The plaintiff claims her neighbors damaged her property by building a chicken coop and a tool shed on her land, so the plaintiff is suing. The defendants claim they have been using the 30 feet of land in question for the past 17 years, so they have adverse possession of it.

Judge kind of settled that though by ruling in the owners favour and I'm thinking that it will have to be disclosed during any sale process. But who would want such neighbours, that's going to be a problem for her selling.

*self-entitled. "Entitled" means you really are owed something (ie "you're entitled to compensation") "self-entitled" means only you think you are owed something.

NO LADY! Don’t sell it. Then the bully lady wins. The judge explained to her how the law works. Now if she keeps harassing you take action. I’m shocked at how the little one acre lady thinks she has the right to use other ppls property without their permission. How would she like it if someone did that to their yard. Some ppl are unbelievable.

Why would the defendants feel they have the right to encroach on someone else's property? This is outrageous! You have no right to feel outraged, nor do any other neighbors. You are wrong, wrong, wrong! Please do not sell you land, just because of these ignorant people.

they had an agreement with the previous owner for many years and nothing was put in writing as to what would change if the property was ever sold . this judge may have been over her head on this verdict because the defendants can still appeal this decision and continue to use the property under the adverse possession laws which are basically a type of squatters rights , and they can still tie this up in court . thats why the plaintiff said she was gonna end up selling the property .

@@marleonetti7 Did you not listen to what the judge said? Adverse possession must be hostile, i.e. contrary to the owner's rights AND without permission. They had the consent of the previous owner to use that part of the property, so it by definition cannot be adverse possession.

@@cowgirlbebop14 well i looked up several sources regarding the definition of adverse possession and none of them defined or described it as hostile . it is a very old law that basically states that if a person or persons have been occupying property for a long period of time and treating it as if they were the owners without the owners consent to ALL that they were doing on and with the property then they can have a legal claim to the property if the owner for all those years never protests . which is EXACTLY what happened so why is this judge not understanding the law ?

They were renters and angry that the owner was through with them and pissed at the neighbor for calling on their trespass on her property. Encroaching someone's property is against the law. They though the plaintiff has no right to her acreage. She pays the taxes; it is her property. The defendants were out of line.

If I'd spent any amount of money on any size if land, it's mine. These people were encroaching 30 feet. THIRTY FEET. They have an acre. That should be enough room for anything they need. Put the chicken coop on your own property. Just because the prior owner was a pushover, doesn't mean new owner is. Why are the Defendant's acting like the Plaintiff is wrong for wanting THEIR things off her property. They seem like the type to complain to all the neighbors as well. Trying to turn them against the new owner.

well not so fast , adverse possession is a bit more complicated then this judge is telling us because its basically a form of squaters rights . and if the defendants had an agreement with the previous owner and no stipulation was given in writing as to what would change in the event that the property was sold then the defendants can still have a case with another judge if they appeal . that may be a big reason as to why the new owner is selling the property .

These ppl are probably the reason the last land owners sold their property. They didn't want to deal with this a**holes encroaching and bullying. She has a right to peaceful enjoyment of her property and she doesn't have that. It's not worth staying if you are miserable in your own home

the wife tore up the no trespassing sign, you can tell from the smirky look on her face, and yeah, maybe the desk isn't "hers, it's her kids, or husbands.... Who thinks that after Judge says to leave the party alone, and "no taking care of the property", bad things are going to happen to that property.

I mean they’re not wrong that if you use land and the owner doesn’t stop it then it can be a problem for the owner. Judge Judy has talked about it before, and when she bought a house she asked the neighbors to sign that she owned this portion of property or she’d build a fence. They didn’t sign so she build a fence right through what they were using as their front yard, so JJ could ensure there was no issue with rights later

I don't think JM was listening when the plaintiff said that they pulled out the iron pin that marked the property line. The area has to be resurveyed to place the pin in in it's proper place..

As a Land Surveyor….ALWAYS and I very strictly mean ALWAYS get a land survey done when you buy a new home or you get a new neighbor. It saves so many problems. Trust me, I could write a book on the shit I’ve seen.

@@mandylynnhoff Absolutely! And go ahead and let them move the wooden stakes. Let them waste their time! There should be metal pins in all 4 corners of your property (usually rebar but older properties have used any metal they had on hand, even found a tractor axel used for a corner pin once 🤣). So the important thing is to know where the pins are, cause that are MUCH harder to pull out. Have your surveyor mark those up when he adds the wooden stakes so it’s easier for you to see. Walk the boundary line with him and have him show you all the corners and pins so you know where they all are. And it might cost extra, but if any pins are missing…definitely pay to have it replaced. Those pins are very important. And ask the Surveyor to “flag the line” on the side of the problem neighbor. He or she will put pieces of survey tape or little flags or even a piece of string down the property line….and then take a PICTURE so you have evidence of where that line was in case you need to go to court. Good luck! The Courts side with the survey 99.999% of the time so it’s great ammo to have!

I've had simi!ar problems with the trash that moved into the property next mine, deciding that my property was theirs to park all of their vehicles on. After trying for over a year to politely ask them countless times to not park on my property, the meth addict threatened violence to me and I finally gave the owner written notice that I was going to start having vehicles towed. They've stopped parking there, but to this day, I'm still having to constantly clean up the overflow of trash onto my property.😡

Most land owners are not this entitled and respect land rights and surveys. If you do have a problem like this..contact authorities and keep a record of any time they come over. They can be arrested for tresspas.

I have problems with one of my neighbors because any time she doesn't like the plants I have on my property, she destroys them and makes up stupid excuses, like "I thought you'd like it better this way" when she chopped vines I had been training along my fence for 2 years, and she told the landscaper that I gave permission. Or "the previous tenants were fine with this" even though I've lived here for 10 years.

The defendants are absolutely ridiculous and vindictive. I feel bad for anyone buying it because they were remain a problem, as they feel entitled to that space.

The judge is dead wrong on the survey. It is illegal to pull the stakes/pins out. How does a judge not know this??!!

It would depend on where exactly they are but in most cases you can just pay for a new marking (pins/stakes) based on the survey she still had. Much cheaper than paying for a new survey.
