The stepson should be reported to her County Social Services office. This is financial elder abuse and there are laws against it. Also, and I hate to say this, but she’s not safe if he knows he gets the money after she dies; he may not want to wait.

Honestly the staff at Dave Ramsey should report this guy to whatever state he is located for potential elder abuse. It has all the red flags for it and I guarantee it’s been going on since the father has passed.

Reading between the lines I think it's more an issue of he is tired of waiting for the trust and is finding schemes and ways to get some of the money. Let's be honest if your father died and left a trust which you still can't access at 60 years old then what's the point? Get it at 70 years? Most people will access such finds earlier to be able to make use of it not when they are older but unfortunately in this case the trust is tied to when his step mother passes and she is still alive so he can't access it hence coming up with different reasons to at least get some money. I may be wrong but that's how I interpreted this call.

They need to learn how to be independent and self-sufficient. Best to learn in early 20's rather than later in life. The enablers who set no boundaries create the entitlement belief in those who are determined to continue taking.

The father should have left the trust in his name if that was the case or given him some of it in his will. Regardless though asking for $69k is stupid because of taxes. At most $15k a year is good though.

Similar situation with my in laws and their loser son. They have enabled him for 27+ years (he is 48 now) and they won't see how he has put them in poverty. They have no retirement, they kept giving him monthly nearly $2k for that whole time!

The step son knows that the money in the trust is his in the end, so he's trying to get his hands on it now before it gets spent on her health needs over the next few years. If she runs out of money down the road, he will be nowhere to be found/

She has given him money since the dad died. The other brother tried to sue to take what was their home. This stepson is the smooth snake. He WANTS his inheritance and may not NEED it. There is gift tax on anything over 17k per year so no I can’t give it to you because of the taxes.

Assisted living costs an average of $80,000/year. Nursing care runs $100K+/year. Average time spent in care, excluding Dementia care, is around 2 years. [Dementia care can readily last 8-10 years.] NONE of that is covered by Social Security. To get state Medicaid which covers [subpar] care when her money runs out, there is a 5-year lookback rule which checks for any money that has been given away...with a dollar-for-dollar penalty. This woman needs all the money she has left in the trust. Plus, you absolutely know that neither stepchild will be there to help when something "more" serious happens. It will fall to her own children to take her to doctor visits, help her manage her health, do her shopping, pay her bills and arrange caregiving.

My Dad passed one year after my Wife passed, and my Mom and I developed a closer relationship. My Mom just started giving me money. I asked to borrow a few times, but when I sent a check to pay it back, they never got cashed. My Brother was infuriated.

Don't take money from your mother in the first place. Can she really afford to give you money, will she have enough to support herself into old age? Your brother should speak to your mother about leaving a larger portion of her estate to him to make up for all the money you are getting now. This will avoid conflict between brothers upon her death. I am sure she would like her sons to remain connected and not be the cause of conflict between the two of you.

I don’t know that people asking people for money but I do know that we all need to be responsible for ourselves. That being said people that are successful seem to put down the people that are down on your luck and have problems. Why don’t we start helping people instead of just tell him to get a grip. Step daughter here. After I left my ex husband, I had to borrow money from my stepmom. My ex took three fourths of our money out of our joint account. I had $2500 to take of myself and our daughter for two months. My stepmom let me borrow $2000. That was one of the first debts I paid off with the debt snowball. That debt was paid off five years ago. How sad that this 62 year old man doesn’t know how to manage money. When the trust goes to him, it will be gone in six years.

She needs to say, "No." She would be enabling him. He is using and abusing her. He over spends and is relying on her to give him all he wants. She needs to tell him no.

The money in the trust from the late husband is for her to live on until her death. The stepson should have to wait until all of stepmoms debts /medical are paid and she has passed. That could be another 10-20 years. Then and only then does he get anything from the trust. At age 62 the stepson should be able to hold his own fort. Stepmom has no obligation to give $$. She needs to take care of herself first.

I agree, although the timeline is probably shorter, I'd say closer to 10 years. But you never know, she does sound like she's in good health.
