The plaintiff hired the defendant to make a dress for her New Year’s Day party. She claimed the defendant told her the dress would be ready on New Year’s Eve, but the plaintiff wanted a refund because it wasn’t enough time just in case she needed alterations. She’s suing for the deposit on the dress, the ticket for the party, and pain and suffering. The defendant argues the told the plaintiff it would take time to complete the dress. She doesn’t think she owes anything. She’s countersuing for lost wages.

If the defendant really made those dresses she's super talented. She needs to hire an assistant. Admin is a skill that she clearly doesn't have and as bad as she is manager her calendar and correspondence with clients, she's probably just as bad at money management. Hiring someone would help her business tremendously.

I know and I hate it because I prefer expediency and talking directly on the phone. Text messages (to me) suggest it’s not urgent and can be answered at someone’s leisure and I think I would throw logic out the window and just call people versus getting things in writing, this I hope I never have to sue or be sued lol ETA I guess I could always text after “per our conversation XYZ”

I don’t have one formal dress in my closet since I don’t normally go to formal events so she probably didn’t have a back up dress. It would be hard to prove she didn’t go either way though

The defendant was wrong. She knew she couldn’t do it in that time. On Dec 7th she knew she had other outfits to make. Then she took over 2 weeks to send her the invoice. Also the no communication isn’t a good sign, atleast say something to her.

But if it was super important for her to go and she wanted custom-the judges point was to get it made way in advance of the event. Not last minute. She could have ordered something high fashion and probably had gotten it shipped to her faster if she was going to be so last minute and still have gone. That's ridiculous to miss something cause you can't say its custom made. Now unless the party was based on being judged as for competition purposes, and you stand a chance of winning money, but you had to show proof of the designer-Than I can see her not going.

JM was right about the fact of ordering a custom dress months in advance in case of something going wrong. And, always have a backup outfit from a department store if necessary. Some store dresses are gorgeous.

I’m kinda like the plaintiff lol I probably wouldn’t have went either. It’s so hard to find a dress very last minute. But I also agree on the other hand that I would’ve planned for my dress months before this party and definitely would’ve had a back up if it was getting that close to the wire .

Doug asked the plaintiff why so much texting instead of picking up the phone and calling. Fortunately she did mostly text. It made this case much easier for JM. The defendant was trying to say the plaintiff cancelled, but the text clearly showed it was justified sure to the defendant's poor communication. JM had it right. The defendant bit off more than she could chew!

In this case, the plaintiff is extremely frustrated and upset due to the defendant's lack of communication. Furthermore, the absence of a clear appointment for a fitting highlights poor business practices on the defendant's part. Cancelling the dress order was a good decision, but missing the New Year's celebration was not. I understand the plaintiff's frustration; the purpose of having a custom-made dress is to showcase it. Nonetheless, a backup dress should have been considered, as New Year's Eve is about celebrating with friends. The defendant creates beautiful dresses, as evident in her final product, but her business practices need improvement.

Everyone wants to be an entroreneur just because they have talent, running a business takes much more than talent. A successful business is often based on relationships with customers and how you make them feel. If customer service is lacking or nonexistent, most likely the business will fail or profits will be under potential

The girl that said the dressmaker did have the right to say that because she told her that it would not be ready until the day of. She no damn well if she paid somebody to make her dress she would not accept the fact that it would be ready the same day. I think the defendant bit off more than she could chew. Her pieces were beautiful but she just failed to produce a finished product for her client. Time is of the essence and I think this will be an eyeopener going forward. She's human. She carried herself well and she's pretty despite the negative comments about her eyelashes.

Judge gets on my nerves with “if you didn’t go, blah blah”. If it’s for CUSTOM dresses, and I PAID for a dress to be done and the deal wasn’t botched til the last minute, then why would I scrape up extra dress money at the last minute?? Everybody doesn’t want to go everywhere looking a mess in something they found at Dillards.

The defendant took the lady’s money and wouldn’t even confirm that she received her payment. I run a small business and my clients immediately get an automated email/receipt from me confirming their purchase and timeline.
