNTLESS hour's that your literally never able to eat or sleep much and the income your making doesn't even cover you due to the area your in and the job market that effects how much your making which like I said isn't even enough to afford anything maybe rent if your lucky lol no phone or car payment and have to us a downtown library to get internet !. Does that qualify as scrutiny ?_?. Just curious ?. Because that's the way were headed in life !. Never able to get what needs to be done losing your contacts family friends and losing all of your possessions !.

Does the custodial parent also receive the interest accumulated on child support? I'm wondering because records show arrears and interest were both paid, I received the arrears but not the interest.

Are you sure he is the correct sperm donor? I'm pretty positive that a 3 or 4 month old fetus will not survive outside the mother's womb. Maybe you got your dates wrong? How much did your baby weigh?

I wonder what I can do child support is after me. I am a male I have been diagnosed with pancreatitis five years ago from that time I have never healed from it actually other organs are now affected. I do not have insurance the child support court is hammering down on me ordering me to get a doctors note with a date of when I was sick and when I will get better. This is absolutely ridiculous there is no telling if I will ever get better. Also not having any insurance no one‘s going to do a CT scan or an mri on me that usually cost around $12,000 to look inside and see the organs again. I’m a true fact is I am no longer able to do manual labor they suspend my drivers license in New Orleans even though I’ve been a resident of Florida for about 15 years in Florida said that they were going to contact the state of Louisiana along with the Department of revenue and have my license given back. They never kept her word and I’m still fighting for my license back I live in the middle of the country so there’s no buses to go to work even if I could go to work and when I try to explain Explain that to them they told them that is my problem. The child support system is broken I am very unlawful and unjust to my rights and toward the constitution. I do not have the right any more of freedom and independence or the pursuit of happiness because I am being enslaved and cornered under a contract of state law. And to make everything worse A couple years after the judgment was put up on me I brought all the evidence showing the child never lived with his mom and he never was raised by his mom. She never had custody of him the judge told me that she wasn’t even going to look at it because it was a relevant to the case and I was going to have to pay all the child support no matter what.Also my kid is 22 years old and he does not live with his mom anymore or me anymore and he does not go to school. And I O several thousand dollars in arrears

I live in FL. My husband cheated and a child was born in 2017. During this time my husband was receiving SSI . He was on SSI from 2017-2019. His first official day of child support started 3/1/2020. But the state added back pay up to 24 months. The child mom applied for public assistance which started the case. My question is, is it legal to calculate back pay during the time he was receiving SSI?

Yes. They can order it even if he’s on SSI but they cannot garnish child support deductions from social security benefits. I’m not a lawyer, but I do know this is true.

Not necessarily true. They were taking payments out of my dads monthly ssi payments. He didnt request this be done.

If it's on a petition solely for child support than you cannot. However, there may be exceptions.

Is there any way to legally force a mother to pay child support? So I am going to be turning 18 soon, my mom and dad got divorced a while ago and my dad got full custody, and since that she may have paid a few child support in the beginning but at very least she has not paid child support for the last 5 years, is there any way to get her to pay child support or have her face consequences or should I just do what my dad says and "don't bother with her it will just be a pain in our ass"? (Also in the time since then she has less than 48 hours combined visit time with me possibly even less then 36)

What about disabled vets, who also collect ssdi? What happen to our child support, will it change or does ssdi get me off of paying the ridiculous amount?

It depends on the facts of the case, but if your ssdi is less than the amount which you were originally made at the time of the support order you may have options. Can someone sign your name on a birth certificate without your consent , and I was put on child support without paternity even being established, I was told just this is illegal? But this is what was done to Me and had caused my life to be hell

The law differs based on whether or not the Mother was married at the time of the child being born. If someone else signed your name, that is fraud and you may have options to address this issue. If this is a matter in Florida please feel free to call our office and schedule a consultation.

a man I was with almost 7 years cheated on me and had a baby with another woman, and i did not find out about her until a few months ago. he managed to hide the woman and baby from me for almost 2 years! she put him on child support and he pays her 600 a month. Our 6 year old gets 251 a month, but after finding out about her I broke up with him and filed for a modification. My support case was first, yet she got more money than my child. Unsure of how that happened. What can I do to get more support and get hers lowered down? A subsequent child should not get more than a first child right?

@@siciliabelluccia4582 yeah it was because the court in her county didn’t know about my case. I’m in another county. I filed for modification and mine got raised to 1275 and hers got lowered to 50$. Because my child had a support case first. She’s kinda mad now. But IMO it is her karma she shouldn’t have been a mistress to my baby daddy knowing he was still with me.

I have an unusual question which someone might be able to answer. If I was to marry a woman in Florida who already has children from a previous marriage would her child support from her previous husband come to an end and therefore her children become mine and her responsibility financially?

You cannot be responsible for her children unless you formally adopt them.

No the order will stay in effect. The children are still his children and 1/2 his responsibility.

The FLORIDA Standard for calculating CHILD SUPPORT the STATE-aka Chile Support Enforcement Agency; Has established the base amounts to be $110,000. Per Child-over that chiles lifetime. SO once someone ( any Man within the State of FLORIDA) has been roped into the Child Support Circus- HE will be expected to pay out at min. $110,000. For each Child. No matter how old the child is. The Father will be expected and forced to pay continually for the rest of HIS LIFE. BTW.... That money $$$, does not go back to the mother of his children. All of those monies being stolen through every means possible by the FLA DoR are kept by the DoR. Along with their FEDERAL Subsidies. (yes the state also is receiving $$$ for having collected Child support from innocent people... )

I will never have another child. Worst mistake I ever made in my life. Not because of the child , but because of the laws behind children that supports the custodial parent. It's legalized stealing!!!. Make both parents pay a fee and make both parents require a certain amount of time with the child. Simple. But Laws in place just wanna see money and not support the child even tho it's called child support... Sad. Your law firm is part of the problem. I fully agree that non custodial parents should pay child support and I feel for a majority of (women( that are getting the short hand of the stick. Unfortunatelyas there unfit women in America abusing the child support system for their own self agendas especially those with criminal records. Those bleeding the welfare system, Medicaid, wic, housing and still stealing child support from the children should be "locked under the prison"

Because as a tax payer, who is not on assistance, I have to pay for all the stuff you get for free. You didn't ask the government to help you have sex to create a baby you couldn't afford to support. Grow up! Get a job and start being an upstanding role model for your child.

Indeed help never took a paternity test but I have been paying child support but mother gave up rights also the lawyer I had had me say I give u,p rights to a child never signed birth certificate why I'm I paying he stays with his grandmother she keeps running to court to get more money now she is taking my social security and using my military benefits how can I stop this my life is a living hell

There are alot of biological parents parental rights and civil rights, that are being violated. Alot of biological parents, syblings, and other family members, have been alienated from the child or children. Alot of biological parents, are being blocked from visiting their child, due to a custodel parent, adoptive parent, or legal guardian, who are domestic violent abusers and violent crimminals themselves, who create a negative and violent environment for the child and the non custodial parents. So there are many reasons, why the non custodial parents do not have time with their children. If the courts don't enforce the childs visitation rights, them children, are not given a fair opportunity, to learn and be familiar with their other parents, syblings.

If mother left the home and father was taking care of child for 4+ years paying everything, dr visits, school etc. before paternity was established can the father once paternity is established in court get retroactive/back child support for the full FL allowed 2 years? Also when child is born out of wedlock the hospital should have to present paternity forms when the birth certificate and all other paperwork is done as well as explain to fathers the laws about children born out of wedlock. I also find it extremely unfair and against the whole “equality” movement that a mother can have an abortion and eliminate all parental responsibilities and financial by having an abortion, fathers have no choice but to pay child support even if they don’t want to, it should go both ways. Equality should start in family court because it’s all about making a dollar not the child.

Why would a parent not want to pay child support and help give their child the absolute best life they can have. They are 1/2 your child why do you feel you shouldn't be held accountable for helping take care of (support) your child? It's not the custodial parents responsibility to be burdened with this alone. Do you have any idea how expensive it is to raise a child. Don't have unprotected sex if you don't want the responsibility of raising or helping to raise a child. Better yet don't have sex unless you are married. A child is not a thing. They are people just like you and I. They require certain things to live their best life and prosper. Wouldn't you want that for your child?

@@alwaysright237 it's for the child's best interest, period. I know exactly what I'm talking about. Go ahead and be on assistance, if you get on SNAP, the state steps in to mediate or enforce an agreement between the CP and NCP. Say the NCP isn't paying because they are on unemployment. The state cannot enforce. But when the NCP returns to work, they are supposed to comply with CS and report the new employer. They then 1) pick up where they left off with payments and 2) pay arrears. You see, I actually work for the DOR Child Support Division. With that said, alllllll of this is because EVERY state, equally feels that even THOUGH CP'S and NCP'S can't get along, or NCP'S run off, or grandma gets the kids...WHATEVER the reason..they need to interject and enforce because children should not suffer because the parents didn't work out.
