Hey Phillip I just submitted my nexus letter from Paul Dennis as well for OSA secondary to Rhinitis. How long after you filed did you receive a decision letter service connecting you? I’m curious It’s been 7 weeks since I filed.

@@reggiegardner9188 Ten days after I filed I had my C&P exam then ten days later I was approved. Total twenty days, very fast for the VA. Typically most claims take 3 to 4 months.

I was just rated 50% for OSA thanks to Leah's group. Now I'm 100% P&T. The VBA made it secondary to Allergic Rhinitis, just as you did the paperwork for. For some reason the VBA also sent me to 2 C&P exams for the OSA. One with VES and the second with LHI/OPTUM. It was a little irritating but the exams went well. The examiners were kind and respectful. No big deal really. Thank you again for your help fellow Vet!!🙂

Thank you for your time and posting. Just a note. Not all VSO's work for you. Make sure you do some homeowork to find one that has a good reputation. My first VSO took my info on three claims, said he would file. Didn't hear anything for 6 months, I called and it turned out he walked off the job two weeks after I was there and NEVER put my claims in. Nobody in that office ever followed up either. Now IMO, I have someone good.

Thanks for all the great info!Persian Gulf War veteran here. Had a sleep study done and was diagnosed with severe mixed sleep apnea before 31 Dec 2021 and prescribed a CPAP machine and therapy. What is the latest on the Presumptive route for SC using the “sleep disturbances” or “respiratory problems” symptoms that fall under the “Undiagnosed Illness” category. I hear/read many stories of denial for sleep apnea - even with confirmed diagnosis/CPAP issuance - under those symptoms. I understand that sleep apnea in and of itself is not a “Presumptive” condition, but shouldn’t it be able to get Service Connection by virtue of it being a “sleep disturbance” which is one of the actual listed symptoms in the “Undiagnosed illness” category of the Persian Gulf War Presumptive conditions? Have you, or anyone reading this, heard of anyone successfully claiming sleep apnea under the Presumptive process? Thanks!

I have seen many many denials and never personally seen one approved although I am sure maybe someone has been. There are usually other factors that cause sleep apnea like obesity that would preclude it from being an undiagnosed/medically unexplainable illness if that makes sense.

Thank you for this video, I'm already service connected for 50% for anxiety and I've been there since 2016. I was diagnosed with OSA in Oct 2022 and I'm unsure about doing a claims for OSA because I don't want to get reevaluated for Anxiety. I'm looking for a VSO or a good advisor to help me.

​@@prestigeveteranmedical The decision letter came 8 days after my official Retirement date a few weeks ago. 50% OSA service connected rating, one of the many ratings on my claim. I am 100% P&T. I use a CPAP, have been for 13 years now.

VAMC in Memphis, TN is trying to tell me they don't know why I was diagnosed 9 years ago with Chronic Obstructive Sleep Apnea. They failed to follow me up when I moved to Memphis in 2018. They camcelled a Sleep Study that was ordered in 2020 during COVID.

Hi Leah, I'm rated 30% for valvular heart disease with aortic insufficiency and mitral and pulmonic valve prolapse aggravated by time in service. Had a sleep test with 70 events per hour. VA Pulmonologist ordered a CPAP which has dropped those events way down. Is this a solid secondary service connect?

Could you answer a question about an award for 50% osa then in the same letter said they subtract 50% because about 3 different reasons that I and my vso don’t understand

Probably because they said it was aggravational and they subtracted the pre-aggravation baseline from the current level which would be a net 0. If your VSO doesn't understand that is a a big red flag. You may want to hire a more competent accredited legal professional

is sleep osa considered a static condition? I am curious to know if they can come back and take my rating without warning if it isn't a static condition. I was rated at 50% recently for OSA after being rated 10% for Tinnitus for the last 12 years. I currently have a claim in for Sinusitis that i am waiting on a decision. Thank you for all that you do.

They failed to reorder the Sleep Study so I kept using my CPAP Machine. I just had a home Sleep Study done and now they want to say I only snore. They don't want to pay for replacing CPAP Machines that are on recall. Mine is on the recall list and I don't use it now. I was advised by Philips Resperonics not to use the CPAP Machine. It is supposed to be replaced. VA doesn't want to pay for new machines.

I was diagnosed with PTSD from the VA and also took a sleep study with them that determined I have sleep apnea. I was then prescribed a Cpap machine (although it barley helps. I plan on filing my sleep apnea as secondary to the PTSD. Would the next step be to get a Nexus from a VA Pulmonary expert?

You can get a nexus letter if you choose but they are not required.

Hello Leah, I was diagnosed on active duty with Sleep Apnea. My original service connected VA rating is 30%. I was given a CPAP machine and have been using it for 7 years. How do I go about getting my rating increased? Where do I begin with the process? I just recently relocated to California from Maryland, so I am just now getting registered with the VA here. I was planning to request a new upgraded machine, but is there something I should request from my Primary doctor during my initial appointment? Please advise. Thank you!

You can ask a legal professional like a VSO to assist you with the paperwork to request an increase or you can do it yourself if you are comfortable navigating the system.

So I was in the gulf in 1999 and was subjected to burn pits and flaming oil rigs. Not to long after that I was given a sleep study and issued a Cpap but it did nothing for me. My apnea was so severe that the doctors were afraid I was going to die in my sleep. I got a Uvulopalatopharyngoplasty procedure done but my sever sleep apnea still continued. With in the last two years I had the Inspire device installed in my chest and throat which has helped, but I am still having over 30 episodes an hour. I filed a VA claim. Curious what the out come will be. Probably get denied like most do. Great video, thank you.

Sleep Apnea or insomnia could be a secondary condition to chronic connected pain...for example chronic knee pain. Research you DBQ'S. Cheers!

Hi Leah. I am currently battling VA for sleep apnea claim. Provided civilian diagnosis w/ CPAP and current symptoms. Condition is due to service connected back injury. Cannot sleep more than 30 minutes on my sides. Submitted claim and got C&P Exam call. Doctor was horrible. Only strict questions about numbers and metrics. Claim was acknowledged but denied due to “service connection” Went for HLR and now my claim was kicked back to appeal due to “service error.” I submitted a buddy statement with appeal attesting to condition while in service (medical answer while serving was always suck it up, get more sleep, or set more alarms. NEVER a problem diagnosis) Now I am awaiting appeal review results. Any idea what to expect???

I conducted two sleep studies while I was on Active Duty and was Diagnosed with OSA ( Obstructive Sleep Apnea) also while serving on Active Duty. I was even issued a CPAP Machine while I was on Active Duty serving my country. However, when I filed my claim with the VA, they Denied it. How is this even possible ?

I was diagnosed with a mild case of sleep apnea while still in service. 12 years later I now have a have severe obstructive sleep apnea requiring a CPAP I Recently filed a claim my question is sense the years have past is this going to hurt my chances of a claim ????

I filed for sleep apnea in June of 2022 due to weight gain caused by my service connected hip injury I was prescribed a CPAP machine I filed an appeal will I be subject to any changes if they happen or will I be grand fathered in the older rules

What do you think about full diagnosis now 20 years later on machine and full atrial fibrillation because of it, no in service diagnosis but have two roommates did buddy letters? Is it possible to get direct connection or would I have to go secondary through Tinnitus?

I do not believe tinnitus causes sleep apnea at all. I do see many veterans connected with buddy letters on a direct basis but of course it depends on the circumstances.

I have to wait to get service connected for sleep apnea hopefully I do just appealed a denial if I do get service connected I will be filling secondary claims my sleep apnea has caused atrial fibrillation and ventricular ectopy which is my bottom heart valve does not work correctly

Good afternoon, Ms. Leah. I have a problem with sleep apnea, The VA Hospistal gave me the CPAP machine which I have been using for quite some time. Also the VA told me that I have Restrictive Lung Disease, which I use 2 types of inhalers to help me with my breathing. I never was treated when I was in the service about this, but my ex-wife wrote a letter explaining how was my sleeping when we were together. I tried to send a claim to VA with all these paperwork including the letter from my ex-wife and VA denied claim. I don't understand...

I Have a c&p exam in a few weeks for Sleep Apnea . Last week I got My CPAP machine switched over to The VA . My private DR prescribed 1 litter of oxygen with the CPAP machine . The VA is getting me set up with a oxygen generator with back up tanks soon .Could This put me at 100% ? Thank You for the great Information in the Videos !!

Hi Leah, first off thank you! I used your service and got 50% for my migraine headaches. I was recently diagnosed with sleep apnea by sleep study. I’m already rated 50% for anxiety/depression and 20% lumbar pain. I take a lot of medications for both mental health and pain meds and muscle relaxers for my back. Can I file a claim for sleep apnea second to anxiety/depression or should I file it second to muscle relaxers for back pain? I’ve been rated for back and mental health for years now. I'm only 80% and tdiu snd unemployable so I'm paid at 100%. Just wondering if I should try to take a chance and get a added claim to make mine 100 %. I have been diagnosed with obstructive sleep apnea. I also have severe degenerative disc disease. So osa would be a secondary condition . How can that be proven to have occurred during your service time? I was active 1/63 - 2/73 and during that time I injured my lower back (L4/5) which was initially rated at 30% then increased to 50% had to have surgery in 82 at VA Hospital a diskectmy L4/5. Overall VA sent me to local Neuro Surgeon and was told my back in terrible shape and would not recommend surgery due to my age 78. After that put in for an increase denied but given 50% Depression also have 10% for feet (near frostbite) in Korea 1963-1964. VA gave me a Sleep Apnea machine and still have sleep apnea but need new machine. Should I ask for SC of Sleep Apnea? I now have a combined rating of 80% Thank you!!!

Happy to hear you were connected for several issues. As far as the sleep apnea is concerned many veterans get SC for this in relation to weight gain related to orthopedic issues and depression but it depends on the individual circumstances. I hope this makes sense.

Nexus letters are never required. A Nexus must be established during the process showing a link between your issue and your service. This can be done for free at the C&P exam. Hope that clarifies.

My 50% was reduced because I received an Inspire Implant which requires intolerance to CPAP (so worse condition). Currently under appeal now for over 2 years.

My C&P examiner did not give an opinion, but noted that I have sleep apnea and have a CPAP. With my claim, I submitted a DBQ and Nexus letter - sleep apnea secondary to ptsd and GERD. The private medical option is that is at least as likely as not aggravated by ptsd and GERD. What will happen if the C&P examiner gives no opinion?

I am also rated for tinnitus and have terrible migraines at least 2 times a week with digestional sickness, light and sound sensitivity, etc. Been having them since end of my military service. I have only taken Excederin for the pain and sleep in dark room. Doctors have not “medically evaluated” me with migraines but I do have them. Should I get it on paper or can I file and get a C&P scheduled for the “evidence?”

Which is easir to connect osa with as a secondary claim rhinitis or obesity from psych meds? I have well documented allergic rhinitis and im a dessert storm vet. (I was in Saudi Arabia in 1991) I havent claimed it yet but I will this week or next. I'm working on the paperwork. I had a sleep study at the VA and have a CPAP. I don't use it as much as i need to. It gives me anxiety because it will blow air in my mask and wake me up. I also have 50% rating already for depression. I get 10% migraines and 10% ibs 0% hemorrhoids I'm total 60%.

@prestigeveteranmedical both are certainly contributing factors. I will list both. When I filed years ago, I didn't get help, and I didn't know what I was doing. I was a Corpsman in the Navy and thought that I knew enough medical. I kind of screwed myself. VA medicine and DoD medicine, even Navy medicine are very different animals. Someone should make a video addressed to military healthcare workers (Corpsmen, medics, even nurses and doctors, as well as other healthcare specialists. When it comes to VA, we don't know anything. We do know how to care for patients, and we have a lot of knowledge, but we gave to remember that when it comes to our own care, we aren't so good. We need help, too. It is not a sign that we don't know patient care if we ask for help with our own. See as you have a health care background maybe you could adrees other military health care workers that no matter how good we are at our jobs, the VA system has a different way. Applying for benefits is administrative and not care. It is different than going to our regular health care provider. We have to switch gear from giving care to navigating an entirely administrative process. Once I understood that it got easier Now I'm trying to get what I deserve. I'm not just listing my injuries and illnesses like a SOAP note. I'm looking at the causes and effects and how they affect my social and occupational life.

I was use awarded a 50% for sleep apnea after an exam by VA. I’ve been at 10% for Tinnitus and 50% for hearing loss. The award letter says my pay amount is now 80% total, so they are only paying me 20% for sleep apnea?? Should I appeal this?

That seems correct using VA math. There are many online calculators that can assist you with looking at that or speaking with your VSO or another legal professional.

Your total of 80% is correct. The VA math takes your 40% that you aren’t disabled and then takes the 50% awarded for your sleep apnea and divides that into the 40%. So in other words 50% of 40% = 20% so your 60% + the 20% = 80%. That’s VA math

I recently got a a C&P exam on 'deferred' sleep apnea, I had a sleep study already. The examiner asked no questions. Except if I had deployed. The DBQ questionnaires was sent to me to fill out. Still no direct questions. is that a bad sign?- (secondary to MST)

So my question is this. I filed sleep apnea secondary to ptsd and i sent in a lay statement, nexus and medical studies. The cnp examine says less likely, because ptsd is mental and sleep apnea is physical. She also says ptsd can aggravate my sleep apnea. I was an aircraft fuel systems mechanic for 18 years. I entered fuel tanks after defueling for repairs. I was experienced a collapsed lung and retrained another career field. I have 0% rating for my tinnitus that i am appealing now, can i still do a secondary Sleep Apnea without a 10 rating for tinnitus??

Hi sir we do not believe tinnitus causes sleep apnea. As far as filling a claim for it that is something you may want to address with a legal professional like a VSO

Hi! I got PTSD and got diagnosed with Mild Sleep Apnea by my private sleep doctor and a cpap prescribed. I want to claim SA as a secondary to PTSD. Should I get a sleep study from the VA even though my private doctor already diagnosed and prescribed me the cpap? I’m 25 lbs overweight which would be a good excuse for my VA claim to be denied.

Just for clarity, I am a disabled(70%) Vet who has a CPAP machine....for the last 7, 8 years. Can I file a claim for sleep apnea?

Well if you are an eligible veteran you can seek service connection for disability many years after service. You may want to follow up with a VSO or another accredited attorney for advisement
