Yeah that was my thought, I think you have a right to know when you're sleeping with someone, perhaps even more so if it's transactional. And also she should have known that that was a risk, and always told clients just to be on the safe side. Of course it in no way justifies murder, or any kind of physical attack.

My thought as well and the sad part is regardless of what you want to be you would always have to disclose that you’re trans to someone that’s straight because that is the first protocol to safety/survival for them because a lot of people don’t like that let alone being deceived if you’re having intimate relations

Agree. To many men, it’s a big deal to be deceived. They want to be with a natural born woman and not transgender. and transgenders have to realize this and take precautions. Don’t just assume that every guy you meet will be ok with it. Of course they don’t deserve to be murdered either. All sex workers take a big chance, transgender or not.

You’re correct, but the word biological is unnecessary. “Shelby” was a man. The only thing we know for sure about him after his death is that he was a man. Every cell in his body is XY. But yes, men do have a right to not be tricked into having sex with other men.

Hi Eleanor, I'm sorry to keep bringing this up but I would be over the moon if you would consider doing this specific Swedish case at Malmölatinskola and sharing these vitcim's names and stories, Victoria Edström and Sara Böök. This case really hits close to home as they were my old teachers..and it's still affecting me even after graduating. But it breaks my heart because no-one (not even in our country) is talking about them, they were so lovely and deserve to be known across the world. But also that the defence lawyer was really trying to excuse everything with autism which makes my blood BOIL. I know I've brought it up multiple times but I hope you might consider it. But I am just pushing my luck at this point, hope you understand. May also sound a bit selfish but I think it might being sole closure to know that people are talking about them again. Thank you as always for doing these cases. What you're doing is so so important and that you give so much respect towards the victims. All the love x

The fact that the "gay/trans panic" defense is still legal in so many places, including where I live, is both disgusting and terrifying for me as a trans, queer person who knows and loves many other trans and/or otherwise queer people.

Honestly besides the guy being a terrible person and criminal, this encounter would've been prevented with simple communication and clear concent. Had she not been surgically changed and gotten as far as the bedroom, the same thing would've happened. Just confirming the person ur with actually wants u for you (meaning the person u were born AND the person u r now) is safer than what she did. It's dangerous as well, but no more dangerous than all other hateful people already out there looking to b mad about something. I'm not trying to victim blame. This person is gone, but for others, we all seriously need to get a clue and learn how beneficial communication is as social creatures. You can't control others, u can control yourself and all Tracy could've done to save her life would've been to say she was transgender. It would cost her money and clients but was it worth her life?

Its always really nice to hear LGBT+ stories outside of pride month, because they shouldnt be squeezed into a month just because thats "the theme of the month," they're still people who deserve to have their stories heard. It helps make me feel like these stories are more valued and less commercialized for lack of a better wird like the pride-month logos places have for exactly one month then immediately switch it back at the end of June. The LGBT+ community is around year round, and we representation to reflect that. Thank you Eleanor, I feel like you cover these pretty regularly and i personally really appreciate it

Although it does not excuse what this person did to Shelby. It's extremely important to disclose whether you are trans or not. Not because you'll get murdered or anything but for respecting the other person's preference whether the woman is cis or not. Again I do agree it's an extremely stupid reason to kill someone but it does matter.

I am so sad this happened to her, and that this happens to trans women to this day. Even thought disclosing is still dangerous, it lets you know how the other person feels about you before you take it any farther. I am not defending the criminal in no way, however there are a lot of people who get any homosexual thoughts beat out of them since childhood. So they never truly view transgender women as women. This is why it’s extremely important to disclose, especially in this line of work. Such a sad case

Nah, Disclosing in a public place is definitely the right call. Safety for trans people. And despite many people disagreeing, I insist it is the right of every person to know whether someone they are going to sleep with is trans or not. Bcause how close it plays into their own identities. You are not serving someone pizza you know. Sex has a very deep impact on our minds, idenitites and psyche. It isnt a flippant commodity. It is always better to respect yourself and the other person enough to be honest.

It would absolutely go against some peoples religious, cultural or spiritual beliefs to sleep with someone of the same sex (they may be different gender but still same sex in many peoples opinions). Not, of course, an excuse for killing someone EVER but people should be respectful enough to understand that there could be implications for some people if they engage in same sex relations (being shunned by their own religious/cultural groups for example).

great work Eleanor, for the record, not that I agree, but the lawyer is required to try any method to get their client off no matter how ridiculous it is. if they don't, that's when people try to blame their lawyers in the appeal process for improper council.

This one situation ended that way but Shelby specifically did exactly what she did to that man to countless other men who just didn't know. And she had no intention of telling them, if it was about safety and not money she would've told them and confirmed the people she was sleeping with WANTED to sleep with her as a transgender woman. Not to separate the two so blatantly but to not outright say you're a transgender woman leads people to assume u were born a woman which affects nothing except sexual preferences. I don't think it's appropriate conversation for anything else except of all people the person your intimate with. Things we can't see like viruses, we rely on people to tell us, we trust people to tell us. The honors system ring a bell? To say the least she can't stick up for herself and her actions show she would've gone about her days until this eventually happened even if it wasn't this guy. How many other guys would've done the same at the time? Shoot, the feeling of betrayal can come from finding out somone has kids and didn't tell u before sleeping with u.

I’d love to see you cover the case of Ashley Oullette. She went to a sleepover at her best friend’s house in February of 1999 in Saco, Maine. Around 4am the next morning she was found dead in the middle of the road. Anybody who lives in the area will tell you who killed her but the police have never had enough evidence to arrest that person.

i, myself am transgender and hearing this story is genuinely terrifying and disgusting. thank you for covering lgbtq+ topics and highlighting the hate crimes that happen to our community. i have a few opinions about this case. first and foremost, what happened to shelby should never and will never be forgotten. she was a beautiful, strong, independent, loved, valued, and respected person. what happened to her was 100% a hate crime. there’s no way around it. second, i know it’s controversial to say, but i think the murderer is trying to get away with assaulting other women. if they’re going to be locked up they want to be around people they can offend. i believe it’s them trying to make one last move towards living a life of violence, rather than being put amongst other men. i really hope we get an update on this case.

Seeing how they reoffended, I totally agree. I also had a hypothetical thought of what if they murdered shelby, and shelby was actually outed by the 2nd sw who found her body and they decided they would have a better chance using the gay panic defense (I still cant believe this is allowed!), to get out of going down for murder.

Im sorry but I don’t see how you can say something like that “respectfully”, no offense. I mean, maybe if you’re going to date them and see a future with them, maybe? But she’s a sex worker and he knew that. They were there to have sex. She is a woman with a vagina. It _literally_ doesn’t matter. It matters as much as needing to disclose that you’d had a boob job. I’m not trying to be rude or argue, I simply don’t agree and think if you’ve had sex reassignment surgery that it is only the business of you and who _you_ want to tell. I can’t see any reason that two strangers there for a business exchange, for her to disclose what her genitals used to be. Used to is the key word. If she still had a penis, I can understand. Whether a person wants to disclose that to a client is up to them but it is extremely dangerous for them either way. I hope you’ll take what I’ve said seriously you reconsider this point of view! A vagina is a vagina. Edit: we also don’t even know for sure that she didn’t disclose. This is from the murderer’s mouth only and from what was said about her, she was very open about who she was. It is very likely that she did disclose, he came and then felt ashamed and angry and then killed her, finally said she didn’t disclose as a defense.

If they had examined her genitalia and found too much hair for their liking and flown into a rage, we'd call them crazy. The fact they found scars and immediately KILLED a person is wild. Trans people do NOT deserve any type of violence. Of course not murder. However ,,, before having any type of sexual relationship with ANYONE they should have to disclose they are trans because EVERYONE has a right to choose who they have s3x with. And it protects sex workers as well. Also if you know ANYTHING about the Canadian judicial system when you are imprisoned awaiting trial all time waiting is used as time and a half. It is doubled based on timely trial laws. Sooooo itwas a law for all crimes. Not like the judge was playing favourites but he should have been locked away forever.

I think what he did was wrong and indefensible. However I think when youre talking about having intercourse with someone your sex/gender is important, and should be disclosed. I was literally dating a guy for about a month, when one night, somehow he got on the topic of transgender people. He told me that if he ever found out someone he slept with was transgender and found out after, he would beat the shit out of them. I got SO ANGRY!! He was also telling me that being gay was a choice. I was in shock at how ignorant he sounded. Needless to say I broke off that relationship immediately...I don't know why but he was the first person I thought of when I watched this 😡😡

That reminds me of someone I was talking to, who thought that all trans people were predators and/or trying to mutilate children. I chewed him out and dropped that shit IMMEDIATELY, I will not be tolerating any sort of hatred/bigotry towards my trans friends. I am sure this isnt the most popular opinion, but i appreciate the timeline specific pronouns. I've heard this case before from someone using only she/her pronouns and it really took you out of the moment/ made the relationships confusing. I think its just more respectful to... the scene. Years ago I briefly dated a "girl" who now identifies as a man. I am very respectful of that when we see each other, but i would never refer to him as an "ex boyfriend", that just wasnt the relationship I had with him. From my perspective, i was in a heterosexual relationship, it wouldnt be respectful to me or tthe storyline to retroactively change the pronouns when talking about that time in my life just because now "she" is a he.

I don't think he attacked her for being transgender. I might be wrong but that was not what they argued. He attacked her for not being told about the transition before engaging in physical activity. Of course the reason behind his actions is irrelevant as what he did was horrible and he should have been sentenced for murder. In my opinion. Since he is a repeat offender maybe he "transitioned" so he can be sent to a female prison next time..

I guess I'm not entirely understanding what you mean by the possibility of not killing her because she was transgender. She definitely should have disclosed it to him, but him finding out on his own, and then choosing to murder over it is definitely because he didn't like that she was trans. Had he found out on his own or through her that she was trans, he didn't mind, and he didn't kill her is the only way this case would have gone if he didn't mind that she was trans, besides the alternative of him saying "no thank" to any further interaction. I hope my explaining wasn't too difficult to understand, I did my best to take my time to think how best to say what I was thinking. If not, you can ask me for clarification. @@MelissaLawrence2002 I can imagine the scenario where she disclosed that she was transgender when he approached her for services and he could then say "I'm not into that and no thanks". I personally wouldnt feel good if someone did not disclose that to me prior to engaging in any physical activity or a relationship. Bcuz I would consider that as a lie by omission. It would make me upset. Not bcuz I have anything against transgender people but simply bcuz of the dishonesty. If someone already had some bad feelings against transgender people or doesn't consider trans women "real women", I can imagine them getting really angry in this situation, which could trigger aggression. Ofc aggression and violence is not acceptable in such a situation and I don't want to excuse such behaviour. I just think that maybe he would not have k*lled her if they were in a different situation, bcuz a simple existence of her as transgender did not trigger him but the fact that he was unknowingly having relations with someone transgender. Idk if I explained it clearly or just made things more confusing.

What is the point of pointing out what a victim should have done in a situation where they were murdered? It just feels so gross how so many comments are saying she should have done so and so. Since when is victim blaming ever constructive? Sure, maybe if Shelby had disclosed beforehand it could have saved her, but it didn't matter when it came to all of the vicitms that her murderer had. It's also not constructive to point out what a murder victim should have done or not done. They were murdered and the fault is of the murderer.

Jesus Christ, that is taking it very far. SA? Really? How do you justify that? If I go to have sex with a woman and she pulls down my pants to find a micropenis, does that make it SA? Disclosing to someone that you are trans is not required in any scenario. No one is entitled to that information, and sometimes it is safer to not tell the person that you are trans. If a man had sex with a woman and his penis was shaped a little funky, does that give her a reason to freak out because he "lied" about the appearance of his genitals? As far as I'm concerned, that's all this was. She had scars. That is it. That's the only visible difference between her and a cisgender woman. Having scars on your genitals and not disclosing that is not SA.

With all due respect I think Shelby should’ve of told him in the first place she was trans for her own safety. She was in a public place and should have told him. Like the person that murdered her was feeling that he felt betrayed, thinking that she was a real biological woman. because from what it seems, he was attracted to only biological women. But at the same time it doesn’t make an excuse for him to murder her. I don’t know if this is transphobia or not but like a person should disclosed if they’re going to have relations if they are trans because a lot of people that don’t disclose and end up getting murdered or some cases like this. And also having preferences to not date, trans men or women is not trans phobic there’s many transgender people that say it’s not transphobic to have preferences. But in this case it doesn’t like excuse him for murdering this person. That was just my opinion.

Shelby seemed like a sweet lady, and she did not deserve life being snatched away. That said, I strongly believed transgender women should disclose before hooking up, particularly with heterosexual men. It goes without saying no one should lose their life for being themselves but being up front (in a safe location) could save lives.

When she revealed to him what her profession was, she should have included the fact that she was also transgender while being surrounded in a space that she obviously felt safe in. Being in the profession for years, as described in the video, she should have known how to say it and when to bring it up. That being said, seeing things through the killer's POV is a bit much, people are just saying that they'd feel upset about it, not that they'd go to extremes and kill her.

Another example of the Gay Panic Defense is of (i think) The Jennifers Show and a guy got tricked into thinking a female was confessing her feelings when in actuality, it was a male. When the guy freaked out and killed the male, The Gay Panic Defense was used.

I agree with you. A transgender person should disclose that before hand, that give a choice for the person to go ahead with their date or wthever. If I have a child, who is transgender - the first rule I'll ask them to follow is to please reveal this detail about yourself before getting intimate with anyone. and to reveal it in public place as well. just heard about similar case few days ago. in my honest opinion it's REALLY dangerous to pretend that it's totally ok and safe to not disclose such an information.

@@bj.reo87 I personally do yes, IF you still haven’t had bottom surgery, if Shelby still had a penis she should’ve told him but she had her surgery, therefore she had no reason to out herself, if she was to be in a romantic relationship with him she could’ve then told him WHEN she was comfortable but she wasn’t in a long term relationship. There was no reason she should’ve lost her life that night.

I will comment this and not even read the responses because I bet they will be either kind & understanding or ignorant & vile, but thank you for telling stories from the lgbtq+ community. I am a part of the community, but I am not transgender so I cannot speak for any trans folk. But, when we people say “why do they need a pride month? How are _they_ brave? There’s no bravery in being ___! (Gay, bisexual, trans, etc)” But when I hear stories like this. Stories where people are assaulted, harassed, raped, and/or MURDERED for their sexual or gender identity, it answers that question easily. When there are people out there who want you dead for who you are or how you love, it _is_ brave to be open about it. There’s also no reason to compare it to the bravery of soldiers, I don’t understand why people feel the need to do that. There are different scenarios in which a person can be brave. Thank you for this video.

The person was murdered after violating a straight person sexually. The murder was wrong but the fact you can't see that is concerning and dangerous. I'd imagine there's plenty of men tricked or lied to who refuse to seek therapy they likely need afterward because of embarrassment. Lying for sex and money is NOT ok As a man I can speak from that perspective unlike you speaking for Trans people.

I think for a safety precaution if you are a transgender that you disclose of your status to anyone you plan to engage in any sexual act with. There are so many cases like this and there is even a Gay panic defense.

I’m trans myself and personally, that’s not always the case. Not only bc it could 100% just end up the same, but also bc in this case, she already had gender reaffirming surgery. The only situation in which I’d imagine it’s necessary is in a romantic relationship, pregnancy, etc. But other than that, if you’ve already had bottom surgery, I don’t see why you’d have to discuss it beforehand. Like I said, it could just turn out the same. Plus, just because their sexual partner had scarring doesn’t automatically mean they’re trans

If your preferences don't coincide with being intimate with a trans person, that doesn't make you transphobic. What makes you transphobic is murdering a person for being trans, regardless of them disclosing it to you or you finding out on your own. He should have just politely asked her to leave for being deceitful, and nothing more. Not everyone wants to have sex with a trans person, just like not everyone wants to have sex with the opposite sex or same sex, or any other type of person you may or may not want to have sex with. The right to say "no" was taken from the killer because she didn't disclose that very important piece of information. Just because it doesn't matter to someone doesn't mean it won't for everyone. The killer should be rotting in Hell right now, so don't think I'm trying to defend them. I'm merely trying to explain why it's important to share that with a potential client or partner. She didn't deserve to die for not telling him. He did deserve the truth to be respectfully told to him though. Now he deserves nothing but Hell.

Even if they’d see scarring, it doesn’t necessarily mean the person is transgender. I get where you’re coming from, but generally, in my opinion, we don’t owe anyone an explanation if their “needs” (for a lack of a better term) don’t require it

Maybe it's because I'm bi but I don't really understand the difference it makes. Yeah it might be a bit jarring if you're hitting on a cute girl and then she takes off her pants and has a dick, especially if you're only attracted to vaginas, but post-op? That's a vulva and vagina. So many cis women get reconstructive surgeries and cosmetic ones too on their genitalia that they never have to disclose - look at literally every professional pornstar out there! Not to mention the basic tissue is all the same because all human genitalia comes from the same precursor organs, and I mean *all*. I myself as a cis woman was surprised to find out how much of the tissue is the same when I did embryology as part of my MD. If you get into a relationship with someone who says they're a woman, you fully believe it and have sex with her, and for all intents and purposes the only thing that tips you off is some scars (which again, there's ciswomen who get labiaplasties), what's the big deal?

As a trans person, its best not to use the gendered terms that were used prior to coming out, even with criminals. Its unfortunate, but crimes like this, where a minority turns on their own and kill, is far more common and complex of an issue. Not to mention, it can encourage transphobia, and for some trand people makes them feel like their acceptance as people are based solely on acting correctly always. Not claiming to be a sociology major or anything, but thought i would tell tou so you can cover cases with trans individuals in a more nuanced way if you ever do a case similar to this again :)

For a one night stand or just sex I don't agree with that. You don't see that person after that night so it shouldn't matter. However, dating a person it would be nice to know beforehand. Absolutely, I came here to say this. NO ONE deserves to be murdered, and I understand the threat that trans women face, however, these things need to be disclosed for everyone’s safety and mental health. It’s important that trans women DISCLOSE that they are trans women. To some people that wouldn’t make a difference, but to some people it absolutely would- be it through trauma, cultural upbringing, ect. Sex work should be legalized across the board so it can be regulated and everyone can be protected.
