Everyone wants to believe in happily ever after but the reality is that many marriages end in divorce. While we certainly don't delight in the end of a marriage for whatever reason, genealogists recognize this as another instance in which a paper trail is created, leaving clues for our family history research. Join Crista Cowan as she shares what kind of information you can expect to find in divorce records and where to find them.

I’d love to see the updated version of this video. Is there an index for updates? I’ve followed divorce breadcrumbs for many years. About four years ago I traveled to the state/county where my GM was divorced, in 1923. The Clerk was skeptical when I presented my request; in a few minutes, somewhere back in their records room, I heard him shout out, “You hit the jackpot!” I walked away with copies of the of court transcript! I also found a new depth of respect and gratitude for my GMother. She stood up for herself in a time when divorce, no matter the circumstances, was not easy. Two years later, she married my GFather. I was one of many grandchildren who, along with 9 living children, attended their 50th Wedding Anniversary celebration!

My parents lived in Connecticut and got their divorce in Puerto Rico. Where can I obtain their records? It sounds obvious but it was a hush-hush situation so records would be difficult to find.

Hi, Sassy. Thanks for reaching out. We're always happy to help. We aren't able to answer that question with out seeing the record. We have categories on Ancestry called Marriage and Divorce. Could it just be the name of the database or record? We recommend looking over the record to see if you can find the answer. If you need further help, you could send us a screenshot to see if we could make a determination.

What if you have a living relative yet there's no record hits of them. Even though they was born and raised married and give birth in this country as well as have worked and retired and received a pension and paid taxes

Found a divorce record for my maternal great-grandparents on her father's side. It's actually included in a book about divorces in Southern Alabama. It's pretty interesting! In 1913, my GGF moved out of the family home. In 1917, GGM filed for divorce citing abandonment as the reason.. At that point they had been married 22 years. Lawyer described their marriage as "unfortunate." GGM was FIERCE! In the petition, she states that she wanted full custody of all of their 6 kids (this was back in the day when mothers didn't automatically get it.) All of the kids were listed in the petition, including my grandfather who was 16 years old at the time. All of the names matched what was on the 1910 census. GGM also wanted alimony/maintenance. GGF seemed pretty indifferent to it all. He didn't respond to the subpoena nor did he appear in court. So GGM got granted a divorce pro confeso, only to see her "cancel" the divorce nearly 6 months later! GGM had to pay all the court cost, and they were declared as 'still married." They still lived apart until early 1919. Their youngest son died in May of that year, and the death records show same address for the GGPs. On the 1920 census, they show up listed together and living in the same house. Yet, they list GGF as have 2 marriages. Weird huh? That census took place in January 1920, but GGF dies in June of that year. His death record says "divorced" but also "husband of GGM." So basically he was married twice...to the same woman lol All together, they were married 25 years until his death.

might be helpful to put up the subtitles if you find the level a little low. Do you have the vol on max? On the KZfaq app on my computer there is a volume as well as the volume control on my computer iteslf. I'm listening to music whilst reading the subtitles instead.

If a divorce was against the law, at one time, how is it that spouses could legally remarry?

decko cards from what I’ve discovered in my research... they “left” and that was that. I suspect many of us have “poligamist” ancestors. 🤨

If it was a case of desertion, after a certain time period, the person could be declared legally dead. That would free up a person to marry. Also, a lot states recognized "common law' marriages.

@@thegrandmasabrina This is interesting. Thanks for the post as it relates; seems like my grandfather's 1st wife eloped to Australia, (with his oldest brother no less), leaving no note or info as far as I can. tell. My grandmother married him in 1944, but in 1939 records he was still married to his first wife. I wonder how long he waited before he was able to annul the marriage or possibly get her consent for divorce!? This is UK law, but similar I would assume. I'd love to find the divorce or annulment documents but as somewhat an Ancestry noob am struggling.

No back then men often married younger women especially if they were farmers

It's not a matter of the age, but the duration of the marriage itself. If that part doesn't match up, then it may be an indicator one of the partners was married before.
