The plaintiff says he’s an Uber driver and the defendant rear-ended him while he was working. Even though the defendant’s insurance covered the repairs, the plaintiff says he lost $1,000 in fares while his car was in the shop, so he’s suing for lost wages. The defendant says the car was drivable and doesn’t believe it was in the shop for four days.

The insurance company did not cover his wages because he likely refused to provide accurate proof of what he typically makes just like he did in court. They are not going to pay out on things people don’t provide proof of. Insurance companies do have network shops but you can decline those and use the one you want anytime. It’s up to the vehicle owner. As far a Uber and Lyft, you have to have insurance that covers you using your car for work /delivery however most rental companies will not allow their vehicles to be used for ride share types of use.

I think if the plaintiff would’ve been able to express himself better he would’ve gotten a little more. He did show proof on (some) days he did make a lot more than $65 a day. I feel they should’ve averaged it out. It felt like the judge had to pull words out of his mouth. He didn’t explain anything right

But he also showed proof of large gaps where he wasn’t working at all. He’s was speculating. He tried to say he makes $250-350 a day and on both apps combined that wasn’t true. He was making maybe $500 a week

He makes more than $65 some days, and 0 on other days. The insurance company and Millian computed his average daily earnings and it came out to $65/day so that's what he got. He wanted to convince her that since he makes $250-300/day once in a while that he deserves that much for every day that his car was in the shop. That's not how it works.

uber drivers actually do only make around 60 to 70 bucks per day once all the gasoline , maintenance , and repairs for their car is deducted at the end of each month or end of each year .

Agree! I do both DoorDash and Uber at the same time. If the same thing happened to me, it would say maybe 65 on one app and 65 on the other so I’m technically out 130 a day potentially

He should have done a better job preparing if he uses multiple apps when asking for over a 1000$. I would have made an excel sheet with earning from both apps and use to app to prove what I put on the excel sheet is true.

If he had chosen to work he might have made a lot of money, but it's pretty obvious from his statements that he doesn't work every day so it's even less likely that he would have worked every day during the holidays.

WHAT? I don't think the judge understood that he works 2 jobs, and that between Christmas and the New Year would be the busiest time for him, so I think he deserved the $1000 he asked for and not the tiny 260 she awarded him...

When you have speculative damages the. The judge needs to speculate on what the damages were. Just because you did make $250 per day in the past doesn't mean that you will earn $250 per day. You could have a very slow week and only made $50 per day.

I am glad for Uber, taxis were too expensive and in the past, when I used taxis a few times, I wanted to pay debt and they always told me that their machine was down and they only wanted cash, right...

I feel terribly for him because he struggled to articulate his point and it cost him. JM didn't understand that he shuttles between both apps and tbh, he easily could've made $1000 during the period he was car-less.

Cheap insurance that wouldn't spring for a loner car. 4 Days is not out of line. A car is never worked on the day it arrives at a busy shop paper work to do, 1st they take it apart order any parts needed they may have to wait for the insurance adjuster to inspect and ok the repairs and parts many times they argue saying you can fix that part or your asking for too much time. do the repairs it than goes to the paint line were it's prepped and masked up. Car gets painted even when baked your better off buffing it the next day. Put it together detail it now it's ready

Four days sounds like minimal damage to car. Replace a bumper panel that’s already painted and a taillight. The plaintiff didn’t complain of injury, didn’t even have a picture of damage or cost of repair which says a lot and probably why it wasn’t in shop for a longer time.

Not sure why JM and the defendant thought 4 days in the shop is too many. I was rear ended late last year and the car was drive-able but it still took the shop 9 days to repair it. They originally told me it would be 2 weeks. They were pretty busy and parts had to ordered. Since the pandemic lots of things move slower these days.

The fair damages here should have been a rental car for the period in question---the plaintiff could have rented one direct through uber, even. He couldn't drive---but he also didn't have to work those days. It's not the defendant's responsibility to pay him for a vacation.

yes , if uber drivers really and truly made 250 per day take home , after deductions for gas , taxes , and other vehicle related expenses , then 80 percent of the population would become a uber driver . ha ha ha .

$250 a day is a reach, however, depending on the area, it's very possible. $65 a day was really low, even in less demanding areas. I think $100/day would have been fair. What killed him was the sporadic working days, which many uber drivers tend to work. Many like to bang out 2-3 12 hour days and relax the remainder of the week.(again depending on the demand in their specific driving zone) Also, many drivers use multiple apps and bounce back and forth depending on where the money is.

The average pay for an Uber ride is 3-4 dollars per ride. You can drive for 12 hours. A ride usually takes on average 20 minutes, sometimes longer, maybe shorter. If hypothetically someone did it for 12 hours, at 3 rides an hour, it's possible to make 250 a day.

And that's with the pay per ride being 3-4 bucks. They do have higher paid rides that can be over 100, those are out of town rides. They also have surges where they add on some extra money, oh and tips. My husband does Uber when hes not at his regular job. The most hes made in a few hours (he never does 12 hours) is a little over 100.

@Destiny Miller the prices riders pay as opposed to what the drivers receive are very different. However, it's still very possible if they're working in a high demand area, especially during peak times.

@LaLaLA LaLaLA yes. Uber drivers can make decent money depending on their area and what time they're driving. Where I'm from, if a rider is paying $11, the driver receives about $5 base plus whatever the tip is. I know someone personally who works three 12hr shifts (Thursday, Friday, and Saturday) and was able to replace her 9-5. It depends on many factors, but $250 was definitely possible.

In all fairness those 4 days would have been a busy time for him since it’s Holiday Season, people throwing parties, people shopping, people are just out a lot more & more inclined to call Uber for a ride.

An insurance provider has a Fav shop because they get $10 per hour off on labor. The body shop goes out of their way to please them because they send a lot of work there way. There may be cases where jerk wad adjusters have a shop that cut's corners for them because keeping costs down gets them raises.

I dont get how the judge doesnt understand how insurance works. I've been in 2 accidents (both not my fault so I didnt pay a dime..not even my deductible) and it always took 2 weeks and under to get my car back. The insurance pays for the rental and takes my car to their shop of choice.

im so tired of hearing about uber drivers making a grand a week and finding out its a bunch of boloney to make themselves feel better but in reality once all their vehicle expenses for each month and each year are deducted they only make about 10 bucks an hour and 400 bucks per week , not a damn grand !

I worked with a guy that bought hood daughter four cars because she kept totaling them playing with her radio. She was really on her phone. I swear it was all within a six month period. He was so stressed out at work. At first I felt bad but but by the time he bought the fourth one my well was dry and told him as much

Four days at a body shop tells me that car had minimal damage and parts were readily available. Sixty five dollars a day for a rental car is reasonable also. Uber only requires that your car is of a newer year( not ten years old) and insured with a valid license and registration. There was no reason he couldn’t have used a rental to do his job.

@@tunisiancrochetchannelseveral days is not acceptable IMO when that could be someone's only source of income🤨I once interviewed for a job in customer service for Uber and one of their questions was what if a driver called you after a passenger deficated in their vehicle seeking solutions? I said well I don't know your procedures but I would of asked if they got the vehicle detailed & try to reimburse the employee/driver. Then I informed I would take the appropriate steps to charge the consumer as well since they should be held responsible for being a liability, also making sure to monitor their account where it's fair that they don't give the driver a bad review ...Let's just say the team was full of ppl that aren't into giving the driver's that much of an advantage🤷

@@imwheyintoyou It is the way it is. The car has to be inspected and approved. And you have to show appropriate insurance that covers business use of the vehicle. I think the issue in this case is that the driver couldn't properly communicate. If he had shown that his earnings for the week (not by day) were down because of the accident, he would have gotten more money. But it's not the judge's job to figure it out for him. It was obviously that she didn't know how the ride share business works. He needed to be able to explain it to her.

Now that's a crummy decision. Clearly his proof of wages was more than $65/day. Not $250/day, but def more than $65! How did she come up to that figure? It was a slap in the face to the plaintiff. Did she dislike him? I don't get it.

So many of theses cases are lost because the litigants cannot properly communicate ......your honor Uber and Juno is considered GIG work....my pay is going to fluctuate if you look at week XXX i made $300 Plus around this holiday and according to demand - 12/26 - 01/01 is VERY busy time of the year - that week if had not my vehicle been in operable - I had the ability to make $250 per day - I shouldn't be penalized in wages due to his error - she did not COMBINE the UBER & Juno - she looked at one and the other - perhaps not $250 per day for all 4 days but $65 is a slap in the face

I deliver food. Some days I get 10 dollars and some days I make 70 dollars It depends on the day, the weather and the events in the town I live in. That is the problem with gigs and non salary weekly pay.

Judges are really reluctants when people ask/blow some daily incomes. It's a sensible ground, don't blame the plaintiff but i knew the judge would be hyper cautious, that's always the case. For exemple, if you are called to be part of a jury during a trial, you get paid a certain amount, but if you ask more, you need to justify your daily incomes and guess what ? Sometime court are very cautious to accept.

A lot of people saying he should have gotten more, but he just didn’t come prepared. You can’t say this is how much I COULD have made and have December income show different amounts each week, lowest $500. It’s assuming he would have worked those holidays when it’s shown he doesn’t work 5-7 days a week, it’s whenever he wants. If he showed proof that last year he worked those days or even in November thanksgiving week that yes he does work holidays I think it would have been a better argument.

Good job judge. I have friends that drive for Uber and usually during those days it's not that busy. People will need the ride mostly on new years eve. But not during that week.

@pakedermsfavs9080 points can be made. But you can't legally dismissal actual case just for someone's attire choice. What if a judge dismissed all cases that have a plaintiff wearing blue? What if you had a case and wore blue and got dismissed? Would you just accept it? Or would you go to the bar association to review your cases to get those rulings thrown out. You have to follow LAWS not fashion rules

@@ashleyrockefeller they haven't been putting on new episodes nobody's asking for new episodes or asking for stuff that they haven't already uploaded to KZfaq they are literally uploading the exact same videos they're already uploaded they have 26 years worth of content this has nothing to do with their cancellation
